Alamogordo man guilty of producing child pornography, faces up to 30 years in prison

Jason Ross-Lattion Fleming, 36, pleaded guilty April 7 to charges of production of a visual depiction of a minor engaging in sexual activity and providing child pornography to a minor, according to court documents.

Fleming was a firefighter employed by the City of Alamogordo at the time of the offenses, but was since terminated from the position.

According to court documents, from Feb. 1, 2012 until Dec. 1, 2013 Fleming persuaded a minor to engage in sexually explicit activity, and recorded the acts with photographs and video on his cellphone.

Fleming was babysitting a 9-year-old who he engaged in sexual contact with from January 2021 until March 2021. According to case records, Fleming exposed himself to the child and showed her pornographic material.

New Mexico State Police (NMSP) executed a search warrant on Dec. 9, 2021 and seized two cellphones from Fleming. Homeland Security Investigations then obtained a federal warrant to go through the contents of the phones on April 18 and found child pornography on his personal cellphone.

Fleming faces a minimum of five years and up to 20 years in prison for providing child pornography to a minor and up to 30 years for the production of a visual depiction of a minor engaging in sexual activity.

He remains in custody pending sentencing which has yet to be scheduled. After his time in prison, Fleming will be under five years of supervised release and is obligated to register as a sex offender.
