    Tobacco companies file lawsuit over warning labels

    COLUMBIA, S.C. (AP) — Tobacco companies want a judge to put a stop to new graphic cigarette labels that include the sewn-up corpse of a smoker and pictures of diseased lungs, saying they unfairly urge adults to shun their legal products and will cost millions to produce.

    Four of the five largest U.S. tobacco companies sued the federal government Tuesday, saying the warnings violate their free speech rights.

    "Never before in the United States have producers of a lawful product been required to use their own packaging and advertising to convey an emotionally-charged government message urging adult consumers to shun their products," the companies wrote in the lawsuit filed in federal court in Washington.

    The companies, led by R.J. Reynolds Tobacco Co., Lorillard Tobacco Co., said the warnings no longer simply convey facts to allow people to make a decision on whether to smoke. They instead force them to put government anti-smoking advocacy more prominently on their packs than their own brands, the companies say. They want a judge to stop the labels.

    The FDA refused to comment, saying the agency does not discuss pending litigation. But when she announced the new labels in June, Health and Human Services Secretary Kathleen Sebelius called them frank and honest warnings about the dangers of smoking.

    The FDA approved nine new warnings to rotate on cigarette packs. They will be printed on the entire top half, front and back, of the packaging. The new warnings also must constitute 20 percent of any cigarette advertising. They also all include a number for a stop-smoking hotline.

    One warning label is a picture of a corpse with its chest sewed up and the words: "Smoking can kill you." Another label has a picture of a healthy pair of lungs beside a yellow and black pair with a warning that smoking causes fatal lung disease.

    The lawsuit said the images were manipulated to be especially emotional. The tobacco companies said the corpse photo is actually an actor with a fake scar, while the healthy lungs were sanitized to make the diseased organ look worse.

    The companies also said the new labels will cost them millions of dollars for new equipment so they can frequently change from warning to warning and designers to make sure the labels meet federal requirements while maintaining some distinction among brands.

    Joining R.J. Reynolds and Lorillard in the suit are Commonwealth Brands Inc., Liggett Group LLC and Santa Fe Natural Tobacco Company Inc. Altria Group Inc., parent company of the nation's largest cigarette maker, Philip Morris USA, is not a part of the lawsuit.

    The free speech lawsuit is a different action than a suit by several of the same companies over the Family Smoking Prevention and Tobacco Control Act. The law, which took affect two years ago, cleared the way for the more graphic warning labels, but also allowed the FDA to limit nicotine. The law also banned tobacco companies from sponsoring athletic or social events and prevented them from giving away free samples or branded merchandise.

    A federal judge upheld many parts of the law, but the companies are appealing.

      So if everyone is so gung ho on smoking causing cancer, then explain to me why older people in their 90's have been smokers all their lives and are cancer free? Why are native american indians, who smoke tobacco, cancer free and live to be over 100? Is it maybe because they haven't been exposed to food additives as much as well have? GMO as much as we have? How does a newborn acquire brain cancer? How come scientists are always announcing a "treatment" for cancer, but they can't seem to find a cure? Do you think maybe doctors WANT to find a cure? If they did, they wouldn't have as many patients to deal with and thus wouldn't make a lot of money, pharmaceutical companies would be out of business, the world would be healthy. Does this sound like something Doctors want to see happen? I don't give money to medical charities anymore because it's #$%$ they KNOW how to cure all these diseases and they won't because the big bucks will stop falling into their hands. Btw, I smoke American Spirits, additive free tobacco..just like the indians. I'm changing my diet to go completely organic and probiotic through the help of a alternative medicine doctor/nutritionist. For all those people saying we should charge more health insurance costs for smokers, that's discriminatory. If you start doing that, then you'll have to charge more to extreme athletes because i'm sure they'll break more bones and have more surgery than the average person. Charge more to those who don't cook at home and only eat out because you don't know what's going into that lovely velvety sauce on your steak. Maybe charge more to people who eat meat because there is a high risk for acquiring e.coli or some other bacteria.

        my dad smoked all his life except for the last 5 years , and they killed him . You do what you want . The bennies of not smokeing in terms of how you feel and look with out smoke, you will find out , out weigh being saddled with a stinking dirty habbit that robs your body of the natural elasticity your arteries need to do their job . My dad died because his arteries wern't elstic to stand being sutured . But it's your choice . Have a good one. And best of luck to , what ever you descide to do. R.K.

        Alcohol, weed, cheese, hamburgers & fries, cars, trains, plains, bicycles; I guess we need to stop selling these items too---combined the above, you would find that cigarettes would be 1% or 2% of the total deaths annually.

      - if with child, no smoking in the vehicle or house

      forget the warnings! JUST MAKE THE SMOKING AGE TO 20! We raised the drinking age to 21 from 18 cause we knew the problems of teens drinking....so why are we letting teens buy cigs?!

      I hope everyone here that thinks cigarettes should be banned realize that over 50% of the cost of a pack is state/local and federal taxes. I find it very safe to assume ALL smokers do in the long run contribute far more taxes to the system then nonsmokers. Go ahead and ban cigarettes but that lost tax revenue is now going to be made up by you.

      The cost of a pack of butts should reflect the cost of their use. I am supportive of an extra cost for risky behavior. I know, we'll have to define what is and is not risky behavior, but smokers already pay higher insurance rates. Why should they not pay a bigger chunk of their medical bills, the higher costs are passed on to the rest of us, which I find even more obectionable. I do not want to pay more because some choose to smoke, not use seatbelts, not wear cycle helmets etc. I DO NOT WANT TO PAY MORE. I DO NOT WANT TO PAY MORE, which by the way we all do!

      While I don't and never have smoked, do hate smoking, think it stinks and know it shortens life, I have seen the effect of these types of labels in other countries. I lived in Asia for 11 years where the labels were required, they had exactly zero effect. Again, I do not in anyway support smoking, would support a ban, don't go to places where there are smokers, don't allow smoking in my house or car, but I cannot support this intrusive law!

      everybody thinks that smoking is the cause of all these diseases.....(shortness of breath, COPD, emphysema, lung CA, etc.).....the fact is...smoking is the contributor......the cause of these things is not smoking...like we have been told and so many times been show that this is fact....this is all a ploy......our environment..(outside, the yard, the chemicals we use, and stuff like that) that is our cause of cancer, heart disease and all........that is the truth that is what the gov does not want you all to know........this talk about second hand smoke...c'mon ppl... i thought we were smarter than the govt but evidentally i was wrong......because so many ppl believe what they are told and believe that the govt would not lie to them......bull.......the gov lies everyday..that is what they do........get a clue....our govt.....our health pro and all lie to each and everyone of us every day and most of us sit there and agree with it.........hello are we really that stupid??????

      I think along instead of the taxes on these things (Tobacco, fast food, alcohol) there should be a precondition exemption for medical care. If you suffer from any ailments from these (Lung ailments, obesety, liver disease) it should not be covered under your medical care, plain and simple. YES this is a simplified generalization of what would need to go into a bill of this nature, but you get the idea.

      I smoked for 31 years, 3 packs a day, starting at 13-years-old. I know the power of denial. There are all kinds of chic cases out there that could easily cover up these images. I'm not saying they shouldn't be required, or that they should. But I am saying they won't necessarily have the desired effect.

      Those who have never smoked have no idea what it's about. Those who smoke are not stupid. They are addicted. It's an addiction that's harder to quit than heroin. I wish that there was more compassion around this. Yes, folks have the right to control their environments. Forbid smoking in your home, ban smoking in public places, protect yourselves and your children. But in the process, please don't demonize the human beings who smoke.

      I stopped smoking just over 9 years ago. Not one single solitary puff since, or I am sure I would start up again. I can't stand to be too close to people who smoke, much less smoke itself. People ask how I did it. The only answer I have is that I was ready. I wish that was more easily duplicated or transferred. I just don't have any wisdom for those who want to quit. And that's why I believe that the key is stopping young people before, or very shortly after, they start.

      Perhaps these images will help with that. But I think it will take more, on a broader and deeper societal and cultural basis. I believe that begins with some true compassion for those already addicted. Don't soften the science or the message, but please at least stop calling people stupid?!
