    NY Deli Worker: Employer Demanded I Have an Abortion to Keep My Job

    A wildly unusual story is making its way out of Long Island, New York, where a woman is claiming she was told that if she didn’t abort her baby, she would lose her job.

    According to a federal lawsuit, the woman, 25-year-old Catherine Rizzo, was given this bizarre ultimatum when she was pregnant with her third child. Rizzo, who worked at Cooky’s Deli in Bohemia, claims that the situation unfolded earlier this year.

    In an interview with the New York Post, the single mother claimed that the owner’s daughter pulled her aside and told her that the abortion would be necessary to keep her job. “It was very, very clear,” Rizzo said.

    Here’s where the situation gets a bit murky. Rizzo proclaims that she already had two children at home and that she was desperately in need of the job at the deli counter, which gave her $400 to $500 per week. Because she couldn’t afford to lose her employment, she says she was forced to terminate the pregnancy.

    “As a direct result of this serious threat, approximately one week later, [I] was forced to terminate [my] pregnancy,” reads Rizzo’s lawsuit, which was filed on Dec. 19 in Brooklyn federal court. As a result of this startling claim, the young woman is seeking unspecified damages.

    In addition to the alleged forced abortion, she also claims that she was harassed by a fellow co-worker. While she says that she complained to management, she alleges that nothing was done to curb the incidents. “I stayed there because I needed my job, and I got the blunt end of the stick. I was trying to deal with it on my own,” she explained.

    Following the abortion, Rizzo was subsequently fired in August. Then, she and her children were evicted from their apartment. On the bright side, she was able to secure a new job and a new home. But she claims Cooky’s Deli employees began showing up and photographing her at work.

    Martin Marsilio, the 69-year-old owner of the deli, denies the abortion allegation and, according to the Post, has dubbed the claim “a total lie” and “fiction.” Additionally, her former boss claims she was fired because she was chronically late and that she never filed complaints over harassment.

    “We have had many female employees here that have gotten pregnant, had their children, took time off and came back to work,” Marsilio said.

    As far as the charge that he has followed Rizzo to her new job, Marsilio isn’t ashamed to confirm. But rather than simply attempting to stalk Rizzo, he says he was trying to prove to the state’s unemployment office that she was working off the books.

      Sounds like she got fired. In New York, it is very easy to collect unemployment compared to most other states, so she started collecting. The old boss found out she was working off the books and began investigating so he could report her for fraud and lower his unemployment premiums. She found out she was being investigated and concocted this story.

      The owner didn't want his unemployment insurance rates to go up....get it? There are a lot of people collecting unemployment and working under the table. If you turn the person in it is likely nothing will be done, there aren't funds available to investigate. I used to work for unemployment. A picture is worth a thousand words.

      It may sound crazy, and I don't know who is telling the truth, but a few yrs ago a doctor was hiring staff for his office. His office manager, doing the interviewing, asked each and every one (all female btw) "are you going to have children" or "are you going to have any more children".....this, in case people don't know, is an ILLEGAL question to ask someone applying for a job. She was an older woman, so maybe she didn't know, but she could have gotten the dr and herself in a lot of trouble if anyone had seriously complained.

      I don't believe this deli workers story. The owner said he took pictures of her at her new job to prove to the unemployment office that she was working; that is something I can believe.

      I am pro-choice but this lawsuit seems completely wacky. I'll reserve judgment but I hope the former employer sticks to his guns and doesn't settle this.
      I mean, the simple fact that previous employees have had kids, gone on leave and come back is more than enough of a defense.

      How come she did not file a harrassment claim before she was fired, before she took another job, before she hired a lawyer to support her fabricated story. She had the abortion on her own will, nobody forced her and felt so guilty about it, she created this story.

        Even if her story is true, no one forced her to have an abortion. She obviously wasn't too desperate for the job if she chose to become pregnant. As a single mother of two children, she is sadly lacking in responsibility.

      The story does sound fishy. First of all she should never have listened to the owner's daughter. She was not her boss. She should have went to the boss to confirm what he wanted and taped the conversation. Then if the owner confirmed, she should have went to the government agency in that state that protects workers rights. This is 2012 and workers have rights. If she really wanted to keep the baby, this is the route she should have taken and told the owner's daughter to go pound salt.

      I know enough about the way that NYC & LI work to know that her story is totally bogus .
      If Ms Rizzo wanted help from the authorities before she had her abortion then it was readily available to her

      This woman’s story might have been credible had she not gotten the Abortion. She just got caught trying to collect unemployment benefits while working under the table. BTW, with two kids what was preventing her from applying for welfare?

      I'm not buying her story, It doesn't make sense to me. No one can force you to have an abortion. If this happened to me I would be unemployed. I'm wondering if she chose to have an abortion and now regrets her decision so now she's putting the blame on someone else? I don't know, just weird.
