    The Paradoxical, Dangerous Balanced Budget Amendment

    The Nation -- This week, as the federal debt ceiling battle churns closer to Treasury Secretary Timothy Geithner’s August 2 deadline, there’s increasing talk about an amendment to the Constitution that would require balanced budgets. Senate Minority Leader Mitch McConnell, a key negotiator in the debt ceiling talks, spoke this weekend about the need to “save our entitlements and our country from bankruptcy by requiring the nation to balance its budget.” Sen. Rand Paul now insists a balanced budget amendment must be part of any debt ceiling deal, and said Sunday that he will filibuster any agreement that doesn’t include it. Leading presidential candidate Mitt Romney also said recently that the United States should default on its debt unless Congress passes a balanced budget amendment.

    Several media outlets dutifully noted the new turn in negotiations but few actually describe the fundamental, radical shifts in American government required by the proposed balanced budget amendment. It’s crucially important to understand what the new GOP demand actually requires.

    The most important thing to know is that if enacted, the balanced budget amendment would actually be impossible to have a balanced budget. Both the House and Senate versions of the legislation not only mandate a balanced budget starting in 2018, but also mandate how it must be done. Federal spending cannot exceed 18 percent of the national Gross Domestic Product, and there would be a super-majority requirement for any new revenue: in other words, two-thirds of Congress would have to vote to approve any tax increase.

    Republicans have made it clear they will not support tax increases in virtually any situation, and most GOP Senators have signed Grover Norquist’s no-new-taxes pledge, and it’s not hard to imagine that under a 67-vote threshold, Congress will simply never raise taxes again. So if the government permanently handicaps revenue, how can it possibly achieve a balanced budget, especially as health care costs are certain to increase as baby boomers become senior citizens?

    One answer would be that it’s not, which then raises basic questions of enforceability. Say the amendment was enacted, but one year Congress passes a budget where spending exceeds revenues. Would the federal courts rule the budget unconstitutional? And if they did, what then? As Bruce Bartlett wonders, would Americans have to send back their Medicare checks or federal salaries? (Bartlett, a former official in George W. Bush’s Treasury Department, has called the BBA idea “idiocy” and “especially dimwitted.”)

    Then there’s the 18 percent spending cap. First of all, given that taxes are basically frozen by the supermajority provision, it’s quite possible that the government won’t even be able to raise revenue equal to 18 percent of GDP, meaning that Congress would have to spend even less than that in order to have a balanced budget. But putting that aside, even spending at 18 percent of GDP would be practically impossible and would require unimaginable reductions in government services.

    As Ezra Klein notes, federal spending exceeded 18 percent of GDP every single year of Reagan’s presidency, every single year of George W. Bush’s presidency, and all but two years under Bill Clinton. Not only would the BBA have made Ronald Reagan’s entire economic stewardship unconstitutional, it also would make Paul Ryan’s budget illegal—his plan still forecasts federal spending of 20.75 percent of GDP in 2030.

    The only budget proposal that would come close to federal spending at 18 percent of GDP is the ultra-conservative plan put forth by the Republican Study Committee. The Center for Budget and Policy Priorities examined that budget, and found that it gets to 18 percent spending with a 70 percent reduction in non-defense discretionary spending by 2021. This is the area of the budget funding everything from “veterans’ medical care, most homeland security activities, border protection, and the FBI…[also] education, environmental protection, protecting the nation’s food and water supply, and medical research, as well as services for disadvantaged or abused children, frail elderly people, and people with severe disabilities.”

    Beyond that, the budget raises the Social Security retirement age to 70, makes deeper cuts to Medicare than Ryan’s plan, and cuts $86 billion over ten years from Pell Grants. If the idea is to shrink government “to the size where I can drag it into the bathroom and drown it in the bathtub,” in the words of Grover Norquist, then the BBA is the watery coup-de-grace.

    Impossible and unworkable as it sounds, every single Republican Senator co-sponsored the BBA legislation now in the Senate, and as noted, leading GOP negotiators and presidential candidates are demanding it. Calling for a balanced budget makes good politics—a poll released yesterday shows more than seven in ten registered voters support a constitutional amendment to balance the budget.

    But the same poll also shows that the support plummets to around 30 percent when the voters are told it would require deep cuts to Social Security and Medicare. This is why the media needs to be clear about what the GOP is proposing—the balanced budget amendment is one of the most dangerous soundbites in recent political history.

      Most of the 47% that don't pay are making between minimum and $10 an hour.

      Any of you rich tax payers want to trade places with them.

      I think it's awful our economy can't produce wages for them so they could pay taxes!

        Start a business and overpay them then. Actually, if you could get really good people, it would be worth the savings in turnover costs if you paid them more and kept them on. Some of the "evil rich" actually do this, you know. If you're really good at what you do, you can usually do pretty well, even if it isn't rocket science. What socialists want is for everyone to make the same wages regardless of ability, motivation or productivity. Sorry, but that is ruinous.

You mean, before Congress could ever raise taxes again, the things they would want to raise them for would have to be so popular that THE PEOPLE WOULD ACTUALLY SUPPORT A TAX INCREASE IN ORDER TO GET THEM??? That is, THE PEOPLE WOULD ACTUALLY VOTE TO SPEND THEIR OWN MONEY ON THEM???

      Otherwise, my friends, WE ARE TOAST!

      If you don't think INCREASING the National DEBT limit $2 TRILLION BUCKS will have the same EXTREME, draconian, destructive AND devastating effect on our economy as INCREASING TAXES $2 TRILLION BUCKS, you’re either REALLY, REALLY stupid…..or a Democrat.

      I strongly recommend a Balanced Budget Amendment that REQUIRES a 3/5 majority (60%) of BOTH Houses of Congress to increase the National DEBT limit on the American people and to continue to 'dump' (we're WAY past 'investment', we're into 'shoplifting') TRILLIONS and TRILLIONS of dollars 'onto the backs of our children and grandchildren'. We have got to raise the requirements for Congress to borrow money. It’s that simple.

      It should be obvious that NEITHER party can be trusted with the economy. THAT'S why we need the Balanced Budget Amendment. Democrats are stupid and quite a few Republicans are idiots.

      Regardless of WHO or what party is in office….WE the people, of the people, by the people and for the people (and the American Taxpayer) have got to protect ourselves, our children and our grandchildren from future Presidents, Congresses, Supreme Courts, the Federal Reserve and MOST importantly, those d**n public unions and lobbyists!

      On March 20, 2006 the National Debt stood at $8.3 TRILLION.

      Sen. Barack Obama (D-IL) and ALL the Senate Democrats voted AGAINST increasing the National Debt.

      When the vote to increase the National DEBT limit in 2007($850B) and 2008($800B), Sen. Barack Obama (D-IL) didn’t even have the COURAGE or bother to show up to vote either time. Yeah, that’s REAL leadership.

      And NOW...POTUS Obama has expressed ‘regret’ for his vote??? Well so do a lot of Americans, Mr. President, so do a lot of ‘taxpaying’ Americans.

      What about the rest of the Senate Democrats, Mr. President? Do they also regret THEIR votes?? Nobody is buying the lies and b**l $**** you and the Democrats are shoveling anymore, Mr. President.

      After 70 years of real world ‘experience', it should be obvious that POTUS Obama and the Democrats have proven, BEYOND a doubt, that this Keynesian Macro-Economics ‘Theory’ has been thoroughly 'Myth Busted'.

      Fiscal responsibility and reigning in Federal spending is even more imperative NOW than ever before. Financially, NOTHING is more important for the future of our children and grandchildren than passing the Balanced Budget Amendment IMMEDIATELY, and NO! NOT waiting 5 more d**n years!

      The DJIA FALLS 270+ POINTS!! (06/01/2011) and Democrats haven't submitted a Budget in 775+ days and refuse to submit one? Stupid and irresponsible leadership! Priceless

My wish it the pain would come down on both of you with both feet. The Democrats gave W. a balanced budget and he squandered it on two unnecessay wars off-budget or were you two asleep for the 8 years of his reign of terror?

      Well Mr. Z, what is the alternative ???....If the nation never passes a balanced budget (or rarely does) on top of a 14 trillion debt already in existence, what possible outcome could happen
      but eventual bankruptcy ? The only alternative is to print our way out of it & that will lead to
      hyper-inflation. The budget must be balanced & all segments of society must be taxed according to how they have benefitted. This means the rich pay more but all pay some.
      This leads us to a flat tax &/o a national sales tax. Yes, please free us from the IRS tax code.

      The part so cleverly overlooked in the article, is that the budget process must begin with the necessary entitlements on the table. What is left over after that is what gets funded with the remainder. No longer would Congress be able to send the pork home to their union supporters or their big business friends with a simple add-on to another bill. A balanced budget would make the entire process more open and transparent to those who are footing the bill--US, the taxpayer. Remember the $700 hammer and the $10,000 toilet seat lid? Those days would be long gone. And with the need for a super-majority to raise taxes, taxpayers could see where the squeak is coming from and apply the grease specifically to that point.

      Funny, the GOP could have brought the Balanced Budget legislation to the floor of the House and Senate anytime they wanted from 2002-2006 when they had complete control of both chambers and a President to sign the legislation into law, but did not. Yet, they had no problems running up the deficit at the same time.

      I think it is safe to say that any legislation requiring a balanced budget is nothing more than election politicking. It won't be long before the GOP revives the anti-gay marriage amendment and the flag burning amendment for 2012 as well.

        I normally don't agree with your positions but I must agree that the Republican controlled Congress spent money like drunken sailors during the period from 2002 to 2006. But don't take the BBA as being an entirely political ploy yet. It may turn out to be that but the idea of really having a balanced budget year to year would be a good thing as long as we don't tie future Congressperson's hands like both the House and Senate versions are trying to do...

      By all means, don't tax the top 2%. That way they'll be freed up to"create more jobs." In the meantime, we can finance the country off the backs of the people who can least afford it. After all, they're used to getting screwed over as it is.

      Well, according to NPR, 47% of "taxpayers" paid no tax at all in 2009(http://www.npr.org/templates/story/story.php?storyId=125997180). So, how can any of you say that there's a transfer of wealth from poor and middle class to most wealthy, when the poor - and some middle class - pay nothing at all? According to the IRS' own records, over the last decade or more, on average, the top 50% earned, as a group, about 6 times as much income as the bottom 50%. During that same period, they paid about 30 times as much in taxes. I know people who have cheated their way to wealth, and it makes me crazy....I also know some very intelligent, hardworking individuals who I believe deserve anything they ever make - they've truly earned it. We have to stop using the bad apples as justification for legal theft. No class of citizen should be treated as an ATM. It SHOULD hurt to balance a budget. We SHOULD let the voters have a voice in what is important. As a republic, the idea is that we won't let the majority run roughshod over the minority. Do we all feel that way if the minority is the wealthy, and the majority feel that they are entitled, by their citizenship(or lack of, in some cases) to seize whatever portion of others' wealth they feel is their right?

      Supporters of less government, no taxes and cuts in entitlements have to ask themselves what do such policies do for them. Under Bush we had less taxes, less regulations and give backs to the rich all in the name of boosting prosperity but we're in the worst economic slump since the Depression.

      CEOs and top executives are making record salaries and bonuses while middle class jobs disappear and the general public is being asked to do with less. One of the most prosperous times in American history was during the Eisenhower era when tax rates were greater 90 percent on the rich. Now we're at a time of historic low tax rates and the promised jobs and boom times are an illusion. Instead the policies are creating an entrenched wealthy elite who have an inflated sense of entitlement reflected in the Bush mantra of it's my money and I know what to do with it better than the government.

      The tea party loves to rant and rave about serfdom under "socialism" but welcome to the real thing as the rich take more and the 90 percent rest of us get less and we'll gladly sell our soul to the company store in order to keep what jobs are left in America.

      The only thing more dangerous than the Balanced Budget Amendment is NOT passing a Balanced Budget Amendment.

      It's a sad commentary on the deficient nature of government schools that we now have multiple generations of Americans who think the government's legitimate function is to care for each individual from cradle to grave, when the PROPER role of government is to do for the People those things which MUST be done and CANNOT be done through private enterprise. Thus, health care, social security, welfare and most warfare are OFF THE TABLE. Since those items comprise about 3/4 of the Federal Budget, it's easy to see how the budget might be balanced by simply eliminating the things we do not need from government.

      But it gets better. Eliminate all of the unconstitutional agencies. BATF, ED, DEA, etc. More hundreds of billions in savings. In fact, something like 85%-95% of everything the Federal Government does today is UNCONSTITUTIONAL.

      Get ride of those, and we'd scarcely need taxes.

      The 'negotiations' are based on whether in 10 years (2021)…

      Is the National DEBT, that is going to be dumped 'onto the backs of our children and grandchildren', going to be at $28 TRILLION OR $32 TRILLION from the CURRENT National DEBT level of $14 TRILLION?

      Kinda’ gives you the warm fuzzies, doesn’t it? Wait till the stock markets figure out THAT little scam.

      IT IS STILL 'kicking the can down the road' to future career 'cockroach' politicians.

      Without the Balanced Budget Amendment we are still TOAST.

      Career 'cockroach' politicians lying to the people, piling on National DEBT, is what is destroying our nation. It's all bull$**t, baling wire and bravado.

      A 40% PAYCUT for all elected US Congress, President and Vice-President and 'highly compensated' appointed officials, Executive, Judicial and Federal Reserve. (EXCEPT National Defense)

      Then lay off 20% of the Federal workforce. Is there anyone out there who DOES NOT believe there is 20% of 'deadwood'?

      For every TRILLION BUCKS the National DEBT is paid off, THEN they get a 2% raise. By the time we go from a National DEBT of $14 TRILLION to a $4 TRILLION National SURPLUS they will have gotten a 36% raise and we would still be 4% ahead!

      No, it won't make a dent in the $14 TRILLION National DEBT but it d**n sure will get their attention and make us taxpayers happy.

      Otherwise, come midnight August 2, pitch forks, torches and baseball bats? ;0) lol!
