    School accused of putting autistic student in bag

    LOUISVILLE, Ky. (AP) — A 9-year-old autistic boy who misbehaved at school was stuffed into a duffel bag and the drawstring pulled tight, according to his mother, who said she found him wiggling inside as a teacher's aide stood by.

    The mother of fourth-grader Christopher Baker said her son called out to her when she walked up to him in the bag Dec. 14. The case has spurred an online petition calling for the firing of school employees responsible.

    "He was treated like trash and thrown in the hallway," Chris' mother, Sandra Baker, said Thursday. She did not know how exactly how long he had been in the bag, but probably not more than 20 minutes.

    Mercer County schools Interim Superintendent Dennis Davis said confidentiality laws forbid him from commenting.

    "The employees of the Mercer County Public Schools are qualified professionals who treat students with respect and dignity while providing a safe and nurturing learning environment," Davis said in a statement.

    State education officials said they were investigating.

    Chris is a student at Mercer County Intermediate School in Harrodsburg in central Kentucky. The day had barely begun when his family was called to the school because Chris was acting up. He is enrolled in a program for students with special needs.

    Walking toward his classroom, Baker's mother saw the gym bag. There was a small hole at the top, she said, and she heard a familiar voice.

    "Momma, is that you?" Chris said, according to his mother.

    A teacher's aide was there, and Baker demanded that her son be released. At first, the aide struggled to undo the drawstring, but the boy was pulled out of the bag, which had some small balls inside and resembled a green Army duffel bag, Baker said.

    "When I got him out of the bag, his poor little eyes were as big as half dollars and he was sweating," Baker said. "I tried to talk to him and get his side of the reason they put him in there, and he said it was because he wouldn't do his work."

    Baker said when school officials called the family to pick him up, they were told he was "jumping off the walls." Days later, at a meeting with school officials, Baker said she was told the boy had smirked at the teacher when he was told to put down a basketball, then threw it across the room.

    At a meeting with school district officials, the bag was described as a "therapy bag," Baker said, though she wasn't clear exactly what that meant. She said her son would sometimes be asked to roll over a bag filled with balls as a form of therapy, but she didn't know her son was being placed in the bag. She said school officials told her it was not the first time they had put him in the bag.

    So far, almost 700 people have signed a petition on the website change.org. Lydia Brown, an autistic 18-year-old Georgetown University freshman from Boston, said she started it after reading a story about Chris.

    "That would not be wrong just for an autistic student. That would be wrong to do to anyone," Brown said.

    Advocates for the autistic were outraged.

    Landon Bryce of San Jose, Calif., a former teacher who blogs about issues related to autism, said the school's treatment of Chris was "careless and disrespectful."

    "A lot of the damage that we do to students with all kinds of disabilities is by treating them as though they deserve to be treated in a way that's different from other people," Bryce said.

    Baker said she heard different accounts about her son's behavior that day.

    Baker stopped short of calling for the dismissal of school employees, but she said they should be suspended. They also need more training, she said.

    In Kentucky, there are no laws on using restraint or seclusion in public schools, according to documents on the state Department of Education's website.

    A July letter from the state agency to special education directors said the state had investigated two informal complaints this year.

    In one, "a student (was) nearly asphyxiated while being restrained," and in the other, a student vomited from panic attacks after spending most of an academic year "confined to a closet, with no ventilation or outside source of light," according to the letter.

    Baker's case was first reported by WLEX and WKYT.

      this sickens me how the schools lately treat disabled kids! where do i sign a petitition because someone needs to do something about the teachers and principals! someone needs to personally put whoever did this to the child in a bag and see how they like it!! this makes me so mad because my son is autistic im deffinitley keeping my eye open at my sons school i will raise hell if this ever happened to my son!

      #$%$ The last mention of a student having panic attacks because of being locked for most of the school year in a closet with no light and ventilation? If a parent did that at home it is child abuse, but a school can do it because there are not laws in KY on using seclusion? Am I in the twilight zone right now? Crying for children who adults treat like garbage. Sickened.

        Ritta, Please do check on him often. I hve Asperger's, and can tell you that schools will often judge those on the spectrum MUCH more harshly than 'normal' kids. I had the misfortune of having lived in Kentucky, and going to school was cruel inhumane punishment and a total waste of my time.

        My daughter has aspergers and ADD, after dealing with "teachers" with no common sense and a "everyone is the same mentality" I home school my girl. Even if she didn't have a beautifully different way about her I would still home school, public schools are terrible.

        Most teachers aren't prepared to care for the disabled which is why they should probably be taught by SpEd teachers only. Mainstreaming is a total failure.

      #$%$Yeah, the kid probably was having a bit of an off day, many autistic kids do. But you sure as hell don't put them in a dufflebag and chuck him/her in the hallway! I swear, Kentucky is still the most bass-ackward state even in this day and age.I hope all teachers and school staff involved in this get canned, and are forbidden to ever work with any kids again.

      What this woman did to that kid can have far reaching effects in kids like this. Many kids with autism can "go into behavior" at anytime for no known reason. But with trauma like this, it can set back the kid by months and sometimes years.

Why is it the almighty school system is allowed to abuse our children, but if a parent is accused of doing something similar that is different? Wrong is wrong no matter who does it.

      I have a brother who works with kids with special needs they spit in his face and throw garbage in his face he changes teenagers diapers and cleans feces whatever they can to to terrorize him they do it...but he takes it all with kindness and love of Christ and he still loves them and treats them like babies.......he has a special skill to do this job and a wonderful job he does......he is blessed and the kids love him.......if you can't stand the heat in the kitchen get out of the kitchen......if you don't love kids......get off these jobs that deal with kids....you must be a special loving person the put up with these actions and if you are not go work in a factory........

      As the mother of two grown autistic boys, one of which was abused in a public school, my heart goes out to the mom but especially to her son. Autism and its behaviors are not easy to deal with......believe me, I know. Patience can wear thin, but that is never ever ever an excuse to mistreat and abuse a child, teen, or adult with the diagnosis. If you don't have the patience, the dedication, the self control, and in this case, common sense, when it comes to working with these special children, then don't be a special education teacher or aid. Don't the "professionals" understand that many of these behaviors can not be controlled. Meds will work, but there are sensory issues involved, which affect behavior. Modifications are needed. I hope the school board fires this aid and that charges are filed for child abuse.

      I am a paraprofessional in a resource classroom. I would never allow something like this to happen. The teacher and the aide need to be fired and an investigation into the practices of this school need to be investigated. Children with special needs need more attention not to be thrown into a bag. Usually when I have a student that is misbehaving, I will take them out of the classroom for a little while and let them calm down. This works very well. You should NEVER, EVER stuff a child in a duffel bag. How outrageous!

      i would not of ben able to restrain my self from anger if that of been my child! THIS isnt my child and im outraged right now, got tears in my eyes to knoww how that pooor child must of felt being bagged up like trash and left alone, alll children have probs with behavior let alone special needs children, their brains cant function as ours or know how to behave, doesnt mean we abuse them, IF THAT child was misbehaving so badly they should of called his mother to come help and work with him. ohhh man, that poor baby, i just wanna find them people and hug him and let that child know hes important as every one else.!!!!

      The Mother showed great restraint in her response. I would not have been able to keep from stuffing the teacher in the bag and maybe kicking it a few times before I called the police.

      Dosen't make it right, but from what I read this child was trouble and hard to handle. The teachers were probably burnt out from him altogether. To me it would seem he needed maybe a more special type school.
