    Texas execution halted amid Supreme Court review

    HUNTSVILLE, Texas (AP) โ€” A black man convicted of a double murder in Texas 16 years ago was at least temporarily spared from lethal injection when the U.S. Supreme Court agreed to review his lawyers' claims that race played an improper role in his sentencing.

    The court on Thursday halted the execution for Duane Buck, 48, two hours into a six-hour window when he could have been taken to the death chamber. Texas officials, however, did not move forward with the punishment while legal issues were pending.

    Buck was sentenced to death for the fatal shootings of his ex-girlfriend and a man in her apartment in July 1995. His attorneys had asked both the Supreme Court and Texas Gov. Rick Perry to halt the execution because of a psychologist's testimony that black people were more likely to commit violence. Buck's guilt is not being questioned, but his lawyers contend the testimony unfairly influenced the jury and Buck should receive a new sentencing hearing.

    The nation's highest court, without extensive comment, said it would review an appeal related to that testimony. The decision meant Perry did not have to act on a request from Buck's lawyers that the governor use his authority to issue a one-time 30-day reprieve.

    Buck's case is one of six that then-Texas Attorney General John Cornyn โ€” a political ally of Perry who is now a Republican U.S. senator โ€” reviewed in 2000 and said needed to be reopened because of racially charged statements made during the sentencing phase. In the other five cases, new punishment hearings were held and each convict again was sentenced to die.

    State attorneys contend Buck's case was different from the others and that the racial reference was a small part of larger testimony about prison populations. Jurors in Texas must decide on the future danger of an offender when they are considering a death sentence.

    Perry is a capital punishment supporter and as frontrunner for the Republican presidential nomination his actions now are coming under closer scrutiny. During his 11 years in office, 235 convicted killers in Texas have been put to death. His office said he has chosen to halt just four executions, including one for a woman who later was executed.

    Buck's lawyers called to tell Buck of the reprieve and the inmate was praying in his cell when Texas Department of Criminal Justice spokesman Jason Clark approached.

    "Praise the Lord!" Buck told Clark. "God is worthy to be praised. God's mercy triumphs over judgment.

    "I feel good."

    In its one-paragraph decision, the court said it stopped the punishment so it could further look at Buck's request, known as a writ of certiorari. If the court decided against the writ, the justices said the reprieve would be lifted, meaning Buck could receive a new execution date.

    "No one should be put to death based on the color of his or her skin. We are confident that the court will agree that our client is entitled to a fair sentencing hearing that is untainted by considerations of his race," Kate Black, one of Buck's attorneys, said.

    Buck was convicted of gunning down ex-girlfriend Debra Gardner, 32, and Kenneth Butler, 33, outside Houston on July, 30, 1995, a week after Buck and Gardner broke up. A third person, Buck's stepsister, Phyllis Taylor, also was wounded, though she has since forgiven Buck and sought for his death sentence to be commuted to life in prison.

    Buck's attorneys went to the Supreme Court after losing appeals in lower courts. A clemency request to the Texas Board of Pardons and Paroles, all of whom are Perry appointees, also failed.

    Assistant Attorney General Edward Marshall had told the high court that Buck's appeals were attempts to relitigate claims that every court, including the Supreme Court, already rejected.

    Perry was not in the state Thursday, meaning any final order to delay would have come from Lt. Gov. David Dewhurst. However, Perry's office frequently points out that he remains the governor and in contact with Austin while traveling.

    Two more Texas prisoners are set to die next week.

      Am I the only one that read the article correctly? There is no question that Duane Buck committed two murders. No one doubts that he is guilty. I have been following his case(s) since '95. His color was never an issue. Buck has been using the race card to relitigate claims in every court that has rejected this. This is not his first, second, nor third attempt at this.

      If racists and bigots would keep their big yaps shut and stop proudly proclaiming their prejudice in public, especially in courtrooms, the administration of justice and government would be much more effective. Who do you think gives a fig for what you think of someone else's race, religion, nationality, gender, sexual proclivities, etc.etc.?

        Even more telling is that the black males do most of the killing, so it is about 6% of the population doing 50% of the murders. "Funkdr." it is race. It is genetics. Learn about the MAOA-L gene, it's prevelence in various races, and its causative effect in commission of violent crime.

      For all you racist out there my brown skin color doesn't define me, i am a male like any other male out there just because someone is brown like me and does something bad doesn't mean you can define other people who have brown skin and say we all do it, it's quite ridiculous there are people of all different skin tone who do bad things and you really play into the media hype and what the world tries to tell you instead of making your own choice and you know it's true most people believe whatever there told on the news or tv cause your so brain washed it is really sad. my look on this is that he should get life no matter what color you are because i don't think we have the right to kill people even though they killed but we can punish them but that's just me. the choices you make in life all depend on how you were raised up by your parents and that's the truth no matter what skin color you are you have your own free will and this guy chose to kill like many others skin has nothing to do with it again you let media hype get you hyped up and scared of people with brown skin and that's just not the truth because my family is interracial my parents are white i have a white sister and a brown brother & sister who i love with all my heart even though by blood we weren't born into the family and don't have the same birth parents we still consider ourselves brother and sister and that it was just meant to be before either of us were born and the color of our skin has never been an issue you let other people scare you and make it one plain and simple because were doing just fine and always will. open your hearts and let the hate go and give me all the thumbs downs you want because i got true love folks a family that loves me no matter what color my skin, friends of all shades & the most wonderful girlfriend a guy could ask for who so happens to be white and you say we can't get along? just lies to scare. you can't touch me i build up buildings with the hate you sling towards me =)

        This is not being racist it is the truth, it is something that you dont see. I grew up around black people and the ones that I grew up around never used the card. But I tell you it does get old seeing it. I believe everyone bleeds red. I rarely see a white person use the N word. I have yet to see one pull the card. Granted their are those out there that use that word. And there are some "white trash". But I tell you this for truth and fact, the only ones I see using that card are black folks

        Yes, Jarhead this is the problem. Anytime someone black get in trouble the first thing they do is play the race card. I am not a bigot by any means, however, I do get real tired of hearing calls of racist anytime someone of color is in trouble (or when a liberal is losing the argument they bring out that card too).         There aren't as many people oppressing you as you think. Who said we can't get along? I encounter WAY more racism from black than i do from white and its just ignored. Perhaps this is just the way things are in STL but frankly I'm sick of the race card as well. And for your information:
        from the article above: "Buck's guilt is not being questioned.." In other words, race aside, he still murdered 2 people. Stating that a black man is more likely to commit violence IS INDEED racist, but if the guilt isn't even being questioned by his attorneys, what does it matter? Its sounds to me like his stepsister was there as a witness and a victim to his actions as well. It's a really, really easy rule to follow - Don't murder people and you don't risk capitol punishment!

      There are other cases in which new evidence has surfaced that could have proclaimed innocent, but Governor Perry has not ordered one stay of execution despite 248 executions on his watch, a record by over 100 executions. Perry only cares about his political #$%$ The previous record of 147 executions was set by, you guessed it, George dubya Bush. Out of those 393, there were more than likely some who were murdered by mistake. Texas is out of control. The rest of the states combined did not come close to killing that many people during the same time frame. People like the Green River Killer, Jeffrey Daumer, John Wayne Gacy etal. should fry, but unless there is no doubt, not beyond a "reasonable doubt", then the death penalty should not be an option.       When in doubt, lock him in a cell for as many years as is necessary until you either carry out the sentence or take a different path. But Texas is a God Fearing state, so they say.
      Our Nation was built on the belief in God with the freedom to worship as we please. Interesting though... I am by no means a 'religious' person. I believe in God but have no faith in these money making facilities called religions. Sorry if you are offended but... there are God's COMMANDMENTS. Not suggestions! If you are religious and believe in God's laws then 'THOU SHALT NOT KILL' applies to EVERYONE, ALL the time. God never said but it's ok for the courts and legal folks to execute anyone. If you believe that it is ok to execute someone for a crime, you will surely join them in the hereafter, whatever that is.
      It amazes me how arrogant mankind is that we allow ourself indulgences and exceptions when none are indicated. Or maybe, there are no commandments. It's all made up.
      Either you are a believer or you do not believe. Simple.
      If you believe in God you SHALT NOT KILL. Period.

God also made man in God's imiage with the ability to think and reason for himself. Therefore, man decided this man was guilty and decided his punishment. That is the highest law and should be carried out. Stone him to death.
