Attorney General opens investigation into death at Erie County Holding Center

BUFFALO, N.Y. (WIVB) — The New York Attorney General’s Office has opened an investigation into the death of an incarcerated individual at the Erie County Holding Center in August 2023, the AG’s office announced.

On Aug. 8, 2023, officials said the individual allegedly appeared to have been having a seizure and after receiving treatment from members of the Erie County Sheriff’s Office, became physically combative.

The individual is alleged to have been held in a prone position and handcuffed by ECSO members, officials said. ECSO members attempted to treat the individual again after he stopped responding and was taken to an area hospital.

The individual was pronounced dead on Aug. 15, a week after the incident.

Pursuant to New York State Executive law, officials said, the office of special investigation assesses every incident reported where a police or peace officer, including a corrections officer, may have caused the death of a person by an act or omission.

The Erie County Sheriff’s Office released the following statement:

The Erie County Sheriff’s Office and the New York State Attorney General’s Office
have been engaged in a joint investigation into the death of an incarcerated individual
that occurred on 08/15/23. New York State Executive Law Section 70-b requires that
the New York State Attorney General’s Office investigates certain in-custody deaths.
Due to the ongoing nature of this inquiry, it would be inappropriate to comment further
at this time.
