Obama yields on smog rule in face of GOP demands

WASHINGTON (AP) — In a dramatic reversal, President Barack Obama on Friday scrubbed a clean-air regulation that aimed to reduce health-threatening smog, yielding to bitterly protesting businesses and congressional Republicans who complained the rule would kill jobs in America's ailing economy.

Withdrawal of the proposed regulation marked the latest in a string of retreats by the president in the face of GOP opposition, and it drew quick criticism from liberals. Environmentalists, a key Obama constituency, accused him of caving to corporate polluters, and the American Lung Association threatened to restart the legal action it had begun against rules proposed by President George W. Bush.

The White House has been under heavy pressure from GOP lawmakers and major industries, which have slammed the stricter standard as an unnecessary jobs killer. The Environmental Protection Agency, whose scientific advisers favored the tighter limits, had predicted the proposed change would cost up to $90 billion a year, making it one of the most expensive environmental regulations ever imposed in the U.S.

However, the Clean Air Act bars the EPA from considering the costs of complying when setting public health standards.

Obama said his decision was made in part to reduce regulatory burdens and uncertainty at a time of rampant questions about the strength of the U.S. economy.

Underscoring the economic concerns: a new report Friday that showed the economy essentially adding no jobs in August and the unemployment rate stubbornly stuck at 9.1 percent.

The regulation would have reduced concentrations of ground-level ozone, the main ingredient in smog, a powerful lung irritant that can cause asthma and other lung ailments. Smog is created when emissions from cars, power and chemical plants, refineries and other factories mix in sunlight and heat.

Republican lawmakers, already emboldened by Obama's concessions on extending Bush-era tax cuts and his agreement to more than $1 trillion in spending reductions as the price for raising the nation's debt ceiling, had pledged to try to block the stricter smog standards as well as other EPA regulations when they returned to Washington after Labor Day.

A spokesman for House Speaker John Boehner, R-Ohio, had muted praise for the White House Friday, saying that withdrawal of the smog regulation was a good first step toward removing obstacles that are blocking business growth.

"But it is only the tip of the iceberg when it comes to stopping Washington Democrats' agenda of tax hikes, more government 'stimulus' spending and increased regulations, which are all making it harder to create more American jobs," said Boehner spokesman Michael Steel.

Thomas Donohue, president of the U.S. Chamber of Commerce, said the move was "an enormous victory for America's job creators, the right decision by the president and one that will help reduce the uncertainty facing businesses."

White House officials said the president's decision was not the product of industry pressure, and they said the administration would continue to fight other efforts by Republicans to dismantle the EPA's authority.

But that was little consolation for many of the president's supporters. The group MoveOn.org issued a scathing statement, saying Obama's decision was one it would have expected from his Republican predecessor.

"Many MoveOn members are wondering today how they can ever work for President Obama's re-election, or make the case for him to their neighbors, when he does something like this, after extending the Bush tax cuts for the rich and giving in to tea party demands on the debt deal," said Justin Ruben, the group's executive director.

The American Lung Association, which had sued the EPA over Bush's smog standards, said it would resume its legal fight now that Obama was essentially endorsing the weaker limit. The group had suspended its lawsuit after the Obama administration pledged to change it.

Obama's decision, in fact, mirrors one made by Bush in 2008. After EPA scientists recommended a stricter standard to better protect public health, Bush personally intervened after hearing complaints from electric utilities and other affected industries. His EPA set a standard of 75 parts per billion, stricter than one adopted in 1997, but not as strong as federal scientists said was needed to protect public health.

In March, the EPA's independent panel of scientific advisers sent a letter to the agency's administrator, Lisa Jackson, saying it was its unanimous recommendation to make the smog standards stronger and that the evidence was "sufficiently certain" that the range proposed in January 2010 under Obama would benefit public health.

But the White House, which has pledged to base decisions on science, said Friday the science behind its initial decision needed to be updated, a process already under way at EPA. The smog standard now is to be revised until 2013.

Whether Obama still occupies the White House at that point depends on the outcome of next year's presidential election.

Cass Sunstein, the head of the White House regulatory office, said changing the smog regulation now, only to have it be reconsidered again in two years, would create unnecessary uncertainty for the private sector and local governments.

The stricter limits initially proposed by Obama would have doubled the number of counties in violation. Smoggy cities such as Los Angeles and Houston would have been joined by counties in California's Napa Valley and one in Kansas with a population of 3,000. They would have had up to 20 years to meet the new limits, once EPA settled on a final number, or would have faced federal penalties.

In his statement, the president said scrapping the stronger smog standards did not reflect a weakening of his commitment to protecting public health and the environment.

"I will continue to stand with the hardworking men and women at the EPA as they strive every day to hold polluters accountable and protect our families from harmful pollution," Obama said.

Even before Friday's decision — announced as many Americans were paying more attention to their Labor Day weekend plans than the news — the White House has faced some criticism for its record on the environment. Obama abandoned a campaign pledge to set the first-ever limits on the pollution blamed for global warming, and he announced an expansion of offshore drilling before the Gulf oil spill sidelined those plans.

However, he has successfully taken other steps to reduce air pollution, such as doubling fuel efficiency standards for cars and light trucks, clamping down on pollution from power plants that blows downwind and setting the first national standard for mercury, a toxic metal, from power plants, all in the face of Republican and industry opposition.

The ground-level ozone standard is closely associated with public health — something the president said he wouldn't compromise in his regulatory review.

The Chevy Volt isn't selling so his $6 billion GM bailout is also a bust. Everything this guy does is a bust.

The Environmentalists would rather have all of us living in caves, naked, foraging for food and dying at 30 because there should be no industry, no medical industry, no housing industry, no agricultural industry, no transportation industry... It does not matter what you do, if you want a technological society there will be pollution period... So, be the first in your neighborhood to give up your computer, cars, boats, motorcycles, synthetic fabrics, carpets, furniture, television, refrigeratures, ovens, stoves, microwaves, disposable diapers, etc...

Ah. You haven't heard of fully insulated homes (and not mega-sized homes) and buildings, high efficiency heating and cooling systems, solar heating and cooling, geothermal heating and cooling, wind turbines, both on, and off shore, electric cars and small trucks, CFL and LED light bulbs, using your phone and computer to keep in touch with distant friends and family, instead of traveling to see them so often, teleconferencing, instead of a whole bunch of people driving hundreds of miles to sit in the same room, etc., etc., etc.
      • TTown 8 mths ago
Yep, heard of them and use them, BUT the environmentalists do not seem to understand that to MAKE these products pollution occurs and for some of these products the by products of manufacture are worse than the problem they solve. Over the life, including the manufacture of the product, such as an Electric car what is the carbon footprint? you maybe surprised... Or are you one who believes that these things are just pulled out of a magicians hat?

With the economy being in the dump, is it only me who has noticed, by breathing outdoor air, that it's getting worse? I find the chief offenders are cars and trucks that need work on their emissions systems; work that obviously hasn't been done, most likely because the owners can't afford it. Then there was the 5 week long heat wave in July and early August, in which my lungs were literally burning, when exercising outdoors. The coal-fired power plants were maxed out, and putting out prodigious amounts of pollution.

Who needs republican president with liberal opposition when a democrat president is willing to accept all our demands and his cronies have to go along with him because he's the president. If I were a liberal I would question his loyalty...but LOL.

This is hyped out of all proportion. The facts are these: Bush's "clean air" regulations were utterly without scientific foundation. There wasn't much disagreement about that. Obama had said he would put something better on the table before the old ones expired, as it's kind of pitiful to be funding something meaningless. Then I think he suddenly realized he's involved in a re-election campaign, so he withdrew his proposal. That means Bush's regs continue to apply. If Obama wins, he'll have to come up with new regs during the first year of his second term. If he loses, it'll be somebody else's problem.

one of the prime sources for ozone has been recently dictated by the Democrats in congress. Ethanol emissions may account for 40% of the ozone now being generated.
      • Not Here 8 mths ago
It's hard to figure out why Bush dumped such gigantic sums of money into expanding the ethanol program. Many suspect it was solely to benefit the venture capitalists.

obama did not say why he really backed off, but the reason is pure politics. The rule would have forced the shut down of 8.5% of US power plants by next summer. Charlotte, NC, the sight of the Democrat convention is an area that would have lost 25% of its power and the utility there informed the Obama campaign & administration (same thing really) that they would have rolling blackouts in Charlotte by August and under NC rules, they could not guarrenttee the convention would not be disrupted. A nationwide demonstration how Obama policies are turning the US into a third world country and a political disaster for Obama.

OBAMA NEEDS TO START SAYING NO...to these GOP/teabag terrorists....Its time to stand up and fight these enemies.....and that is what they are....enemies of the US and of you. Wake up america.....

More tired old pseudo-class warfare left over from the days when socialism seemed to some in the US an alternative to the developing nannystate; then actually severely strapped and constrained capitalism during the last half century. Some of those ideologues still suffer under the propaganda which they consumed freely in that era. It over. The most radical socialist nations were the first to throw off the social engineering fallacy and built the Global Economy which the US must now join or compete with. The former will be difficult because of old and obsolete business processes and uncompetitive practices. The latter will be eco-suicide and third world status of the US much as Spain, Rome, Athens and France are today [not to mention those empire states which perished] Creative Americans are in action and innovating as we speak, you won't see them running for office or issuing TV interviews.

Hey Charmonium5, are you happy with those wonderful capitalists outsourcing about 4 million of our manufacturing jobs to foreign countries, along with about 3 million service jobs? Of course that doesn't include the jobs we lost by buying foreign made automobiles, SUVs, trucks, earth movers, etc.

Have you looked at our trade deficit lately?

jackr,,, You can thatnk "cash for clunkers" for the a great deal foreign car sales. The foriegn car manufacturers do. It the policies of the administration that has forced the jobs elswhere. They have created the most unfriendly policies toward industry with the highest corporate taxes, EpA regulations, Obama has cripled any form of domestic oil production. It is not a crime to make as much money nfor ypourself and or your shareholders. It is a crime not to.

So I googled "is ground-level ozone a real problem?", and here's a very good article I found:

      http://www.k12science.org/curriculum/airproj/ozoneprimer.html

My next step, tomorrow, is to research what the levels are in Toledo, OH. I have a mild case of cystic fibrosis, and I sure don't need any further damage to my lungs.
      • JamesB 8 mths ago
the real issue is what level causes health issues. There is in fact no data that supports tightening the standards. We have seen significant health benefits up to about 2000, but there is decreasing benefits documented since and not everyone has reached the current standards. In fact there is another few years before it is fully enforced. If you have personal issues, talk to your Doctor.

I read the website and what it does not tell you is that ozone is an unstable chemical. It breaks down and reforms at ground level. We actually do not know what created the ozone layers, but there is new evidence that they were created by the most massive volcanic eruptions. In fact, one of the largest sources of ozone is volcanic activity. What is also not told is the fact that freon was banned based on ground level testing of how it breaks down ozone. However, when the same tests were run in atmospheric chambers with the correct temperature and air density, the freon had little effect. Why? Many chemical reactions are temperature or density dependent for it to happen. Dupont knew this and secretly funded the environmental groups which supported EPA's ban. They did it because their freon patents expired and the new refrigerants were not nearly as good and twice as expensive. they made $ billions with the freon ban. The environmentalists and EPA wanted to ban freon as the first industrial chemical to be barred. Both sides benefitted. And the ugly truth is the atmospheric chamber tests show the new refrigerants are far more damaging to the ozone layers. That is why the rest of the world did not ban freon. Now the real question is who do you trust?

I hate to tell you Jack, but surfing the internet is not by any stretch of the imagination "research".

Republicans would rather see every American dead than see manufacturers cleanup their act.
      • Mark5333 8 mths ago
America already has the highest air standards in the world. You are taking it to extreams with little regard for the livelyhood of millions of hard working Americans.
      • JamesB 8 mths ago
Dear Kenny, can you please post on line the obituaries of the Americans dying of ozone for me. I just can't seem to find any. Or is it another fantasy of the left to justify their actions?
      • Phoenix 8 mths ago
I agree Kenshin. Many people are not aware of the damage that corporations do, not just to the air but the soil as well. If companies really were "people" and the "trickle down" effect worked, there wouldn't be a one percent that is above everyone else. Corporations only care about the almight dollar- along with our government.

Let's hope there is another winnable Democrat or Independent candidate in the 2012 race. Complaining that any regulation would kill jobs in America is the oldest trick in the book. Let's analyze this complaint for a second. By scrubbing this regulation, we will have 100, 1000, or 10,000 more jobs. But how many employed and unemployed Americans will end up with more health problems which will drive spending higher? But wait, they are cutting spending. So, for those who end up suffering with health problems, the GOP will say, "too bad, so sad, and drop dead!" Let's face it, there are too many greedy and selfish Americans in this country. And for job creation, how about bringing those millions of jobs back to the US and stop outsourcing jobs.
    • kristi  •  8 mths ago
There are so many 30+ year old power plants still running in this country its not funny. Sure the corporations don't want to spend the money it would take to replace them because that would hurt the profit margins. Building new power plants would spur other businesses and put people to work, and reduce pollution
    • World Traveler55  •  8 mths ago
It makes sense...let the current workers die due to smog so that others can take thier jobs and the cycle starts again. Brilliant!

Obama lost my vote a long time ago, I think he probably just lost a whole lot more. So who is going to challenge Obama for the democratic party nomination? It's not like he really has any party credibility any more.
    • JJMurray  •  8 mths ago
You folks are amazing! Really, how bad is the air quality in the vast majority of the country? I've got news for you, thousands aren't dying from pollution today because the rules already in effect have worked very well. For you young folks, you have no idea how bad air and water quality had become in the past and how much better it is today. All this regulation was going to do was cost everyone a lot of money while doing very little to actually change the air quality.
    • JJMurray  •  8 mths ago
"The regulation would have reduced concentrations of ground-level ozone, the main ingredient in smog...."
And the primary emission from vehicles burning ethanol. And people wonder why LA still has so much smog despite such tough environmental regulations.

Why doesn't the president just let Boehner move into the White House so he would have a shorter walk to the office and running the country.
