    Tribunal publishes indictment in Hariri murder

    LEIDSCHENDAM, Netherlands (AP) — Prosecutors analyzed a vast network of telephone records to link four Hezbollah members to the assassination of former Lebanese Prime Minister Rafik Hariri, but there is no clear smoking gun in the case, according to an indictment unsealed Wednesday.

    The U.N.-backed special court investigating Hariri's murder published the 47-page indictment against four members of the Iranian-backed Shiite militia Hezbollah for alleged involvement in the deadly truck bombing that killed Hariri in 2005.

    The publication comes after the Special Tribunal for Lebanon said last week that Lebanese authorities had been unable to arrest the four suspects or serve them with their indictments.

    Hezbollah, Lebanon's most powerful political and military force, has denied involvement and said it will never turn over the suspects. Still, the suspects could be tried in absentia.

    Former Prime Minister Saad Hariri, the son of the late leader, urged Hezbollah's leader to hand over the suspects and cooperate with the tribunal.

    "What the Hezbollah leadership is asked to do is simply to declare cutting links between it and the accused. This will be a historic stance that all Arabs and Lebanese will remember," he said in a statement released by his office.

    The suspects are accused of involvement in the Feb. 14, 2005, bombing that killed Hariri and 22 others — a number that includes a suicide bomber.

    The indictment reveals details of the investigation into a case that has consumed Lebanon for six years, sparked political turmoil in the country and led to fears of renewed violence.

    It says the assassins tracked Hariri's movements over several weeks to establish the routes and movements of his convoy and the location of his vehicle in it. On the day of the murder, they detonated some 2,500 kilograms (5,510 pounds) of explosives packed into a Mitsubishi van parked near a hotel on a coastal road.

    The blast killed Hariri, eight members of his convoy and 13 passers-by along with the suicide bomber, a man whose identity has not been established. It wounded 231 people.

    Prosecutors acknowledge in the indictment's preamble that they have no direct evidence linking the suspects to the attack, despite years of painstaking investigations. The file relies to a large extent on circumstantial evidence "which works logically by inference and deduction," the indictment said.

    Tribunal prosecutor Daniel Bellemare welcomed the unsealing of the indictment, saying it "answers many questions" about the attack.

    "The full story will, however, only unfold in the courtroom, where an open, public, fair and transparent trial will render a final verdict," he added.

    Saad Hariri's allies in government lauded the indictment's release.

    "We think that it will reach the facts and it will also reach justice," said legislator Mohammad Kabbani.

    The indictment that was released, which has many words and numbers blotted out in black ink, relies substantially on telephone records linking the suspects to the crime. It alleges that a "red network" of cell phones was used by members of the assassination team.

    Investigators tracked the movements of the suspects using their various phones' locations as recorded by cell phone towers, a process called "co-location" in the indictment.

    The phone records also showed a flurry of calls shortly before Hariri's assassination. The phones stopped being used two minutes before the explosion and were never used again. The indictment said the records showed "a coordinated use of these phones to carry out the assassination."

    Hezbollah leader Sheik Hassan Nasrallah has long sought to cast doubt on the security of the Lebanon's telephone network, however, and he will likely use the tribunal's evidence to further cast doubt on the court's claims. Nasrallah has called the tribunal an Israeli plot against Lebanon.

    Lebanese officials have confirmed that Israel has penetrated and has great control over Lebanon's telecommunications networks. In 2010, authorities detained two senior employees of one of the country's two cellular telecommunication companies on suspicion that they were spying for Israel. They remain in detention several months after their arrest.

    Then telecommunications minister Charbel Nahhas confirmed at a news conference held with experts in the field in November that Israel was able to infiltrate Lebanon's mobile telecommunications network and could manipulate phone calls and short messages.

    Nasrallah has repeated those claims and said Israel bugged the mobile phones of Hezbollah members, allowing it to make false phone calls and send false text messages and track the users' movements.

    Hezbollah's al-Manar television continued with regular programming for nearly two hours before reporting on the indictment being unsealed; other Lebanese media broke in immediately to report on a case.

    The indictment accuses Mustafa Badreddine, a Hezbollah commander and the suspected bomb maker who blew up the U.S. Marine barracks in Beirut in 1983, killing 241 Americans, of being the plot's mastermind.

    The other suspects are Salim Ayyash, also known as Abu Salim; Assad Sabra; and Hassan Oneissi, who changed his name to Hassan Issa.

    Prosecutors alleged Ayyash led the assassination team and the two other suspects were responsible for a false claim of responsibility intended to throw investigators off track.

    With Lebanon apparently unable to arrest the suspects, the court — unusually for an international tribunal — could try the suspects in their absence.

      If the criminal court can not catch these criminals, Saad Hariri has to take matters into his own hands and do something to avenge the killing of his father, the great and nice gentleman Rafiq Hariri. He has the money and the power. Maybe like plotting the murder of Hassan Nasrallah and his top commanders. Hezbollah are so arrogant that they think nobody can touch them or reach them.       The prosecutor's statement I find is very interesting. How are you going to have the full story unfold in a courtroom, where an open, public, fair and transparent trial will be held when the defendants are tried in absentia? Absentia means they have no opportunity to defend themselves because they have no say in little things like jury selection or trial by judge only, choice of lawyers or defense of self, evidence challenge for any number of reasons, cross examination of witnesses, procedure, you know small stuff like that. A prosecutor can get a ham sandwich indicted. Please do not misunderstand, I have no use for these people but I do quesion the motives, methods, veracity, and intentions of the ICC.

      All of the Lebanese Christian politicians against Hezbollah are being paid off by Israel just like they were during the 1975-90 civil war. These same Lebanese Christian politicians who are against Hezbollah today were Christian militia leaders during the civil war who were supported militarily and financially by Israel against the Moslems (Lebanese and Palestinian). Not much has changed. They’re still being supported by Israel and the U.S against Moslems (Hezbollah). The goal is to make Lebanon a Christian identity so they can have influence over their politics. The only way to do this is to get rid of Hezbollah.
      This has nothing to do with religion. All it is: Christian Lebanese politicians CAN BE paid off. Moslem Lebanese politicians (Hezbollah) CANNOT be paid off. If they get rid of the ones who cannot be paid off (Hezbollah)….they can control their politics. That’s all it is.
      And for those who tie Hezbollah with Syria and Iran and label them a terrorist organization. Hezbollah is Lebanon. Yes they receive support from both of those countries but they do not represent either of them at all. They represent Lebanon. The only reason for the existence of Hezbollah is to protect Lebanon. But some people don’t want Lebanon protected. That is why we have this mess.

      The Mossad, Israeli "intelligence" murdered Hariri. I use the word "intelligence" but don't know how intelligent you are to leave tracings of aerial footage taken of a man you are planning to murder for political gain. This evidence exists and has already been shown to the U.N. tribunal but has not being taken into account because the investigation is clearly being influenced by Israel and the U.S. who is also influenced by Israel just in case you've missed out on the past 100 years. Witnesses who testified against Hezbollah and Syria have said themselves their testimonies were false and were motivated by an outside party. The U.N. tribunal has recognized this and discredited any information given by them yet fingers are still being pointed at Hezbollah for some reason that I am still trying to figure out. How far sketched off does this need to appear in order for people to realize what’s going on?....really?? This is all it comes down to: Israel wants Hezbollah out and they are using this murder charge (which they are responsible for) to do this. Israel had every reason and Hezbollah had no reason to assassination Hariri.

      To the Norwegian, Egyptian, Swedish, German, Iranian and American security personnel who are having to deal with possible false flag terrorist attacks on their country, a little advice from the United States where we have already been through some of this:

      1. Follow and monitor all Israeli Mossad agents working out of their embassy and consulates
      2. Monitor any young vulnerable Islamic kids who are being approached by Mossad agents with funding or backing to promote extremism
      3. Keep a close eye on any allies of Israelis, people pretending to be Arabic, people who look Arabic, like Arabic Israelis, who are backing extremist groups in your country with as much as three to six degrees of separation behind the scenes. (Think like a champion chess player)
      4. And let the Israeli government know that you will not tolerate any terrorist attacks in your country and that there will be consequences on Israel.
      5. Do like Britain did and expel ALL MOSSAD agents from your Nation and watch the "terror" attacks and threats go way down.
      This is something the U.S. should have done long ago, but because our Congress is controlled by AIPAC, they are impotent to do anything to protect our national security at this time.
