'Making A Murderer': Steven Avery's Lawyer Is About To File Papers That Could Change Everything

Staunch defenders of Steven Avery, the man convicted of the 2005 murder of Teresa Halbach and whose trial was made famous by Making A Murderer, will be given a big boost this week when his lawyer Kathleen Zellner files a huge document aimed at securing Avery's release.

The filing of the appellate brief will come on 20 December, and it is massive. "We’ve got a record that’s 22,000 pages," Zellner told OK!. The appellate brief is a document which outlines all the reasons Avery should win his appeal, with the aim of persuading judges that there's enough evidence to overturn the decision of the Sheboygan County Circuit Court not to overturn Avery's conviction.

"The higher court is going to review all of this new evidence," Zellner said. "After we file, the state will file their response, and then the court will have an oral argument, and then they’ll make a decision. Whatever decision they make, it’s going to go to the Wisconsin Supreme Court. So even if we win, the state will still force it to be decided by the highest court in Wisconsin."

Zellner, who's one of the most successful appeal lawyers in America and was introduced in Making A Murderer's second season, also says she has enough evidence to convince judges that a third party was involved in Halbach's death, which would clear Avery and his nephew Brendan Dassey.

"My goal is to not just to find the constitutional violation to get Steven Avery a new trial, because many people are convicted again in their second trial," Zellner said. "I am trying to get the evidence to what I believe is the truth of what happened, so that there won’t be another trial."
