    US redefines rape to count more people as victims

    WASHINGTON (AP) — The Obama administration says it is expanding the FBI's more than eight-decade-old definition of rape to reflect a better understanding of the crime and to broaden protections.

    The new definition counts men as victims for the first time and drops the requirement that victims must have physically resisted their attackers.

    Vice President Joe Biden, author of the Violence Against Women Act when he was in the Senate, said the new definition announced Friday is a victory for women and men "whose suffering has gone unaccounted for over 80 years." Calling rape a "devastating crime," the vice president said, "We can't solve it unless we know the full extent of it."

    The change will increase the number of people counted as rape victims in FBI statistics but will not change federal or state laws or alter charges or prosecutions. It's an important shift because lawmakers and policymakers use crime statistics to allocate money and other resources for prevention and victim assistance.

    The White House said the expanded definition has been long awaited as many states and research groups made similar changes in their definitions of rape over recent decades.

    Since 1929, the FBI has defined rape as the carnal knowledge of a female, forcibly and against her will. The revised definition covers any gender of victim or attacker and includes instances in which the victim is incapable of giving consent because of the influence of drugs or alcohol or because of age. Physical resistance is not required. The Justice Department said the new definition mirrors the majority of state rape statutes now on the books.

    Congress approved $592 million this year to address violence against women, including sexual assault, domestic violence, dating violence and stalking, under the Violence Against Women Act and Family Violence Prevention and Services Act. Of that amount, $23 million goes to a sexual assault services program and $39 million to a rape prevention and education program administered by the Centers for Disease Control and Prevention. The Obama administration had sought $777 million to combat violence against women.

    The change likely will result in big increases in the number of reported rapes, but it was not immediately clear how big. To take just one example of how the FBI totals will change, Chicago didn't report any rapes to the FBI for 2010 because its broad definition of the crime didn't match the FBI's narrow definition.

    The change has been sought by women's groups for more than a decade.

    The Women's Law Project, on behalf of more than 80 sexual assault coalitions and national organizations concerned about violence against women, wrote FBI Director Robert Mueller in 2001 that the narrow definition reflected gender-based stereotypes and requested it be changed.

    Using the old definition, a total of 84,767 rapes were reported nationwide in 2010, according to the FBI's uniform crime report based on data from 18,000 law enforcement agencies.

    Nearly 1 in 5 women and 1 in 71 men in the U.S. have been raped at some time in their lives, according to a 2010 survey by the National Center for Injury Prevention and Control of the Centers for Disease Control and Prevention, which used a broader definition.

    The revised FBI definition says that rape is "the penetration, no matter how slight, of the vagina or anus with any body part or object," without the consent of the victim. Also constituting rape under the new definition is "oral penetration by a sex organ of another person" without consent.

        In San Diego: a teacher was doing a 16 yo student who reported it. When the court process began, another student with whom he was busy shows up; both girls meet and appeared in court declaring no hard feelings (no pun intended). Each stood up for the guy declaring their love and their wish that the court would find him not guilty and cut him loose. He's doing 4 years and the girls write to him regularly and have become good friends. Point here is that both girls proclaimed he had a relationship with him but wanted to withdraw their complaint. The DA nailed him anyway.

        This decision just effects what the govt counts in their rape statistics. Before, if someone was convicted of rape because they drugged someone and rook advantage of them, it wouldn't be counted in the statistics, now it is, that's the only thing this changes. A court still has to decide that a rape was actually committed.

        But here i'll give you and idea of how the courts decide what is rape. If one person purposefully and without the other person's knowledge gave them something intoxicating (like slipping ruffies in their drink) then they are responsible. Or if one person was unconscious and the other person took advantage of them while they were passed out, then that's rape. But if two drunk people both decide to have sex then no one was raped.

        If one is male, and the other female, the male will be given the rapist label. Not that different from the male always being removed from the home after a domestic dispute, regardless of if he was the one being attacked.

      a married woman i know, had once told me she was raped by her father's friend when she was 12.
      and when i asked if she reported it or not, she said no.
      before marriage, she was out with guys, any guy, pick them up at bars, and just have meaningless sex with them and find another one next day. she did that for years, until she finally settled down and got married.

      First of all, no one except misandric sexists says "women and men". Secondly, Joe Biden was not the author. Catherine MacKinnon was. And it was ruled unconstitutional by the Supreme Court and subsequently 'tweaked' by NOW before being passed without anyone reading it, just like the first time it passed, by unanimous vote in the Senate. Since that second vote, individual sections have been found unconstitutional once again, and yet those who swore an oath to uphold the Constitution seem to feel no guilt whatever in having voted in favor of something so rife with unconstitutional mandates.

      "The revised definition covers any gender of victim or attacker" - Wrong, it does not cover 'gender' but biological sex. The two are not the same.

      "Congress approved $592 million this year to address violence against women" even though the vast majority of all violence, including sexual violence, targets males and yet less funding and resources are devoted to combating that. The Violence Against Women Act is primarily used to hire defense lawyers for women who kill their husbands, boyfriends, brothers, etc, and then claim to be "the real victim" in order to qualify for free 'dream team' legal defense from the best in the nation. This is why so many female murderers are getting away with it when the evidence shows they are overwhelmingly guilty. Congrats to you, Joe Biden. You did this. And to you, Orrin Hatch, who cosponored it also without reading it. You are both responsible for so many murderers going free.

      "Nearly 1 in 5 women ... have been raped" - this has been disproven over and over and over again by numerous researchers and discredited as an outrageous lie, and yet here it is again in the Press stated as a fact. Everyone knows it is a lie, it has been investigated and shown to be a willful lie created by feminists, and yet like the Nazis during WWII they just keep on repeating the lies until the shere repitition of it overcomes the truth and erases all opposition to the glorious woman-as-martyr fantasy. Even several non-marxist feminists researched and discredited this claim. You can find some of them talking about it on YouTube.
