DA says tweet, travel records show Giuliani capable of appearing before grand jury

Rudy Giuliani is fighting to delay testifying before a special purpose grand jury in Fulton County that’s investigating wrongdoing during the 2020 election.

Giuliani was ordered by a New York judge to testify on Aug. 9 after earlier being issued a subpoena by the Fulton County grand jury.

But Giuliani’s attorney claims in a motion filed with the court that he is too unwell after a recent surgery to travel by air.

A Fulton County Superior Court judge will hear that motion to delay Tuesday.

In its filing, the Fulton County district attorney’s office says Giuliani’s own social media posts show him traveling.

Exhibit A in the DA’s motion is a Giuliani tweet from Aug. 1 from New Hampshire.

The DA’s office also claims that Giuliani purchased multiple plane tickets after his surgery for travel in late July, including international flights to Italy and Switzerland.

Giuliani’s attorney counters that he is willing to testify by Zoom or testify later.

Writing in the motion to delay, “Mr. Giuliani is in no way seeking to inappropriately delay or obstruct these proceedings or avoid giving evidence or testimony.”

As former President Donald Trump’s personal attorney, Giuliani is one of several Trump confidants subpoenaed to testify.

Channel 2 investigative reporter Justin Gray asked Fulton County District Attorney Fani Willis if she expected to see Giuliani testifying as scheduled.

“We expect to see all the witnesses that are relevant to that investigation. Things are moving in a very good process. We’re right on track where I expected to be at this time,” Willis told Gray.

Channel 2 Action News was there in 2020 when Giuliana spent several hours speaking before state lawmakers and spreading false narratives and conspiracy theories about the “secret suitcases” and “corrupt” voting machines.

The grand jury subpoenaed Giuliani at the same time it subpoenaed U.S. Sen. Lindsey Graham and others who were at a December 2020 state Senate subcommittee hearing.

If flying to Atlanta is the issue, the DA’s motion says they would arrange for bus or train fare for Giuliani to travel form New York.
