Mom Thrilled at Calif. Violent Video Game Ban Being Overturned

COMMENTARY | The boys in my home range in age from 7 to over 30, so it shouldn't be shocking for anyone to learn that gaming is a common pastime in my home. In a 7-2 ruling Monday, the U.S. Supreme Court overturned a California law restricting the sales of violent video games to minors, declaring it an unconstitutional limit on free speech. As a mother of two boys who play video games, a quasi-gamer and an advocate for free speech, I am thrilled about the ruling.

As a mom, I take responsibility for the games that come into my home. It is my job as a parent to be aware of what my children are doing, what video games they are playing, and what books they are reading. Every game that comes through my door is inspected by the adults in the house to determine whether it is appropriate for our children to play. It is called parental responsibility.

I have long been an advocate for the First Amendment in its entirety, and it really bothers me when other people decide what I can see, read, or hear because they have determined it is for the good of all. It bothers me when places like California decide to take that right away from me as a parent and determine what my sons should be able to see, read or hear.

Can you imagine a world where you can't teach your children about history because violence from wars has been documented? Can you imagine not taking them into a church where a statue of Jesus being crucified is hung because it is a violent image? Can you imagine not being able to take your child into a museum because Caravaggio's "Judith" is displayed and it depicts Judith beheading Holofernes --a scene found in the Bible? I certainly can't. Just like I cannot imagine a world where someone dictates what books I can read, what art I'm allowed to observe, or what video games I'm allowed to play. And that is definitely not a world that I want for my children.

Lucy A. Daglish, executive director of the Reporters Committee on Free Speech, summed up the meaning of the ruling quite clearly:

"Time and again, from the early days of radio and television, to 10-cent comic books and now to video games, lawmakers have tried to limit speech for what they believe to be the public good. And each time, they have lost because the First Amendment will not tolerate such wholesale limitations on expression merely because someone has created a new mode of communication. The majority decision ensures that violent content in any medium, including content produced by news outlets, will not come under the same censorship."

Son: "Daddy-daddy, can we play some ultra-violent video games?"
Dad: "Not now, son. I have to clean my 15 AK-47's and make sure all the anti-tank missle launchers are fully loaded and that might take awhile."
Son: "Aw schucks, daddy. We never get to play any ultra-violent video games any more!"

Wasn't it just a few years ago when the Moral Majority (i.e. Republicans) wanted these bans? Wow how times have changed.....

Ok im sorry but if the parents arent smart enough to set the parental controls on little timmys xbox or wii then its their own damn fault.. Its not hard. When you turn on your xbox go all the way to the right until you see the settings tab. press A. youll see parental controls tab in there.. Ta Daaaa.. five minutes and you can keep jr from seein boobs and or blood on any of those video games he tries to sneak from his buddies house.. make sure to use a password that he wont guess either.. dont use your own birthday or the last four of your phone number.. thats to easy.. kids are little sharper than you think they are.. lol

Glad you can work a video game. When will you learn to spell and use the English language????
    • Steve  •  11 mths ago
For anyone worried that "Little Timmy" might grab a game you find objectionable and play it when you aren't looking Google "parental controls esrb pdf" and read that, it shows you how to set parental controls on every modern console so you can lock out games based on ratings. If you only want Timmy to play "E for Everyone" rated games and they try to put in a Grand Theft Auto (rated M) it simply won't play.

This is of course assuming you would actually tell your child "no you can't do that" and enforce it, which most parents don't seem to want to do. Word of advice, you can be their friend later when they grow up... now you need to be a parent.

PS - I'd post the link to the PDF directly but it looks like Yahoo won't allow that.

I think it's fascinating that the part of my comment they SHOW is the 2nd paragraph not the first. It really changes the context to people who don't click on it to see the full post.

Parental responsibility, huh. What an interesting idea.

Gonna have think about this one for a while...

The law restricted the SALE of violent games to minors, not your right to decide what your child can or cannot play! So you would rather the store sell the game to your kid and them sneak it into the house, which, by the way, takes away your right to decide what your kid can or cannot play....I cannot believe they repealed this law. So, what's next, do we allow the sale of alcohol and ciggarettes to minors as well?
    • Mike  •  11 mths ago
Does that mean we should have the right to burn the US flag as free Speech? Or say as a group peek in every window of a house as a right to free speech because we want to see you and report to our neighbors what you are doing? Have you watch NCIS, Law and Order, or other shows that show the gore and murders and do you block them so your kids don't see violence? As a parent I thought I was using parental guidance, then after they got older and live on their own...the stories come out. Even I did things my parents didn't know about at my friends house where parental guidance was gone!

BOYS IN YOUR HOME OVER THIRTY ? ARE THEY POTTY TRAINED ?

Bigger government = less liberty. Less government = more liberty. With liberty comes responsibility. If we are not a moral, responsible society with self control and self reliance, then we do not deserve liberty. Man is capable of self governance but he must be taught the value and worth of liberty and the responsibilities that come along with it. I for one am very pleased the court is upholding my first amendment rights. Don’t be so quick to allow anyone to take away your rights, even for “your own good” it’s a slippery slope that ends in slavery.

Great job! I have a houseful of boys (including one over 30 as well!) Boys and their toys!:) I'd much rather they be here fighting it out on the screen than out somewhere doing those things for real. And honestly how many kids can't tell you that video games are not real life? It's imagination, it's creativity and it's a release that kids need to get out of their systems. I say, let 'em play, let 'em shoot things and beat people up- on the games and maybe they won't get so much pressure built up that they become terrorizing gang members or psychopathic school shooters.

I think what breaks my heart is the censorship of literature in school far more than video games, books of timeless value lost to the illiteracy of false morality.

Enough soap box time for me. Kids learn what they see in their parents, an old military adage, "lead by example" worked for us. Like his father, my son is on his way to becoming a career US Naval Officer.

Dear Mom: You are raising your boys to be serial killers. Oh and a boy over 30 is not a boy anymore.

My son, now almost 20 never liked video games, we never had them around the house, he never seemed to mind, he liked to swim and surf. Video games were never an issue with him. He liked his pullup bar, his board and his down time with the tv itself.

Since my ex and I divorced, we maintain close contact, he's going into his senior year in college, he still has no use for video games although I'm sure he sees them. Some of his friends game. I have an Xbox 360S (privilege of bachelor life) and my own son taunted me for having video games when he came to stay with me. I was told I'm going to end up a 'fat old couch potato' if I keep messing with those games. Yep, video games really had an effect on him, censorship, not an issue, it's up to the parent's and the kid to see what is and what isn't in this world.

None of us give a rat's butt about the bible, but we wanted the kid to grow to appreciate what he likes. He just never cared about this kind of stuff. He grew to love the sea, my ex and I encouraged it. Maybe he sees Neptune as the God of the Sea, I do. We never forbade or censored anything, why should we, life comes around quick enough any way.

Kids learn what they live, taking many queues from their parents. Feed you kid cheese doodle and a steady diet of nothing important, that's what you'll get; a big fat cheese doodle of a kid who does nothing. Open the doors to show you kid a path to excel and he will gladly find it, mine has.

Don't blame the game, blame the parents.

Right on sister, its nice to listen to some intelligence for a change. But I really liked what you said about parental responsibility. However instead of playing video games I suggest crawling around in the wood playing war its better for them Physically and Mentaley. Just a Thought
    • Ruth  •  11 mths ago
This is not mush different then your kids going to the movies, they have RATINGS. under 17 can't see a R rated movie without parent being with them. There PG-13. Video game also have ratings and video stores are not selling games to those that don't meet rating. My husband and son go together to buy video games and my husband has taken games back do to the langage & too violent for him. Let parents decide what is best for there kids.
    • Inlovewithlife  •  11 mths ago
It's great that you are a responsible parent, but let's be honest with ourselves, there are a lot of absent, bad, and irresponsible parents out there. By having this law in effect, it put some responsibility on the store to not sell especially violent or thematic games to children who are obviously too young to handle such violence without parental guidance. While I agree with the Free Speech argument, I am not convinced that this is a good decision for day-to-day living.
    • l5int  •  11 mths ago
Are you sure you are a parent. Do you really have books in your home. Anyone who permits their children to play video games has little or no sense. I heard that a company in Texas that produces video games is going full steam ahead in this time of unemployment and stagnent paychecks. This down economy doesn't seem to be a problem for those who abdicate their roll as parents by wasting money to keep their brain dead children happy while not being able to put other than junk food on the table and teach their children responsibility. I hope you are not being paid for your juvenile ramblings Mrs. StCyr
