AG Weiser on proposed Kroger-Albertson’s merger

GRAND JUNCTION, Colo. (KREX) — Colorado Attorney General Phil Weiser has filed a lawsuit against the proposed merger between grocery chains Kroger and Albertson’s.

The lawsuit to block the $24.6 billion merger was filed Feb.14, 2024.

According to the lawsuit, the merger would eliminate head-to-head competition between Kroger and Albertson’s, giving the grocer the chance to unfairly raise prices.

The attorney general’s office first started the investigation when the proposed merger was first announced in the fall of 2022. Since then, the AG has held 19 different town halls across the state to give Coloradans a chance to weigh in.

AG Weiser says Coloradans already struggling would be hurt even more if this merger goes through.

“Coloradans are concerned about already high prices for eggs, for milk (and) other items at the grocery store,” says Weiser. “These two companies merge; they can raise prices. They can cut customer service. They can provide less variety. We don’t want that to happen.”

The timing as to how long this case could go on is unclear, but the AG says he will continue working on it until the courts are convinced this merger is illegal and needs to be stopped.
