Second arrest made in University of New Mexico shooting involving NMSU basketball player

According to an arrest affidavit, New Mexico State Police have arrested 19-year-old Jonathan Smith in connection to the deadly shooting on the University of New Mexico campus Saturday that left Brandon Travis deceased and New Mexico State basketball player Mike Peake in an Albuquerque hospital with a gunshot to his leg.

Smith was charged with aggravated battery (third-degree felony), conspiracy to commit a felony, and two counts of tampering with evidence (fourth-degree felonies).

On Sunday, State Police revealed that UNM student Brandon Travis was shot and pronounced dead at the scene and that Peake had been hospitalized. Police said Travis had conspired with a 17-year-old girl to lure Peake to campus as the Aggies were slated to play New Mexico on Saturday night. Travis and the girl conspired to lure Peake to the UNM campus and "jump" him as retribution for a fight that involved Peake, Travis, Smith and an individual identified as 'Eli', during last month's UNM/NM State football game at Aggie Memorial Stadium on Oct. 15.

According to the affidavit, Peake was seen on surveillance video walking with a female outside of Coronado Hall when three individuals approached Peake and Travis pointed a gun at Peake while two individuals were behind Peake. Eli hit the basketball player on his right leg with a baseball bat from behind. Peake began to run as the gun was fired at Peake "several times." The affidavit states that Peake pulled a firearm from his waist and fired back, hitting the gunman, Travis, who was pronounced dead at the scene and Peake was transported to University of New Mexico Hospital.

In interviews with police, the girl said she had been in contact with Peake for a while and had planned to meet Peake to have sex. The girl was friends with Travis, who, upon learning she was in contact with Peake, told the girl to set Peake up so his friends could jump him and she agreed. Travis wanted to jump Peake because, "Peake and his friends had beat him up badly at the UNM vs. NMSU homecoming (football) game in Las Cruces, New Mexico."

Peake told police he took an Uber to the UNM campus around 3 a.m.

Smith told police that he knew Travis had a gun but did not know he planned to bring the gun. Smith said they dialed 911 following the shooting and threw his phone underneath a car. Eli broke a window and they entered Coronado Hall and changed their clothes in Eli's room. Smith drove his car back and retrieved his phone and Smith and Eli threw their clothes into a sewer drain near Lobo Village. Smith and Eli made their way back to the scene of the shooting and were in the crowd as police attempted to help Travis.

Smith said he was not aware of what happened to the bat that was used.

On Sunday, NMSP announced that the 17-year-old girl, whom they have not publically named, was arrested, booked into a detention center and charged with aggravated battery and conspiracy.
