Three male students — two third-graders and a fifth-grader — at an elementary school in New York City forced a third-grade boy to perform oral sex on them, according to a disturbing lawsuit.
The March 2012 incident allegedly occurred in a bathroom at Public School 194 in Harlem, reports the New York Daily News. The eight-year-old victim was standing in a hallway when the three assailants dragged the boy into a bathroom stall. His pleas for help went unheard.
“When I was going on line three kids drag me to the bathroom and they pull down there (sic) pants,” the boy wrote in a statement to the school, according to court papers. “I told them no but they didn’t listen to me.”
One of the culprits allegedly pinned the victim’s hands behind his back. Another pushed him to his knees.
When the traumatic scene finally ended, the boy notified a teacher.
A guidance counselor and the school principal called the boy’s mother, who isn’t named.
“I don’t know how to explain this to you, but your son was in the bathroom and was forced to perform oral sex on three boys,” the principal allegedly told the boy’s mother when she arrived at the school.
The boy’s mother also said she was the one who had to call police.
The $6 million suit against the New York City’s Education Department alleges that the fifth-grade attacker had sexually assaulted a female student two years earlier yet school officials did not warn parents, formally record the prior incident or discourage such behavior in the future.
“He’s just a kid,” the principal told the previous female victim’s mother, according to the Daily News.
The suit also claims “emotional and psychological anguish.”
School officials responded with slaps on the wrist for the three boys who allegedly forced the third-grade boy into oral sex. The third-graders got five-day suspensions. Police also arrested the three juveniles at some point but it’s not clear if any charges were filed or if any criminal penalties resulted.
The victim, who is now nine-years-old, did not return to the school. He was able to transfer to a different, unnamed school a few weeks after the heinous incident.
P.S. 194 is among the schools on New York State’s list of “persistently dangerous” schools, notes the Daily Mail.
