Samsung appeals Galaxy Nexus ban in Apple patent case
U.S. District Court Judge Lucy Koh on Friday evening ruled Apple would likely be able to prove at trial that Samsung’s Galaxy Nexus infringes on four Apple patents. As such, the judge granted a preliminary injunction on sales of the Android smartphone in the United States. The ruling came just two days after Judge Koh granted a similar injunction on Galaxy Tab 10.1 sales, which Samsung quickly appealed. The South Korea-based consumer electronics company has now filed an appeal with the U.S. District Court for the Northern District of California in this case as well, according to FOSS Patents. Samsung’s appeal seeks to overturn the judge’s ruling, arguing that the ban is ”inconsistent with the Federal Circuit’s directive that market share losses must be substantial,” and attributable directly to the infringing feature, rather than just sales of the infringing product, FOSS Patents writes.
