    Texas police kill 8th-grader carrying pellet gun

    BROWNSVILLE, Texas (AP) — The parents of an eighth grader who was fatally shot by police inside his South Texas school are demanding to know why officers took lethal action, but police said the boy was brandishing — and refused to drop — what appeared to be a handgun and that the officers acted correctly.

    The weapon turned out to be a pellet gun that closely resembled the real thing, police said late Wednesday, several hours after 15-year-old Jaime Gonzalez was repeatedly shot in a hallway at Cummings Middle School in Brownsville. No one else was injured.

    "Why was so much excess force used on a minor?" the boy's father, Jaime Gonzalez Sr., asked The Associated Press outside the family's home Wednesday night. "Three shots. Why not one that would bring him down?"

    His mother, Noralva Gonzalez, showed off a photo on her phone of a beaming Jaime in his drum major uniform standing with his band instructors. Then she flipped through three close-up photos she took of bullet wounds in her son's body, including one in the back of his head.

    "What happened was an injustice," she said angrily. "I know that my son wasn't perfect, but he was a great kid."

    Interim Police Chief Orlando Rodriguez said the teen was pointing the weapon at officers and "had plenty of opportunities to lower the gun and listen to the officers' orders, and he didn't want to."

    The chief said his officers had every right to do what they did to protect themselves and other students even though there weren't many others in the hallway at the time. Police said officers fired three shots.

     

    Shortly before the confrontation, Jaime had walked into a classroom and punched a boy in the nose for no apparent reason, Rodriguez said. Police did not know why he pulled out the weapon, but "we think it looks like this was a way to bring attention to himself," Rodriguez said.

    About 20 minutes elapsed between police receiving a call about an armed student and shots being fired, according to police and student accounts. Authorities declined to share what the boy said before he was shot.

    The shooting happened during first period at the school in Brownsville, a city at Texas' southern tip just across the Mexican border. Teachers locked classroom doors and turned off lights, and some frightened students dove under their desks. They could hear police charge down the hallway and shout for Gonzalez to drop the weapon, followed by several shots.

    Two officers fired three shots, hitting Gonzalez at least twice, police said.

    David A. Dusenbury, a retired deputy police chief in Long Beach, Calif., who now consults on police tactics, said the officers were probably justified.

    If the boy were raising the gun as if to fire at someone, "then it's unfortunate, but the officer certainly would have the right under the law to use deadly force."

    A recording of police radio traffic posted on KGBT-TV's website indicates that officers responding to the school believed the teen had a handgun. An officer is heard describing the teen's clothes and appearance, saying he's "holding a handgun, black in color." The officer also said that from the front door, he could see the boy in the school's main office.

    Less than two minutes later, someone yells over the radio "shots fired" and emergency crews are asked to respond. About two minutes later, someone asks where the boy was shot, prompting responses that he was shot in the chest and "from the back of the head."

    Administrators said the school would be closed Thursday but students would be able to attend classes at a new elementary school that isn't being used.

    Superintendent Carl Montoya remembered Gonzalez as "a very positive young man."

    "He did music. He worked well with everybody. Just something unfortunately happened today that caused his behavior to go the way it went. So I don't know," he said Wednesday.

    Gonzalez Sr. said he had no idea where his son got the gun or why he brought it to school, adding: "We wouldn't give him a gift like that."

    He said he last saw his son around 6:30 a.m. Wednesday, when the boy said goodbye before leaving to catch the bus to school. And he said nothing seemed amiss the night before when he, his wife and their son went out for nachos then went home and watched a movie.

    Gonzalez Sr. was struggling to reconcile the day's events, saying his son seemed to be doing better in school and was always helpful around the neighborhood mowing neighbors' lawns, washing dogs and carrying his toolbox off to fix other kids' bikes.

    Two dozen of his son's friends and classmates gathered in the dark street outside the family's home Wednesday night. Jaime's best friend, 16-year-old Star Rodriguez, said her favorite memory was when Jaime came to her party Dec. 29 and they danced and sang together.

    "He was like a brother to me," she said.

      I can't believe the sick and immature comments from some of the people here who sounded like they took pleasure in someone's death. Look, this kid brought a pellet gun to school, didn't listen to police's order, and he paid his price. He's dead, so why keep trashing him and his parents?

      Cops are suppose to do everything they can to not fatally wound people, clearly this officer felt as if he did not need to follow rules so which he should be punished for. In this messed up government they will think this cop did something right, i bet he wont get more than a month off of work. He should be fired and sent to jail for aggravated murder, but that's just my opinion.

      The kid didn't actually shoot the officers. I am not saying he did something right, in fact i agree it was wrong but personally I think the officers didn't have to kill him. If they really thought shooting was the right thing to do why not just shoot him so he goes down. There was no reason to kill him. You see murders and whatnot get sentenced to prison but 8th graders getting shot. Come on what the hell is this.

        Wonder if (and i am not against what they did) they ever thought since they parobably had him out flanked and had him outnumbered, that no one thought about using a taser instead of a gun to take him down? I know about gun on gun, but if you're surrounded you can't 'see' everyone.
        Also have to wonder about the circumstances that led up to it. Did the kid have drugs in him, got beat up a lot or was already in trouble there for some reason. Too late now but it might save someone else.

        and we will never know the facts ,rember the blue line ,cops lie to everone so they never can get charged with murder,when the ofender gets to have his friends look to see if he did any thing wrong they will never find it because the bad guy was one of thier own,.
        as for being 15 and in the 8th grade have you ever heard of t-1 not everybody is is ready to go fron kindergarden to first grade some are not as dumb as you try and portray the kid for all you know you just sound racest to me

      Sorry to say it, and though it's sad this kid was killed, he wasn't killed over a pellet gun, he was killed because he pointed a pellet gun that looked like a real handgun at officers, and declined to put it down after repeated requests from the officers, simple as that.

      For those of you that say, they should have shot him in the arm or the leg, I'd like to see how well you shoot at a range, and then factor in the surge of adrenaline you have when someone points a presumably lethal weapon at you, and you have a wife and a couple of kids at home, you will aim for what you have the highest chance of hitting, center mass, which is what they are trained to do.

      It's sad to say, and sometimes the truth hurts, I'm sure that none of these officers went to work that day hoping to shoot a 15 y/old, and it probably haunts them now, and will forever, but that kid forced their actions, plain and simple.

      A tragedy, yes, but not their fault. No I'm not a cop, and yes, I believe they screw up A LOT, but I don't believe this is one of those times. My heart goes out to the family of the kid, and the officers, cause God knows, they're all hurting right now.

        Richard, I agree, and add to that the emotion of all those other children in the school that those cops felt were jeopardized. If they are fathers themselves, that protective drive would have been kicked into high gear.

        Perfect Richard ... People do not get that you can empty a full 15 round clip into a guy and he can still travel the distance to you and kill you. You die from blood loss 99.999 % of the time and it takes a little while. I have heard stories from cops about guys being shot in the head multiple times and still firing multiple times at the officers. Shoot to kill period. I hate when people are like oh just take out their leg etc. If like were like a tv show then it would work.

        @ Adam, it's true, especially if their finger is on the trigger at the time they are shot. The message has already been sent from the brain to the finger and regardless of how many times the police shoot at you, they won't stop until you are down and they can clear the gun.

      Why all the questions. It boils down to someone pulled a weapon to escalate the situation into a gun fight. Cops won. The only one who knew the outcome before hand was the 15 year old. He knew he didn't have a real gun. He was the only one who could have stopped it.

      For those commenting about why the police killed the boy, there is no reason to assume the gun was anything other than what it appeared to be. Had the boy been carrying a loaded 9mm and shot someone, then people would be up in arms about police not having shot him sooner. Police officers are trained to shoot to center mass when they are discharging their weapon to prevent innocent bystanders from being injured in the crossfire. The police did what they had to do and regrettably, there is a 15 year old that is dead as a result. However, had he listened to the police and put the weapon on the ground, he would most likely still be alive, but sitting in prison. Our choices have consequences, no matter what age we are.

      If I ever pulled a gun, bb or otherwise, on a cop, my mother would shoot me herself. Believe that. I can appreciate this grieving mother's position. Having said that, I hope she realizes that virtually no one else in the community feels this was an injustice. A person pulled a gun on police. The police shot him dead. If it was her child in danger from some other child, I feel she wouldn't be so forgiving. I guarantee that these parents try and sue. I hope they don't. They will truly become outcasts in that town.

      As a Hispanic (4th generation American citizen I might add), I have seen a couple of incidents like this as I grew up in a predominantly Hispanic neighborhood. I have witnessed protests of family and friends of a suspect claiming their loved one was the victim. It makes me sick to my stomach and I'm embarrassed by it. I raised my son as a single mother but I let him know that every action has a consequence to it. If that means jail time, so be it. I'm sorry for the family because it sounds like this kid was a good one but he had underlying issues that were not revealed until it was too late. Whether the parents gave him the gun or not, he brandished one and threatened other lives with it and the police did what they were trained to do. As for him only being 15, he was old enough to know the difference between right and wrong. I will keep this family in my prayers and for the police officers as well because being a friend to many officers myself, I know what they will be facing in the future.

      Come on, the boy is 15 (and probably looked like he was 18) and in the middle school. The other students heard him call out his threats and he's carrying a weapon that was meant to look real. Feel bad for the police and the boys family. And if it was a real weapon and other students were hurt, the police would be blamed.

      Rules of engagement are quit clear, never point a gun at someone you do not intend to kill. The officers had no option in an open hallway. They cannot be expected to wait until they are shot to determine if the gun is real or not. All students know not to bring a weapon to school. Everybody knows that if you point a gun at a police officer, your fate is sealed.
