    Twitter stalking is protected free speech, judge rules

    A San Francisco judge has declared cyberstalking on Twitter and blogs constitutionally-protected free speech, reports The New York Times. The ruling is a victory for the First Amendment. But like all things worth fighting for, it comes at a price.

    Here’s what happened: A Buddhist religious leader in Maryland named Alyce Zeoli became friends with a man named William Lawrence Cassidy. At some point, the two had a falling out. Cassidy took the mature route, and began posting thousands of messages on blogs and Twitter, often using pseudonyms, that aggressively disparaged Zeoli. Some of them even called for her death.

    Understandably distraught, Zeoli then worked with the FBI to have Cassidy arrested, which he was, based on interstate stalking laws. Cassidy, the government argued, had caused Zeoli “substantial emotional distress.”

    This, however, was not enough to convince Judge Roger W. Titus, who declared that Cassidy’s actions, while distasteful, were not enough to set a precedent that could cause serious harm to the entire foundations of speech on the Internet.

    “[W]hile Mr. Cassidy’s speech may have inflicted substantial emotional distress, the government’s indictment here is directed squarely at protected speech: anonymous, uncomfortable Internet speech addressing religious matters,” wrote Judge Titus, in his official order.

    Titus ruled that, because no one was forced to read Cassidy’s posts and tweets — as opposed to a “telephone call, letter or email specifically addressed to and directed at another person” — they are considered free speech, not harassment, just as personal bulletin boards of the colonial era fell under the protection of the First Amendment, which “protects speech even when the subject or the manner of expression is uncomfortable and challenges conventional religious beliefs, political attitudes or standards of good taste.”

    One of Zeoli’s lawyers, Shanlon Wu, told the Times that Zeoli was “appalled and frightened by the judge’s ruling.” It is not yet clear whether there will be an appeal to the ruling.

      Titus ruled that, because no one was forced to read Cassidy’s posts and tweets — as opposed to a “telephone call, letter or email specifically addressed to and directed at another person” — they are considered free speech, not harassment, just as personal bulletin boards of the colonial era fell under the protection of the First Amendment, which “protects speech even when the subject or the manner of expression is uncomfortable and challenges conventional religious beliefs, political attitudes or standards of good taste.”

      And since none of us have been provided enough details to really judge this incident, I think the judge took the correct route.

      I also think this is more an indictment of the social media mentality than that of the judge.

      If a person makes a threat, AND has the ability to carry out that threat they have committed assault. Of course this article does not give the details of how Mr. Cassidy called for Ms. Zeoli's death, but I'm sure if this type of statement were made against the judge it would be considered terroristic.

        I agree. The problem here seems to be that the stalking charge was deemed inappropriate. Maybe if the offender had been charged differently... If someone can be charged for verbal threats, then the same should apply to Twitter threats. Not sure if this is how the laws are written though.

      Ah, the classic "Slippery Slope" dilemma. The biggest "problem" with the law is that it can't always coincide with right or wrong. The simple fact is, if this ruling went the opposite way, we'd end up having to shut down Twitter, Facebook and all the other online "social" sites. To put it in a way that might make it easier to understand, if the judge ruled against the speech, everyone online who said Cassie Anthony was a murderer or accused Joe Paterno of aiding in child molestation could be guilty of an illegal act.

      For the record, though, I believe that William Lawrence Cassidy should be held accountable for liable or slander (whichever one can best be fitted to online speech) and is definitely guilty in a civil action.

        If she sues him for libel per se, she does not have to prove monetary damage; the damage is assumed. If he said anything about her committing a crime, her performing immoral acts (such as being a prostitute), her being unable to perform her profession, having some type of "loathsome communicable disease" or her being dishonest in her business, she would have a case for libel per se.

      Without the details of the posts (content, context, frequency) it is difficult to evaluate this decision. Until the problem with the media (under reporting of facts) is resolved there really isn't enough information in this article to know whether the postings were of a nature or great enough in number to constitute stalking.

      Stalking is neither to take a single step in the direction of nor to follow to a common destination. It is to pursue with malice and in a manner that causes the pursued to feel set upon or worse. And news is not spattering a few words on a page with half the story.
