    Suit filed after NM teen cuffed for burp in class

    ALBUQUERQUE, N.M. (AP) — A 13-year-old was handcuffed and hauled off to a juvenile detention for burping in class, according to a lawsuit filed against an Albuquerque school principal, a teacher and school police officer.

    The boy was transported without his parents being notified in May after he "burped audibly" in PE class and his teacher called a school resource officer to complain he was disrupting her class. The lawsuit also details a separate Nov. 8 incident when the same student was forced to strip down to his underwear while five adults watched as he was accused of selling pot to another student; the boy was never charged.

    The suit was one of two filed Wednesday by civil rights attorney Shannon Kennedy, who says she has been fighting the district and police for years over the use of force with problem children. She says a review of school and Bernalillo County records shows more than 200 school kids have been handcuffed and arrested in the last three years for non-violent misdemeanors.

    In the second lawsuit filed Wednesday, the parents of a 7-year-old boy with autism accuse a school officer of unlawful arrest for handcuffing the boy to a chair after he became agitated in class. New Mexico law prohibits officers and school officials from restraining children under 11.

    The suits come one year after the same attorney settled a class action lawsuit against the district that was prompted by the arrest of a girl who Kennedy said "didn't want to sit by the stinky boy in class." And Kennedy says she has a number of other cases she is preparing over treatment of students in Albuquerque by school officials, school police, city police and sheriff's officers.

    "I am trying to get all the stake holders in a room to get people properly trained to prevent this from happening," Kennedy said.

    Kennedy said the problem lies with the schools more than with the law enforcement agencies.

    "It lands in the lap of the principal. There are good schools and bad schools. The principals ... who are handling their schools properly don't need to have children arrested. It's ridiculous."

    A spokesman for Albuquerque Public Schools did not immediately return calls and emails seeking comment on Thursday. A police spokeswoman said the department does not comment on litigation.

    One school board member, Lorenzo Garcia, said he had not seen and could not comment on the lawsuits, but he did say he was concerned about what appeared to be schools getting stuck on a "zero tolerance policy."

    "Really, in my opinion, this really increases the whole idea of the schools-to-prison pipeline," he said.

      These schools are being ridiculous. Jailing a kid for burping in school is insane. The parents are right about suing in this case. Teach them bully teachers, bully school staff, and bully police officers a painful lesson. I hope they get millions. Public schools suck.
      I would have loved to rip out a bunch of 110 decibel burps in front of these bozos if I was there.

      This is not even a case of a problem child. The child burped..how the hell does that disrupt class? Alaos it doesnt have to end up i court but then again this is the Land of the Free!

      Police and school officials have to become a little more enlightened. In case they hadn't noticed, our toxic environment has created a growing population of children with neurological disorders, such as autism. You don't punish a meltdown in a child with autism any more than you punish a blind child for walking into something. Where is the compassion and the humanity? I think we lost it with the value of the dollar. I am ashamed of us.

      It's appalling how many schools no common sense. If the kid's a wise#$%$ make him run laps til he wise's up. It even more appalling how many school have an unspoken policy of trying to punish disabilities like ADHD and autism out of kids. Guess what? I doesn't work.

      Oh dear major win for this family what the hell is this world coming to when a kid gets cuffed for burping. Public schools really need to be investigated for discrimination against certain students. I have a cousin who has been going to a school that has discriminated against her she even had a teacher kick her because he had a dollar sticking to his shoe it fell off and she picked up and gave it back to him and he accused her of stealing. If I had anything to say about it this school would be in court. Can't believe what happens in our communities these days.

      I was a teacher for 27 years. You could tell by 3rd grade which kids were going to end up dead or in prison by the time they were 18. His "protective parents" can visit him in prison. Here in Texas they'll be able to see him every Sat or Sun. The school only has him for the rest of the school year-his parents-----forever. I'm sure their little "angel" has some horns under that halo.

      There was a kid in my school who would go around belching obnoxiously or blowing it in peoples faces to gross them out.
      He eventually burped in the wrong guy's face. One hard punch in the stomach and he never did it again.

      I read the comments and I see that everyone is outraged by the arrest of the burping kid. While this is aweful, I find even worse the fact that they handcuffed a 7-YEAR OLD AUSTISTIC KID for becoming agitiated in class.

      I've been working in the public schools for 26 years. A burp is the LEAST of my concerns in class! Wow. Just ridiculous.
