Bolivar area man found not guilty of gross sexual imposition

NEW PHILADELPHIA – A Tuscarawas County Common Pleas Court jury found a student-teacher on Tuesday not guilty of a charge of gross sexual imposition.

Justin McCauley, 22, of the Bolivar area still must stand trial in November on a second count of gross sexual imposition.

The charges involved two victims under age 10.

In April, Judge Michael Ernest had granted the defendant's motion for separate trials on the charges.

McCauley had worked for Tuscarawas Valley Local Schools as an elementary student-teacher and substitute cashier and monitor. The incidents for which he was charged relate to his work as a babysitter and not his work for the school district.

According to a judgment entry from Ernest, a final pre-trial hearing on the second charge will take place Nov. 8, with a status hearing scheduled for Nov. 14 and a jury trial on Nov. 15.
