    US hospital must return $500K to Garth Brooks

    CLAREMORE, Oklahoma (AP) — An Oklahoma hospital in Garth Brooks' hometown must return a $500,000 donation to the country singer because it failed to build a women's health center in honor of his late mother, jurors ruled Tuesday evening.

    Jurors also awarded punitive damages in Brooks' breach-of-contract lawsuit against IntegrisCanadian Valley Regional Hospital in Yukon. Brooks said he thought he'd reached a deal in 2005 with the hospital's president, James Moore, but sued after learning the hospital wanted to use the money for other construction projects.

    The hospital argued that Brooks gave it unrestricted access to the money and only later asked that it build a women's center and name it after his mother, Colleen Brooks, who died of cancer in 1999.

    Brooks left the courtroom shortly after the verdict was read. Jurors were expected to announce how much money he would be awarded in punitive damages later Tuesday evening.

    "Obviously we are disappointed, particularly with the jury's decision to award damages above and beyond the $500,000," Integris spokesman Hardy Watkins said. "We're just glad to see the case come to a resolution."

    During the trial, Brooks testified that he thought he had a solid agreement with Moore. Brooks said the hospital president initially suggested putting his mother's name on an intensive care unit, and when Brooks said that wouldn't fit her image, Moore suggested a women's health center.

    "I jumped all over it," Brooks told jurors in tearful testimony. "It's my mom. My mom was pregnant as a teenager. She had a rough start. She wanted to help every kid out there."

    His attorney told the jury during closing arguments that Brooks kept his end of the agreement.

    "This case is about promises: promises made and promises broken," lawyer John Hickey told jurors shortly before they started deliberating. "Mr. Brooks kept his promise. Integris never intended to keep their promise and never built a new women's center."

    But hospital attorney Terry Thomas said Brooks' gift initially came in anonymously and unrestricted in 2005. He also noted that Brooks couldn't remember key details of negotiations with the hospital's president — including what he'd been promised — when questioned during a deposition after filing his lawsuit in 2009.

    "At most, it was a misunderstanding between these two," Thomas told jurors during his closing argument. "Am I calling Mr. Brooks a liar? Absolutely not. It's perfectly understandable that he does not remember these events."

    The jury began deliberating Tuesday afternoon in Rogers County District Court, and the judge told jurors she wanted them to work as late as midnight to come to a decision.

    Before the verdict was read, Brooks said the day had been emotional. The country music star said he was simply trying to honor his mother.

      @ZenRules - Don't worry about the medical center - medicine is a $1Trillion a year business. Gone are the days when hospitals were built by charities to provide necessary life-saving services to communities. Nowadays the top 50 grossing hospitals in the US make at least $2.9 billion, with the top-grossing hospital being the University of Pittsburgh Medical Center Presbyterian, which makes $9.8 billion a year. Integris is the largest hospital system in Oklahoma. $500,000 is a drop in the bucket to them. Their CEO probably makes that much in bonuses. They don't need (or deserve) donations any more than a bank or Wal-Mart does. If they took his donation on the condition that it would be used to build a women's center, and didn't build it, they committed fraud and should have to return it. It doesn't matter that Garth Brooks is wealthy - he earned his money fairly and has the right to it.

      As someone who lost her mother to cancer, I say, "way to go Garth". He wanted to honor his mother and was trying to do the charitable thing! The hospital took advantage and didn't think his $500,000 would be missed since he has so much anyway! Well shame on that hospital for not honoring his wish and taking the money!

      Having moved to the Tulsa OK area from out of state and never having met the man myself, I know a few who have and they have all said that he is the most giving person and the best respresentative of Oklahoma there could be. His donation wasnt to cover the entire project but rather it served as a catapult to get other people on board to get the funding to get it built. His gives alot to local communities and to the State but never takes the credit for it. In this case, since it was based upon his own mother- the donation couldnt go unrecognized. He gives of himself and financially to many different things. He stood outside the courtroom last night until nearly 9pm they said because fans showed up for a photo/autograph and he felt that they took the time to come see him- the least he could do was to recognize their contribution to his life. Not many stars would do that these days.

        That's quite enough. You do not understand that the money Garth donated to this hospital was not spent which meant they didn't do what they had promised him. He got his money back and suddenly he's a bad guy because he don't take that kind of thng. I agree with him and Trisha building the center but it is not as simple as all that.

      ok I see that Garth is not very well liked here. But a regular Jo, yes with 500k to spare, he would have got alot more sympathy, the Hospital were wrong in not doing what he gave the money for. BUT we did not see or hear the agreement that was made...

        Ok now stop that. If I was in Garth's situation I would have done the very same thing myself. If the hospital didn't do what they promised Garth they'd do then the money should go back to Garth. It isn't him getting richer; it's him getting the money he lost out on when the hospital decided they weren't going to do what they told him they'd do.

        You are a loose screw..zenrules. He did donated $ for a medical center for women and they tried to misuse his donation. that is called embezzlement and diverting of ear marked funds. It was a *conditional* donation. Good for him!
