    Squad mate testifies in Marine's Iraq deaths trial

    CAMP PENDLETON, Calif. (AP) — A former squad mate of a Marine implicated in one of the Iraq War's highest profile war crimes cases testified Tuesday that the group raced to nearby homes after a roadside bombing, firing rounds and tossing grenades for 45 minutes, even though the Marines did not take gunfire, come across a single insurgent or find a weapon.

    Still, former Cpl. Stephen Tatum told a military jury at Camp Pendleton that he felt the squad did nothing wrong that day in the town of Haditha in 2005, when Marines killed 24 Iraqis, including unarmed women and children.

    He said the squad feared insurgents were hiding in the nearby homes after the bomb exploded.

    Tatum gave his account during the trial of Staff Sgt. Frank Wuterich, who led the squad and faces nine counts of manslaughter.

    Military prosecutors have implicated the Camp Pendleton Marine from Meriden, Conn., in 19 of the 24 Iraqi deaths. He is the last defendant in one of the biggest criminal cases against U.S. troops from the war. One squad member was acquitted. Six others, including Tatum, had their cases dropped.

    Tatum acknowledged that charges against him were dismissed in exchange for testifying.

    He told military prosecutors during his testimony that squad members tossed grenades and shot rounds into rooms of Iraqi homes in the wake of the bombing that killed Lance Cpl. Miguel Terrazas and injured two others.

    Immediately after the explosion, Tatum testified, the Marines came under small arms fire, but he did not know from where. Wuterich and another Marine fatally shot five Iraqis outside a white car near the scene then headed toward the closest home, Tatum said.

    Before raiding it, Wuterich told him to "treat the house as hostile," the former Marine testified. Tatum understood that to mean there were armed individuals inside and he did not need to identify his targets to attack.

    Following his squad leader, Tatum said the Marines edged along walls with their weapons drawn. They tossed fragmented grenades into rooms. In a back room, Tatum said he joined Wuterich in firing rounds but was unable to see what he was shooting at because of the darkness and flying debris.

    "I saw silhouettes of targets and that was really it," Tatum said, adding that it looked like there was a man standing or kneeling.

    Then someone yelled a person had fled. The Marines rushed out to a neighboring house, tossing in grenades and shooting off rounds there as well. Tatum saw the body of an Iraqi man near the kitchen when he went in after his fellow troops.

    While checking an empty room, Tatum said he heard movements in a back bedroom and then Wuterich firing his M-16. He went in to assist Wuterich, shooting at what he said were silhouettes, some big, some small.

    "The only thing that gave me any indication there was a hostile act in there would be Staff Sgt. Wuterich firing, sir," Tatum told military prosecutor Lt. Col. Sean Sullivan.

    Wuterich also acknowledged that he did not positively identify his targets, three investigators testified.

    Tatum returned later when the house had been determined to be safe and learned they had killed an unarmed woman and children in the room.

    Defense attorney Neal Puckett suggested Tatum had changed details of his account since talking to investigators. Tatum said mistakes could have been made in the investigating reports but he stood by his testimony.

    Wuterich listened, occasionally rubbing his chin and whispering in the ear of his attorney during the day's testimony.

    The defense says Wuterich believed insurgents were in the homes and that's why he ordered his Marines to shoot first and ask questions later.

    The issue is whether Wuterich reacted appropriately as a Marine squad leader in protecting his troops in the midst of a chaotic war or went on a vengeful rampage, disregarding combat rules and leading his men to shoot and blast indiscriminately at Iraqi civilians.

    Prosecutors in their opening statement Monday painted a picture of a young Marine with no prior combat experience losing control after seeing his friend's body blown apart.

    Prosecutor Maj. Nicholas Gannon said the evidence will show Wuterich "made a series of fatal assumptions and he lost control of himself."

    Wuterich has said he regretted the loss of civilian lives but believed he was operating within military combat rules.

    The tragedy prompted tightening of those policies, with commanders demanding their troops positively identify their targets before firing.

    Staff Sgt. Justin Laughner went in after the raids to gather military intelligence and testified Tuesday that he found no signs of insurgents. He took photographs of 23 bodies.

    In 2008 testimony in the court-martial of another Marine in the case, Laughner acknowledged deleting photos he took at the scene under an officer's orders and later lied repeatedly to investigators about what happened to the images.

    "I remember some of the kids had their eyes open," Laughner testified Tuesday, saying he was shaken by the carnage he saw in the back bedroom.

    "I just wanted to leave the bedroom," he said. "I just thought it was really sad."

        That is a scary thought. We might all just die from extreme bordom as they bloviate, pontificate, and then pat each other on the back about how noble they are. Then they'll look doen their noses at us normal people and preach to us about civility.

      Something goes wrong, and who do the court-martial? A lowly Staff Sergeant. Where the hell were his officers when all this was going on? You never see a high-ranking officer dragged over the coals, only enlisted men they can use as scapegoats. This trial is a disgrace.

        AMEN! Finally someone that has actually thought about this situation besides myself. I was wondering the same #$%$ thing. Marines dont do what they want, they take orders and those orders are followed. So who ordered this man to wipe the floor with these victims? That is the person who should be sitting in court right now, not this guy!

        Officers do not court-martial unless they need a fall guy due to public out cry. They just get honorably discharged if found to have violated their oath, duty, or UCMJ.

      Our most decorated soldier of world war 2 stated he never heard of a good war. Too many innocent people die and the mentality of too many soldiers are lost forever and do not come home as the same person to the ones who loved them.

      Do you think any innocent civilians were killed during WWII when we carpet bombed Germany or dropped a couple of nukes on Japan? This is why we should not go to war without a formal declaration of war approved by Congress as called for in the Constitution. We are now just mercenaries for the United Nations and NATO. We should not be committing US military forces to fight wars on behalf of international corporations. Weapons and war seem to be our only exports now.

      Our fearless leaders who duck combat duty send our young men and women to die in another worthless hellhole, that had absolutely nothing to do with U.S. security. Do we ever learn from history? Ten years from now the Sunnis and Shiites will still be killing each other in Iraq, and someone will say it was all worth it because we removed Saddam from power. All because this country, for 40 years, has no cohesive energy policy, and depends on the Middle East for oil, even though we have huge untapped reserves right here in the U.S. Madness.

      Being a vet and a father of two marines that had tours in Iraq and afganistan The stories they told me made my blood turn cold. War is hell if you enter into war it is a moral obligation to bring it to a quickest end as possiable. My country has a way of sending my boys and your boys into war only to tie there hands cant shoot till you ID your target My country doesnt like to look bad Ive never understood that. Iam the one taking fire seeing my friends and buddies burnt the smell of human flesh is something one nevers forget Hearing your buddies screaming MOM MA as they realize there hit thinking there going to die.Here in the good old USA our children a majority of them never have to experiance death every day like those children do in the third world countries to them its apart of everyday living you train our boys starting in Boot camp they break you down then build you back up all for our beloved country yea right. train you show how to kill brainwash you telling you its for God and Country when in reality its really your buddy you are fighting for no one wants to be there thrusting you into a life and death situation seeing horrad things that will give you nightmares in the daytime things you will never block out of your mind How do you espect our boys to act first time in combat 6 or 7th times of taking fire while on patrol then denying you the chance to fire back.. thinking its your turn for that purple heart or to loose a limb or die. If you are going to involve our young men putting there boots on the ground then by heavens you dam well better back them up and quit tying there hands.

      I served in Iraq, people live in a constant state of overwhelming stress. I could see someone losing it after such as traumatic event as seeing their buddy blown up by a roadside bomb. It doesn't take much to snap in that environment.

      In all modern wars, over 90% of the casualties are innocent people, 1/3 of them children. The only ones who want war are those who never take part in it, which are the military industrial complex and other war profiteers and the puppets in government who work for them.

      Being in that situation as we were in Lebanon your nerves are shot as you know not whom to trust as those that wish you harm look exactly like those that dont. This is both right and wrong at the same time and is much like punching a man in the nose and then getting angry because he bled on your floor. Bully God bless the Marines and the blanket of freedom that they provide. I for one will never question how this blanket is provided as I know that there are evil men in dark places ready to do what needs to be done

      As a former Marine, I understand far too much of the horror and confusion of battle and its devastation of men; both emotionally and physically, none of which is temporary. Devastation not even Hollywood can begin to create or even imagine. I have seen men do heroic things under the most impossible of circumstances, only to be asked to do it all over again the next day. We Marines train with great intensity and precision so it becomes second nature, so as to be ready to answer America's call.

      We all make mistakes. We know we make mistakes. I don't know any military commander, who is honest, who would say he has not made a mistake. There's a wonderful phrase: 'the fog of war.' What 'the fog of war' means is: war is so complex it's beyond the ability of the human mind to comprehend all the variables. Our judgment, our understanding, are not adequate. And we kill people unnecessarily."

      If you never survived a firefight, you are not qualified to comment. If you were a Viet Nam veteran, you understand completely. War is dangerous for women, children and other living things. Our country sends us to war and we do the best we can with what we are dealt. If you want to end war atrocities, stop having wars. Decorate the Marines for a job well done and better prepare them for the next war. This also goes for law enforcement. An officer has usually about two or three seconds (if he is lucky) to react to a threat or incident. The lawyers and bureaucrats sit back for 6 months examing the after math and decide if the officer made all the right decisions. The same is taking place with these Marines, they did their best, and reacted in seconds. It is unfair for any one that was not there and under the stress and duress of the incident to make judgements. These are great Americans and they do not deserve this stigma, or anything less than calling them great Americans. As the old saying goes; Do not judge another until you walked in the other's shoes.

      Mistakes were made... Yep, there were... War, combat, watching your men being blown to pieces, shot to hell and putting your friends in body bags... Most of you can't really read this and understand what takes place in the moment when bullets are wheezing by your head and your responsible for the lives of your men... These Marines made mistakes, war is hell... I can sit here and type these words and look and think about the bullet holes in my back, legs, and the fragments that tore up my face and the seven operations to put it back together, still one ear is two inches lower than the other and I need a Cain to walk... O well, right... I love my country and I Love these men, each one of them, unconditionally... I'm a proud United States Marine and I'm proud of these Marines... We live, and sadly, our families live with the thoughts of our battles and the faces of the people we've killed each and every day... Help? Sure there's help... My first kill was thirty-six years ago, i was eighteen years old... While looking threw his pockets for in-tel there was a picture of his family, a beautiful little girl, two sons and of course him, his wife, not bad looking but you could see only her eyes through her head scarf... I still see them in my head now a then... I'm sure i will tonight... Set these men free... They will see and feel their mistakes and actions each and every day for the rest of their lives, believe me that's punishment enough... I Love you guys, stand tall...
