    The Truth About Teen 'Sexting'

Teens today are constantly attending to their phones, texting and sharing with friends. But how much of what they share is sexual in nature?

Not as much as parents and others may have suspected.

"Sexting," a term that's become popular in the last 10 years, is the sending of sexually explicit messages or photographs, usually between mobile phones. Parents are worried not only how this sexually explicit content may impact children, but on the possible legal impacts of children producing what could be defined as child pornography, according to researchers. If convicted of child pornography, they may have to register as sex offenders.

"We really wanted to focus on the area of most concern, how often are kids creating images that could be child pornography, and what are kids doing when they received them," study researcher Janis Wolak, of the University of New Hampshire, told LiveScience. "Most kids are extremely responsible in their use of the Internet and cellphones … we aren't surprised to see that it's a very small group — 1 percent of kids — that are doing this."

    Defining sexting

This number is much lower than previous studies of sexting behavior, possibly because those studies have included sexually explicit text messages, or didn't determine if the images were actually sexually explicit, and may have included participants who were no longer "children," the researchers said.

A study on Cosmogirl.com, sponsored by the National Campaign to Prevent Teen and Unplanned Pregnancy found that 20 percent of teens ages 13 to 20 were sending "nude or semi-nude" images to others — these numbers are much higher because it included 18 and 19 year olds (images of whom wouldn't fall under child pornography laws)

Wolak and her colleagues, who work at the Crimes Against Children Research Center, focused on sexual image sending in children ages 10 to 18. In one of their new studies they surveyed children themselves, and in the other they interviewed police officers who had been involved in cases involving youth "sexting" photos.

    Sending sexual images

The national survey of teens involved a total of 1,560 participants. They were asked about their experiences taking, sending or receiving "nude or nearly nude" images. If they responded that they had experiences with these types of images, the researchers asked specifically if the photos involved a naked breast, genital or bottom to determine if they could be considered child pornography.

They found that about 1 percent of children in their study appeared in or created sexually explicit images. Using the definition "nude or nearly nude" the number jumped to 2.5 percent. More frequently, the youth received images from others. Almost 6 percent had received a sexually explicit image, and 7.1 percent had received a nude or nearly nude image. In all, 9.6 percent of the youth surveyed had appeared in, created or received nude or nearly nude images in the last year. The rates rise sharply as the youth enter later ages.

Only about 21 percent of the youth appearing in or creating images had a negative reaction, saying they felt "very" or "extremely upset, embarrassed or afraid." Twenty-five percent of those receiving images felt the same way.

"Most kids had neither taken pictures of themselves or received those sorts of pictures," Wolak said. She also noted that the images, when they were created and shared, didn't usually make it beyond their intended recipient. Only about 10 percent were distributed. Most, about 85 percent, never reached the Internet, and stayed within the kids' mobile phone network.

    Sexting as a crime

For the studies of criminal sexting, the researchers contacted about 2,500 police agencies, asking if they had dealt with any cases involving "youth-produced sexual images." About 532 of these agencies had dealt with sexting, a total of 1,447 cases, between 2008 and 2009. The researchers were able to do follow-up interviews detailing 675 of these cases.

They fell into three pots: About a third of the cases involved adults receiving youth-created images. Another third were strictly between youths, though these cases contained malicious actions that the researchers called "aggravated." The rest of the cases were youth-only "experimental" images that didn't seem to have any aggravating factors. In all, two-thirds of the cases involved sexually explicit images.

Arrests occurred in 62 percent of adult-involved cases (usually of the adult), in 36 percent of youth-only aggravated cases and 18 percent of youth-only experimental cases. Only 5 percent of the youth-only aggravated sexting cases involved sex-offender registration.

"In a lot of cases where kids were arrested, the cases were handled in juvenile court and the sentences involved things like community service," Wolak said. "Police seemed quite reluctant in most cases to treat kids like serious sex offenders."

Both studies were published in the December issue of the journal Pediatrics, and were performed by Wolak and her colleagues at the University of New Hampshire.

It is crazy that someone could be prosecuted and become a registered predator for receiving an image over the phone. If an underage person is taking nude pictures of themselves and sending them out that is a personal choice.STUPID , but a personal choice none the less.

Only 2 solutions: Scrap or modify the kid porn laws which protect our children or make it a crime to photograph yourself naked if you're underage. Either way is going to carry it's own set of problems.

I don't know how many times I have talked to a young friend who has just had a new daughter born into his family. The first thing out of his mouth is "I will lock her in a closet till she is twenty one. The second thing is " I will meet the boy that is her date at the door. I will be carrying a shotgun and will get his attention before they leave the house. The truth is that somewhere along the way our hope is he learns how to be a parent. Teach not demand, show good social skills, give respect and insist respect in return, teach them the correct way to eat and the value of good hygiene. All of these skills teach self respect and values. However understand that life is what it is and the day will come that she will fall in love and your only hope is that you have taught her to respect herself and her destiny.

I don't understand the passing of laws to take the place of teaching our kids the value of self respect and the education to set in motion their right to make a good choice

Nude images of non-sexual nature of children is not illegal. Plenty of naturist/nudist websites out there. Although they should be illegal

Hmmmm......Good legal question......if a minor sends a nude ("pornographic") picture of themselves to an adult, is that adult guilty of child porography if they did not solicit the photo?
      • Michael 5 mths ago
If they maintain possession of it, then yes. Just as receipt of stolen goods is a crime, whether you knew they were stolen or not, receipt of illegal pics should also be a crime if you keep the pics.

Short answer: No. Common sense says no. But in the U.S. we over react. If we would stop, slow-down and think things through we would be much better off. When the media gets involved it's all downhill!

Yes, under our currently insane system, that is about 4 years in prison for the adult. The Teen is free to continue sexting and often does.

Look, in spite of what ever nonsense these kids told the researchers,(and having raised 11 kids, of whom 7 were girls, I can guarantee that it was nonsense) teens do as they please. If your daughter wants to send her current boyfriend a naked photo of her butt or the whole body, she will! Get a life and get over your crazy puritan, anti sex hysteria. All of my girls did so at one time or another, in spite of being talked to death about why its a dumb idea to do so. I considered it marvelous that seven girls made it to graduation without getting pregnant or raped! Count the real blessings and stop driving yourself crazy with media generated nonsense.

Through out history sex has been a part of life. Each generation deals with it the same way. If you are responsible you will make good choices if not those are usually not so good. Parents have had concerns with each new generation. They try to figure out the best way to keep their children safe. It is said that you have 9 years to set the values of life for your kids. Some parents succeed some don't however the ones that do succeed most often seem to have respect for their children and teach self respect to their children and are not quiet so dominating. Sex is not a choice. The body is designed to participate in sex. The chemistry is put in place by design. The choice of when and who and why is the choice of the participant and that reason needs to be thought about. I was once asked by a young female employee a question. "When is it alright to have sex" My response was " when you are positive that you no longer have to ask that question".

We need to get over our society's pre-occupation with this topic. People have been having sex as long as there have been people. Your parents had sex... at least once. Kids have always experimented with sex, from a very early age... it's normal. What's un-natural is our obsession that it's somehow a bad thing.

Why are Americans so concerned about teen sex or sex in general? They and the Muslim countries seem hell bent on setting the world straight. Teen pregnancy is the lowest it has been since records have been kept. That means less teen pregnancies today than when your parents were teenagers. Concentrate on getting them educated and then trained for work so they can support themselves as adults. They will find out about sex irrespective of what you do or do not do.

Actually, the courts have already ruled that pictures of nude children are not considered child pornography. There must be something more involved, so that the photo cannot be considered artistic in nature or a showing of nudist family life or something like that.

If you tell a kid that sending an image of nude or near nude pictures over their phone could be considered child pornography and then ask them if they've ever done that, the majority of them will answer no. Want to see real data? Check out their facebook albums and see how many of them post risque photos of themselves and/or their friends. Then ask them about the circumstance and intent of those photos. You might learn that they are just like many of us were at their age, there are just more OF them than there were, therefore the appearance of things is different.

If it is not such a problem then why all the media hype? The more hype , the more kids are going to try it to see if they can get away with it.I think sometimes we create our problems. Why is everyone so preoccupide with sex anyway.Havn't we learned something from aids?

First off, they asked children as young as 10 years old. This appears to me to be a method to lower the percentage of the overall group considerating there are vast differences between 10 and 17 year olds. Second, these are all minors, therefore legally the parents would have to be notified of their childs participation (in theory) and could possibly have (should have) access to their childs responses; the children are well aware of this. Also it stated that when the wording of the image description was modified the percentage jumped substantially; and the modified desription was vaguely worded to a 'nearly nude', which is dynamically interpreted by the respondants.

The truth that these reports seem to forget is that Teens are thinking about sex and that is normal. Maybe these reporters lived very sheltered lifes or they just chose to pretend that there was no sexual talk or experimentation when they were kids. Movies dating back to the late 50's will tell the lie to the idea that teens are sexually unaware until the reach 18. The writers for those movies based what they wrote on things they remembered from High school. At the same time we also know that the number of teens actually engaging in sex is lower then what those same movie depict because they tend to form around a small group and point out how hard it is for them to "go all the way". We need to stop being shocked that our kids think about sex and start talking about it to them and making sure they are ready for it and have whatever protection they can get. When it comes to images being sent via cell phones or the internet we need to remind them that once something is on the internet it is pretty much there forever and that it could turn up when the least would like it to show up. We do not need to prosecute them as sex offenders unless they are forcing someone or dealing with kids who are not in their age peer group capable of making the same decisions on their own.

Interesting that multiple studies done over the last few years all put the number at around 20% of teens who admitted to sexting but this article suddenly drops that number like a rock. So I guess what this study really shows that is if you ask the right people the right questions you can get...well, almost any answer. And THAT is the problem with "surveys".

Teens are naturally curious and experimental, but when they look up to people like Kim Kardashian, this is expected behavior. Parents try to keep them from the video camera.
