    Woman says Owens fails to pay some child support

    ATLANTA (AP) — The mother of Terrell Owens' child says the NFL star has refused to pay the full $5,000 a month in child support he owes.

    Melanie Paige Smith filed court papers June 20 in an Atlanta court seeking to hold the player in contempt.

    Owens "has failed and refused to pay the full amount of child support for June 2011," Atlanta attorney Randall Kessler wrote in court records. Owens' financial advisers have informed Smith that he's decided to no longer pay the full amount, Kessler added.

    Kessler said Wednesday that Smith doesn't have any ill will toward Owens.

    "She simply asks that he follow the order to which he agreed," he said. "Rather than discussing his situation with her or her lawyers first, he simply cut his child support."

    Owens' agent, Drew Rosenhaus, did not immediately return messages Wednesday seeking comment.

    Owens, a free agent, is recovering from knee surgery and can't sign with a team until the NFL lockout is resolved.

    The athlete is a resident of Fulton County, which encompasses most of Atlanta and several suburbs, Smith's attorneys say. The case was filed in Fulton County Superior Court.

    Smith says she's had to pay attorney fees and costs to enforce the court's May 2007 child support order, and she's asking for a judge to order Owens to pay those, as well.

    Kessler said he's looking forward to hearing from Owens or his representatives and working out an agreement quickly.

      there is no way it takes $5,000 a month to support a child, I hope the judge has ordered her to open a trust fund for the child so the excess of monthly support goes to him/her when they reach adulthood, after all it isn't supposed to support her.

      Guys please read the sentence where he has refused to pay the entire month of support for JUNE 2011. The end of June is not even here yet!!! I am a child support caseworker, and I am here to tell you that her attorney is doing nothing but taking her money!!! The judge will not consider that he is in contempt of court until his child support arrearages equal to one month of support. THAT IS CASE LAW!!! Her attorney knows this, but he is preying on her ignorance of the law.

        Won't act until one month in arrears - really. My ex owes over $20k and admits that he has no intentions of paying yet all I ever here from the case worker is "There's nothing we can do"?!

        Well, it was due June 1, it's now June 30, so it is one month in arrears. And he sure can't plead financial hardship just because he blew out his ACL, he's probably made $100,000,000 over his carreer.

      This misguided idea that "child support" goes to the "child" is only a myth. It goes to the "female parent" to spend any way she wants. There is no relationship to the costs of raising a child, just strictly wealth transfer from the man to the woman. If it was about the child, the parents would have "joint custody" with no "wealth transfer" to be had.

        First of all child support isn't meant as an allowance to the child. It is meant to help the parent who SUPPORTS the child the majority of the time. You can't give a 2 year old cash or even a 10 year old and expect them to use it to help support themselves. And second of all, it's not always "wealth transfer from the man to the woman". My boyfriend has full custody of his 2 children because his ex wife is a no good dead beat mother who refuses to hold a job, not because she can't because she won't. We pay over $800 a month just in daycare, not to mention the costs of clothes, food, school supplies... everyday living costs. He works full time, I work and I'm a full time student and these kids have everything they NEED. But it would be nice to have some SUPPORT from their mother so we don't have to stress about money. I'm not saying we are the majority or that some women don't abuse the system but don't stigmatize the entire child support system as that. If you bring a child into this world you need to support it, period. And depending on how much money you make, that changes the scale of support you owe the parent that is fully SUPPORTING that child you help create.

The state of TN requires divorcing parents to report certain costs pertaining to care of the child (insurance premiums, childcare, etc) along with salary and how many days per year the child is with each parent. I can't say all divorced mothers are responsible with their child support payments, but a portion of mine goes directly to my child's savings account for college. That money is used to put a reasonable (not extravagant) roof over my child's head and food on the table. I resent the implication that all divorced mothers are just looking for "wealth transfer" with no regard to care of the child.

        It is ridiculous, but that is what he agreed to pay. Nice that the mom makes more than me and doesn't need to leave the home. I wonder how many more retirement plan babies she has tried to manufacture? I really wish they would make the child support recipients keep records of what they spend the money on.

      I wonder how much she uses of that $5000 for her kid? My guess, less than $500 a month. The kid should sue its Mom for theft of money rightfully his or hers.

      wait..wut? When did she file or contact an attorney? June 2nd at 00:01 a.m.? I'm not even close to a fan of TO, but when he's MORE than a month behind, THEN break out the legal eagles. Sheesh-if one ever needed proof of "gold digging" this woman has provided it. Think that kid gets brand new clothes every month? College tuition set aside by mommy? I doubt it highly. Problem is, the Media would've torn TO as new one if he'd been caught with a prostitute, but tears him one for not paying this one on time.

      no you don't have to be employed. if you don't pay they can arrest you and jail you. if you get behind, even if you are paying some, they can and will take your drivers license. child support enforcement is like the irs. don't mess with them. like meter maids, they eat their young. ps. all mine is paid off. 9+ years to a woman who lied to get me to marry her, then was unfaithful. i even had my two children for much of the time. i paid for costs of moving, storage, and almost double the amount set by the court for support, BEFORE the order, so she could go to school and get employment skill. i got NO CREDIT FOR ANY OF THAT. my child support was figured back before we were even separated. there is no justice in child support. only forced collection. they are hateful people.

      It sounds like the first step in challenging the allowance based on his diminished income. He hasn't worked for four months due to the lockout and he may never play in the NFL again due to his injury. Maybe Mama should have saved and invested some of the quarter million dollars he paid her over the last four years instead of blowing it on cars and clothing.

      a lot of you are bashing the mother saying she needs to go get a job and so on and so forth, yet nowhere in this article does it say she doesn't work, people assume way too much. and those of you complaining about the $ amount, he agreed to it in the first place, so that's on him.he could have easily gone to court and asked for it to be reduced, but you can't just stop paying it on your own, that is just gonna get him in trouble for violating a court order
