    US won't help Alabama apply harsh immigration law

    WASHINGTON (AP) — The government has not offered to help Alabama put in place a strict immigration law that the Obama administration is challenging in court, Homeland Security Secretary Janet Napolitano said Wednesday.

    The administration has sued to block the law, considered the toughest state immigration controls in the country.

    "We have been working with the Department of Justice in its challenge to that law," Napolitano told the Judiciary Committee of the House of Representatives.

    A federal appeals court in Atlanta, Georgia, temporarily blocked a part of the law this month that required public schools to check the immigration status of students. The court did not bar law enforcement officials from detaining people suspected of being in the country illegally.

    A final ruling in the case is not expected for several months.

    Alabama Republicans have argued that the law, passed this year by the Republican-controlled Legislature and signed by Gov. Robert Bentley, was necessary to protect the jobs of legal residents.

    Alabama House Speaker Mike Hubbard, a Republican, said he is not surprised by Napolitano's comments.

    "I suppose we shouldn't be surprised that the federal government won't help us enforce our laws considering it hasn't been enforcing its own law for years. That's why we're in this mess to begin with. In Alabama, we're trying to turn off the magnet drawing illegal aliens across the border. The Obama Administration is trying to make the magnet stronger," said Hubbard.

    The Obama administration, which is challenging a similar law in Arizona, has argued that enforcing immigration law is a federal responsibility.

    Opponents to the strict state law have argued that giving immigration enforcement power to local authorities would lead to racial profiling of immigrants, both legal and illegal.

    "Commonsense law enforcement is about prioritizing resources," said Ali Noorani, executive director of the National Immigration Forum. "The Department of Homeland Security should work with the Department of Justice to hold Alabama accountable, and prioritize valuable enforcement resources carefully to make sure the most dangerous individuals are detained and deported."

    Napolitano said that while it is too soon to know what impact the new law will have, such worries "should be a real concern."

    Similar laws have been passed in Utah, Georgia, South Carolina and Indiana. Civil rights groups have sued to block them.

      just payed HLS $1100 to reexamine my wife immigration papers that US State Department just checked, taking them 5 months before my wife can get her green card so she can leave the country to get our kids. You try to do the right thing, and the gov. wants to just let the illegal in and let them stay because there are so many here now, because they did not do there job. Spent $40,000 in 4 years to get my wife and 2 little girls over here, should have walked them across the border. HLS does not try to not catch anybody, How long before the big T smuggles a atom bomb over the border with the help of the drug cartels or in a load of illegal immigrants.

        Allowing illegal aliens to break the law with no consequences is a slap in the face and a travesty to all legal immigrants. I have legal immigrants, one who is Mexican, in my family so I understand what you went through.

This clearly is not happening on Obama's watch, which is why states are choosing to pickup the ball and do something about it. The federal government has shown absolute dereliction of duty when it comes to ILLEGAL immigration.

        Plyler v. Doe (1982)
        In Plyler v. Doe, the Supreme Court struck down a Texas law prohibiting enrollment of illegal aliens in public school. In its decision, the Court held, "The illegal aliens who are plaintiffs in these cases challenging the statute may claim the benefit of the Equal Protection Clause, which provides that no State shall 'deny to any person within its jurisdiction the equal protection of the laws.' Whatever his status under the immigration laws, an alien is a 'person' in any ordinary sense of that term… The undocumented status of these children vel non does not establish a sufficient rational basis for denying them benefits that the State affords other residents."

      Horse #$%$ Time for politicians to get real. Wanna stop illegal immigration and have it not cost anything. Pass a law that treats employers like drug dealers. Any employer knowingly hiring illegals is prosecuted and all their assets confiscated, sold at auction, with the funds going back to support future prosecutions.Illegals will leave the USofA voluntarily without costs to the taxpayers and those coming across the border will slow down to a trickle so the border patrols can be reduced and still do a better job than currently.

      dereliction of duties. What would happen in a police officer stated he would not enforce traffic laws any longer, he would be fired. If you dont like or agree with laws then try to change them but it is unacceptable to ignore them.

        @Spinning Left: That's not the only jobs they steal, stupid. I work in a facility that pays good money but is laying off people left and right, and the majority of the workforce is hispanic, stupid. There was a story about Alabama farmers #$%$ about illegals fleeing the state of Alabama, so they had a program to hire laid off legal citizens. Only a handful of farmers took advantage of it, so Big Media, again, is lying about the situation, you lemming as*hole.

      If Republicans really wanted to do somthing about illegal immigration they would prosecute those who create jobs for them. Prosecuting the people who are there to work the jobs afforded to them is a waste of time, because like any other supply and demand industry, as long as there is a demand, there will be a supply.

      How About Some Common Sense Laws, kids born in US hospitals are not US citizens, unless one of the parents is a US citizens. You do not have to speak Spanish to get a job, but you do have to speak English. You are illegal and get caught, 4 months hard labor building a wall across the southern border, after tour term they put you on the other side of the wall.

      They keep telling us our country is broke but us taxpayers have to keep paying oblunders lawyers to sue states for trying to do the job that the feds are paid to do but would rather sit and watch the illegals pour over the border. Why do we even have an I.C.E. agency collecting salaries for doing nothing. Just one of many of oblunders blunders.

      "The Obama administration has argued that enforcing immigration law is a federal responsibility" It is a downright shame that they always include this statement in every article but somehow you never see the Federal Government taking their stated responsibility seriously. How can it be a federal crime to cross the border without proper documentation but somehow they are not considered criminals unless they commit a "real" crime. If the law is going to not prosecute them for committing non-serious crimes because they are illegal how is it not discrimination for them to prosecute American Citizens, natural or immigrant, of ANY non-serious crimes. Take a look at the Uniform Crime Report and look at the LONG list of "non-serious" crimes and compare those with the "non-serious" crime of crossing the border without proper documentation.
