    Navy officer, partner wed in Vt. as ban ends

    DUXBURY, Vt. (AP) — Just as the formal repeal of the military's "don't ask, don't tell" policy took effect, Navy Lt. Gary Ross and his partner were married before a small group of family and friends.

    The two men, who'd been together 11 years, decided to marry in Vermont in part because the state is in the Eastern time zone.

    That way, they were able to recite their vows at the stroke of midnight — at the first possible moment after the ban ended.

    "I think it was a beautiful ceremony. The emotions really hit me...but it's finally official," Ross said early Tuesday.

    Hours before the change, the American military was also making final preparations for the historic policy shift. The Pentagon announced that it was already accepting applications from openly gay candidates, although officials said they would wait a day before reviewing them.

    Ross, 33, and Dan Swezy, a 49-year-old civilian, traveled from their home in Tucson, Ariz., so they could get married in Vermont, the first state to allow gays to enter into civil unions and one of six that have legalized same-sex marriage.

    Ross wore his dress uniform for the double-ring ceremony that began at 11:45 p.m. Monday at Duxbury's Moose Meadow Lodge, a log cabin bed-and-breakfast perched on a hillside about 15 miles northwest of Montpelier. The lodge says it hosted the state's first gay wedding in 2009.

    Justice of the Peace Greg Trulson proclaimed the marriage at exactly midnight.

    "This is Gary's official coming out," Trulson said.

    Ross and Swezy were joined by close friends and some family members who shared champagne and congratulations with them after the ceremony.

    Ross said he plans on having a full career in the military. "We're thrilled the policy is gone," he said of his and Swezy's reaction to the end of "don't ask, don't tell."

    Pentagon press secretary George Little said Monday that the military is prepared for the end of "don't ask, don't tell," a practice adopted in 1993 that allowed gays to serve as long as they did not openly acknowledge their sexual orientation. Commanders were not allowed to ask.

    Last week, the Pentagon said 97 percent of the military has undergone training in the new law.

    In preparation for Tuesday's repeal, all branches of the military have spent several months updating regulations. Lifting the ban also brings a halt to all pending investigations, discharges and other proceedings that were begun under the old law.

    President Barack Obama signed the law last December and in July certified that lifting the ban will not diminish the military's ability to fight. Some in Congress remain opposed to repeal, arguing that it may undermine order and discipline.

    Existing standards of personal conduct, such as those pertaining to public displays of affection, will continue regardless of sexual orientation.

    There will be no immediate changes to eligibility for military benefits. All service members are already entitled to certain benefits, such as designating a partner as a life insurance beneficiary or as a caregiver in the Wounded Warrior program. But Swezy won't receive military health insurance or access to a support group when Ross is at sea.

    Gay marriage is an even thornier issue. A Navy proposal to train chaplains to conduct same-sex civil unions in states where they are legal was shelved earlier this year after more than five dozen lawmakers objected. The Pentagon is reviewing the issue.

    Ross, a 2002 graduate of the Naval Academy, is a surface warfare officer at the Army's Fort Huachuca. He expects to return to sea next spring.

    He met Swezy in early 2000 while Ross was still an academy student. At the time, he didn't think through the personal implications of the military's ban on gay and lesbian service members serving openly. But as his relationship with Swezy grew, it became important.

    Their Tucson home is about a two-hour commute from Fort Huachuca, which is near the Mexican border. Under "don't ask, don't tell," Ross could not talk about his relationship with Swezy, but he said some of his co-workers must have known.

    "Anyone with any moderate perception could have figured it out," he said.

    When he goes back to work Thursday, Ross isn't planning to advertise that he's married to a man.

    "Even though the law goes away, it will still be the white elephant in the room until everyone comes to terms with it," he said.

    Ross said the end of "don't ask, don't tell" will simplify many aspects of his life.

    "It requires you to lie several times a day," Ross said of the old system. "Being in the military is extremely invasive. It becomes a web of excuses you make when you try to be as honest as possible but you can't be honest."

    He hopes being able to talk about his relationship will make his work easier, too.

    "If you're standing watch at midnight on a surface ship there's not much to talk about," he said. "It becomes very difficult to trust someone you can't be honest with."

      not to mention when they met while he was a student at the Naval Academy....so let me get this straight, his gay lover which at that time was approximately 35 while the mid-shipmen was 19? This is plain and simple sick, it's not normal for men to behave this way....there is nothing humane about this and it's sick, disgusting, will prove to be a brown smear (no pun intended) on the US military, human kind, and men who have to endure some gay man looking at them in a shower during boot camp. There is NOTHING normal about this whatsoever. They are sick and need mental help, especially the old dude that picks up Navy boys that are 16 years younger. Unbelievable...

      As a 22 year veteran of the U.S. Army I really don't care what people do behind closed doors as long as they show up and do the best job they can. But, if any gay or lesbian doesn't make promotion I would hope they look at why they didn't get it and not just cry "discrimination". I've been passed over before and before I got too upset I sat back and figured out "why" and if it was something I could correct I did. Hope they do the same. Otherwise, whatever. Don't care if someone likes someone else same sex.

      In response to Christophers post... You wanted "proof" that homosexuality is not a choice. There is hard, scientific, genetic proof that the brain chemistry and make up and hormone levels are much different in gays and lesbians,than in straight, heterosexuals. That is proof that there is a difference in the way that homosexuals do not have a choice in their sexual preferences, it's in the way they were made and created. Now that is not to say that there are some people out there who "choose" to be or go gay for whatever reason, just like there are some homosexuals who "choose" to be straight because they refuse to accept who they truly are? There is no right or wrong answer here? It is simply that EVERYONE no matter gay, straight, bi, black, white...should all be treated equally and fairly and given the same rights and opportunities that others have, regardless of who they are in love with, and should not be judged and condemed because of it. Accept each other and our differences, because if we were all the same the world would be a very boring place don't you think?

        I agree with your position. My take on the issue is that until science can definitively show what causes human sexuality - gay straight or otherwise - we will not have absolute proof that being gay is absolutely innate or not. In the mean time, scientific research does provide many studies and plenty of evidence to indicate very strongly that being gay is an innate characteristic. These studies include research on brothers and birth order, twin studies, pheromone and brain scan studies, maternal genetics studies, animal studies (10% of male sheep are gay), etc, etc, etc. None of these scientific studies comes up with a conclusion that being gay is chosen, so no scientific evidence indicates the idea that being gay is a choice.

        It is true that individuals can behave differently than their innate sexual orientation for a variety of reasons. These reasons include making money, societal pressures including religious affiliations, sexual trauma, etc. But none of these chosen behaviors has any indication that an individual's innate orientation is changed. Even the statements of so-called ex-gays betray this reality. One married ex-gay man claimed to be a better lover for his wife because his lack of interest in heterosexual sex meant he could last longer during their love making. How many ladies would find this to be a true benefit?

        I would also agree with your statements, Rob, that even if being gay is a choice, it should have no bearing on how American citizens are treated. Americans claim to value Freedom as a founding principle of our government. Freedom necessarily implies choices individuals make about how to live their lives. If an individual finds that he is more attracted to others of his same sex and chooses to build relationships that include sex with same sex partners, he should be free to do so regardless if anyone else approves. Blacks should not be required to straighten their hair or lighten their skin to appear more like white people to be acceptable to the majority of society. No one should have to join any particular religion to be acceptable to those belonging to a majority religion. These are all impediments to individual Freedom just as any requirement of gays to become or to appear as straights is an impediment to Freedom.

      The issue now will be about military benefits. Will the military recognize same sex spouses and pay benefits as they do to heterosexual couples. I served and never cared about someone's personal sexual orientation so long as the person did the job. I am not so naive as to believe that I did not serve with homosexuals or that homosexuals never served in the military until recently, but the issue is much bigger now. Right now it is up to individual states to decide the legality of same sex unions, so what happens when the Federal Government has to make a ruling about it due to military benefit issues? If the Federal Government rules in favor of recognizing military same sex unions for benefit purposes, then will that then be imposed upon individual states? How will states rights play into the debate? What about gay/lesbian National Guardsmen that are on active state orders, does the state have to pay benefits because they use the same pay scale as the Army even if the particular state does not recognize same sex unions? I think that the courts are going to be very, very busy with this issue very soon and I am not sure that the answer will be clear cut or easily reached.

      I figure since these people are fighting for the right to enjoy freedom, unless you criticizers are prepared to pick up a gun and stand at post with them (and I suspect not many are), then I also figure you don't have much of a leg to stand on in picking who is gonna fight your battles. Frankly, I don't care if the soldier likes meat or #$%$ if you're gonna go out there and put your life on the line, then you've got my respect.
