PIPA, SOPA Would Create Internet Gestapo

This story comes from the Yahoo! Contributor Network, where individuals publish their unique perspectives on some of the world’s most popular websites.

COMMENTARY | Wikipedia's English Language version has gone dark for 24 hours to protest the PIPA and SOPA bills making their way through the national legislature. The Washington Post claims the protest is against "anti-piracy measures." Such claims make it sound like opponents of SOPA and PIPA are against stopping online theft. Nothing could be further from the truth.

People know theft is wrong and I've yet to hear any protesting individual or company say "it's fine to steal other people's copyrighted works." The objection comes in response to the provisions of those bills regarding how whistle blowers and enforcement agencies can respond to theft.

As an MSNBC report says, the problem is with provisions in the bills that allow "blacklisting" of entire domains, making sites unreachable, and with the unlimited scope of enforcement. An accuser who does not own an intellectual property can accuse a web site or host of stealing it, and the government, egged on by the entertainment industry, can shut down web sites and domain names completely.

Imagine Google accidentally indexing a web site where someone had posted a home video that they'd set to a music clip just one second longer than the fair use laws allow. Not only could that site be shut down, but potentially Google as well. This could happen even if the music isn't actually copyrighted, just on the basis of accusation.

The reach of the law is global, meaning US Government laws would be able to disable web sites across the globe.

Google has even proposed an alternative program called OPEN which would allow curtailing of privacy without giving the government Gestapo-like powers to destroy whatever parts of the internet it chooses, according to tech site Mashable.

Perhaps it's time the legislature lets tech companies handle tech issues and tell entertainment companies to make movies. After all, the entertainment world already has tools like DMCA to handle piracy. It doesn't need internet-door-slamming powers as well.

They didn't intend sopa OR pipa to pass at all. OPEN was the goal. It's the same tactics used on sudden spikes on things like gas prices. Hike 3$ to 4.50(everyone's #$%$ then drop it to 3.75. Still bad but it's not the worse...OPEN is the new "Warrantless" occupation of private computer files/use. With the passage of NDAA, and NO solid definition of what exactly terroist evidence IS, gives them the power to enforce ANYTHING they want, in ANY WAY they want, with absolutely NO overhead supervision.Look, old fairy tales still ring true...A Vampire has no power unless you invite him in....WE MUST STAND OUR GROUND AN ACCEPT NO MIDDLE GROUND ON OUR CONSTITUTION, OUR BILL OF RIGHTS, OR EVEN ONE #$%$ OUNCE OF OUR FREEDOM.Peace n Love alljw

Could you expand on what OPEN is? I tried looking it up and had no success. I do know exactly what you mean, they use gradualism as a way to empower themselves and the sheep are none the wiser. Thanks for posting, this one got by me.

Gestapo is right. They will have the power to shut down sites with out "due process". They want to skip the court all together and have their way with you as they please.

Even bank robbers and murderers have their day in court. If this is about infringement issues, then they need to bring guilty parties to trial. They can do this now, but they want to do away with the whole court battle and be given Gestapo powers over every one.

Since they can take you to court, then this is not really about infringement but more so of Power of Control. If you had a website and a cartoon drawing of a mouse that you made yourself. Then Disney might say you have a picture of Mickey and shut your site down with out you having a court hearing. It wouldn't matter if most people think the drawing doesn't resemble Mickey, it will only matter if Disney thinks it resembles. Basically it doesn't matter if they are wrong, they will have no one to answer to and will have all the power provided to THEM.

Americans crack me up. Only up in arms when tyranny is kicking you in the teeth. WHAT ABOUT THE NDAA???? The government can indefinitely detain ANY American citizen without due process, legal representation, a trial, or Miranda rights. They don't need a WARRANT to kick in your door and literally make you disappear FOREVER. This has barely caused a stir with Americans, and isn't talked about openly with the media. Where is all the attention on that? There is none, because it doesn't directly affect you... Yet. The government is literally taking over. Next to come, repealing the 2nd amendment to bear arms, and Martial Law. After all, comrade Obama is trying to protect you from yourself. In soviet America, you don't own the government, the government owns you!

Poor lil Jonny, making a fan vid for fun. Nice lil 12 yr boy who likes this singer and artistically meshes it with a scene from his fav movie. OH CRAP!! Lil Jonny didn't know the law... he is only 12... with a blacked out web, an astronomical fine that wipes out the money saved for college and a charge on a juvie record. Poor lil Jonny and all he did was want to make something cause he was a fan.

"People know theft is wrong and I've yet to hear any protesting individual or company say "it's fine to steal other people's copyrighted works." "

What the internet has done is create simplicity. As a race, or however else might be able to use this tool, can communicate information quickly to one another. I can tell my friend about a book I read or show him my book directly in person. The internet allows me to share the same concepts online digitally. It's really hard to claim whether this is theft or merely sharing or 'showing' as it would be in person.
