Pa. man: 'Callous' church let 3 pedophiles rape me

PHILADELPHIA (AP) — A Philadelphia man at the heart of a groundbreaking criminal case against the Philadelphia archdiocese has filed a related civil suit, charging that the church let two priests and a teacher serially rape him as a young altar boy.

The 23-year-old man accused the Roman Catholic church in Philadelphia of "callous indifference" to his suffering as a 10-year-old schoolboy.

The suit seeks at least $450,000 in damages from the archdiocese and other defendants. The Philadelphia Inquirer first reported Wednesday on the suit, filed this week by a man identified as "Billy" in a February grand jury report.

Prosecutors have accused the archdiocese of letting "a trio of pedophiles" pass him around from 1999 to 2000, starting when the Rev. Charles Engelhardt forced him to engage in mutual oral sex in a church sacristy at age 10.

Weeks later, the civil suit charges, the Rev. Edward Avery performed oral sex and digital penetration on him after bell choir.

And at age 11, his sixth-grade teacher, Bernard Shero, orally and anally raped him during a car ride, and then put him out of the vehicle to walk home, according to details from the civil and criminal complaints. All three lived or worked at St. Jerome Parish in Northeast Philadelphia, where "Billy" went to school through eighth grade.

The victim has since been hospitalized 10 times for drug and mental-health treatment, most recently just this month, the civil suit said. He had become withdrawn and sullen after the childhood assaults, and turned to marijuana by age 11, and later painkillers and heroin.

"How many people would have welcomed information that would have explained why little Johnny is acting so strange and withdrawn and sullen, and knowing it's not something you did as a parent," said Paul Lauricella, one of several lawyers on the case. "All of these secrets prolonged people's suffering, and even exacerbated it."

Avery had been sent to live at St. Jerome by former Cardinal Anthony Bevilacqua despite a 1992 stint at a treatment center that stemmed from an earlier sex-abuse complaint, prosecutors said. He was allowed to say Mass and hear children's confessions, and to continue moonlighting as a DJ at school dances and other events.

The grand jury report led to the filing of rape charges against Engelhardt, 64, Avery, 68, and Shero, 48, along with separate rape charges involving another victim against the Rev. James Brennan, also 48.

The longtime secretary for clergy, 60-year-old Monsignor William Lynn, is the first U.S. church official charged with crimes — conspiracy and child endangerment — for allegedly transferring problem priests without warning new parishes.

"The callous indifference manifested by Bevilacqua and Lynn to the safety and well-being of children left in the care and custody of the Archdiocese was a function of their paramount desire to protect the Church, even at the expense of innocent children, who were ravaged, molested, and abused," the civil suit charged.

The defendants plan to challenge the conspiracy and child-endangerment charges at a potentially key pretrial hearing on Friday. A gag order prevents lawyers from discussing the case. However, Lynn's lawyers have argued that he had no children in his direct care and should not be charged with endangerment.

The civil suit accuses Lynn, Bevilacqua and the archdiocese with negligence and recklessness and the alleged rapists with battery.

The archdiocese is not commenting on the lawsuit, spokeswoman Donna Farrell said Wednesday.

Bevilacqua, now 88, suffers from cancer and dementia, according to the grand jury.

His successor, Cardinal Justin Rigali, was sharply criticized for his handling of sex-abuse complaints by the lay chair of the archdiocese's own investigative panel.

The pope last week named Archbishop Charles Chaput of Denver to succeed Rigali.

I don't care what the hell Bevilacqua is suffering from -- toss his perv#$%$ in prison and let him suffer THERE, WHERE HE BELONGS for protecting and facilitating the continued perverted behavior and evil abuse of innocent children by these pedophile priests ... you abusers DO KNOW that IF THERE IS A HELL, YOUR RESERVATIONS HAVE ALREADY BEEN MADE. You will finally be judged by YOUR BEHAVIOR ... your words will mean NOTHING on your judgement day ... what you say or preach or how many times you've read the bible or how many hail marys you've said WILL NOT BE CONSIDERED in your final judgment.

That is so true Zap, Those people that THINK that they can get away with things just because they belong to a corrupted perverted church, and religion style. will be going straight to Hell. Those people have already sealed their fate,

In the late !930's I was a Cub Scout for only three meeting. Why ?? The assistant scout master kept trying to rape me !! I never told anyone until this day !! Please I am not a cockroach crawling out of the wood work !!

You're not the only one. In the early 60s the Boy Scout troop I tried to join had a Scoutmaster who fondled all the guys. I never went back. The scoutmaster was arrested for hid deeds a few years after I left.

At least the Scouts are doing something about it, by thoroughly investigating all potential leaders and never permitting an adult to be alone with a kid.

Hector, the church may not be able to keep pedophile priests from acting on their urges, BUT they could prevent these priests from having any contact with children via the church, by prosecuting them, or at least firing them. They didn't do either, they protected the priests above their parishioners. I can't understand why anyone gives these men a dime.

        Truely stated Adarc.

Firing them doesn't prevent them from molesting other children. And unfortunately, our understanding of pedophilia during the years this was happening, didn't go beyond any specific incident. So the "solution" for many, many years was to simply put distance between the pedophile and the child. This was NOT unique to the Catholic Church. If you know anybody at all who was molested as a child, you'll hear the same story over and over again. Once a parent found out, they were almost always told that pressing charges could actually do more harm to the child than it was worth because they start to believe that they, the victim, did something wrong. You could also have the accuser making all kinds of claims in court about what the child did or didn't do. The chances of winning a court case like that were very slim until recent years. So the response was always to not press charges and put as much distance as possible between the sick pervert and the child. As I pointed out before, it's much more common in the public school system and some teachers, after being fired, just went to another state, another school district, and did the same thing there.

You want the pedophiles out of church for good? Hold their boss responsible. Sorry, but the Pope needs some charges out of all this too, after all he is the one who has the say about the 'laws' that protect and allow these monsters to do this. Harboring criminals used to be illegal.

And the current Pope Benedict is doing a fast-track sainthood of the previous Pope John Paul II - all whitewash and forgive and forget. Do they really think they're fooling anybody? The Church is having various archdioceses file bankruptcy in order to pay out the minimum for these lawsuits, while protecting their own wealth. I also read that the Church has hired lobbyists in Washington DC, lobbying for laws that make it more difficult for victims of sexual abuse to come forward, reducing the statute of limitations, etc. Disgusting! As a Catholic myself, I can not bring myself to donate to the Church until I see real action and progress on the part of the Vatican to make amends and rectify this horrible, criminal situation against the most defenseless in our society.
      • Telestai 10 mths ago
Good for you, MM. When sincere and believing CATHOLICS, rather than just infuriated members of other denominations/no denomination, it will be much harder for the Vatican to continue its delaying tactics. Perhaps if concerned Catholics temporarily redirected their tithes and offerings to charities which actually AID children, and if those concerned Catholics made CERTAIN to explain clearly WHY they are so doing, it would be much harder for the Vatican to continue its delaying tactics.

Catholics Have it all wrong, God does not recognize this religion that is why these priests are raping children. the Devil himself is at the helm of Catholicism!

From my communications with priests in the church, I understand that the church views itself on equal footing with the Holy Scripture. That is, the church believes that official pronouncements of the church are equally authoritative as Scripture. I do not believe this is true. I find repeated statements in Scripture of its own authority, but I never find Scripture saying that the church would be authoritative. Jesus said that Scripture cannot be broken (John 11:35). The Apostle Paul states that all Scripture is given by the inspiration of God (2 Timothy 3:16). The Apostle Peter states that prophecies of old were given by holy men moved by the Holy Spirit (2 Peter 1:20-21). Jesus, in dealing with Satan at the temptation, quoted Scripture as authoritative (Matthew 4:1-10). Jesus saw that even the smallest letters of Scripture were from God (Matthew 5:18). The Word of God is powerful (Hebrews 4:12) and pure (Psalms 12:6) and true (John 17:17).

But the church can and does make mistakes. Even Peter made mistakes and at one point the Apostle Paul had to rebuke the Apostle Peter (Galatians 2:11-14). Yet, Peter and Paul remained jointly committed to the Word of God and the building up of believers (2 Peter 3:14-18).

Because I find the Scriptures to be authoritative, I will always gauge all churches and doctrines in light of what Scripture teaches. I do not think that the Catholic church would disagree with this, but I find their interpretations of Scripture sometimes troubling. For instance, Scripture says that there is one God and one mediator between God and man, the man Christ Jesus (1 Timothy 2:5). Why then do people pray to Mary or the saints, when Jesus is the only mediator? Never once, in Scripture, is there a positive example of someone praying to one who has died, except to Jesus. It is almost as if people believe that Jesus is too busy or that the saints or Mary are more compassionate or more likely to listen to us than Jesus Himself. We talk about loving Jesus but then the Catholic church encourages its people to speak to the saints and to Mary rather than to Jesus Himself. I find that a bit odd. I do not denigrate Mary. I hold Mary in very high esteem. But I do not pray to her, talk to her, or otherwise focus on her. I want my focus to be where the focus of Scripture is, on Jesus.

In any event, the purpose of the church and the purpose of believers on earth is to draw people into a personal and loving relationship with God the Father through Jesus Christ our Lord. This is the first and great command and the great commission. It is not the doctrine, but that relationship that will be ultimately important. If we are His children, we are accepted in the Beloved. If we are not His children, we are already condemned by our sin. We want to be accepted by God.

May the Lord Jesus guide you as you turn your eyes to seek only Him.

If this was rampant in any other institution. It would be shut down. The raping of children will continue.

Exactly. Rot goes right to the top, but a double-standard protects the hierarchy as they abuse the laity. It's horrible.

I would like to see just 1 good priest come forward as a whistleblower. Instead, they keep quiet and pass around a 10 year old boy between themselves.

I was abused as a 14-year old and the ensuing shame was huge. It was then and remained for my years my deepest darkest secret. No one could know. And it crippled my attempts at emotional relationships for many years.

Hey Hector, if you went to Target with your kid, and he/she got raped by a Target employee in the toy section, and you went back demanding justice, and they told you "we took care of it, that guy has been moved to electronics!" How much longer do you think Target would be in business?

The Catholic church has commited so many heinous crimes since its creation. It is amazing anyone would be affiliated with them
    • randalland  •  10 mths ago
I continue to be amazed that no parent has put a bullet through one of these priest's head. If I found out someone was molesting my child, he would be a dead man....no matter how long I had to go to prison.

For men so concerned about heaven they sure created a hell on earth for this young boy.

Remove pedophiles p e n i ses. Leave just a nub for urination and the shame of having to sit while urinating. That might make them think twice before re-offending

They need to hang these pedophiles

I have nothing against Catholics. In fact, devout Catholics are truly committed to following the teaching of Christ. My problem with the Catholic religions...most especially the powerful religious Catholic leaders...is the protection of those priests who are pedophiles. This is NOT a homosexual attacking these young boys; these are pedophiles...men interested/sexually attracted to young boys. I want the leadership in Rome to step-up to the plate and turn-over these pedophiles for prosecution, rather than reassigning them to other parishes to do the same thing again. The Pope and the Holy leaders in Rome enable this kind of sick behavior by covering up for these pedophiles and for protecting these pedophiles. The Catholic membership MUST address the lack of leadership by Rome or the Catholic Church will continue to have its membership of the faithful diminish.

The worst sin is the Church has swept this stuff under the rug for years and years. God will deal harshly with them.
    • White Dove  •  10 mths ago
What I have never understood was why did the law allow these things to go on? Why were they not turned over to the Law, why does the Church still try to protect them? Why didn't the ones that knew these things get jail time, the Chuch is to blame...in the end...

This is not happening in middle east in a mosque. So we can not blame them. What do we do to stop this horrible crime? It is going on too long.
    • Tammy  •  10 mths ago
      @Brian
The Devil didn't do this, Catholic Priests and a teacher did this. And ONLY they are to blame. Stop blaming devils and demons for what humans do.
