Brockton demolition company fined $1.2M after Easton man killed at Government Center

BOSTON – A Brockton demolition company faces nearly $1.2 million in federal fines after an employee from Easton was killed in the March collapse of a Government Center during his first day on the job.

Peter Monsini, 51, of South Easton, died when several floors of the parking garage at 1 Congress St. in Boston, which was being demolished, collapsed.

The partial collapse led to a two-week suspension of MBTA Green Line subway service to allow structural engineers to inspect the Green Line tunnel.

An inspection by the U.S. Department of Labor’s Occupational Safety and Health Administration followed. According to a statement issued Tuesday, the review found that Brockton-based JDC Demolition Co. Inc. "failed to adequately train its workers on the demolition plan and safety management system to help them recognize and avoid unsafe conditions."

OSHA said that on the morning of the collapse, another heavy equipment operator expressed concerns about the safety of the eighth floor to a foreman.

"Despite the employee raising safety concerns to the foreman, a second employee was assigned to operate the excavator. That worker, the deceased, never received a safety briefing and was not trained to follow the engineer’s demolition plan," OSHA wrote in a statement.

Additionally, OSHA said the demolition company deviated from the plan by placing heavy equipment on the partially demolished seventh, eighth and ninth floors.

JDC Demolition faces proposed OSHA citations worth a total of $1.19 million. Eight of the 11 citations are considered "egregious-willful violations."

"JDC Demolition takes the safety and security of their employees extremely seriously and remains deeply saddened by the tragic loss of a team member. JDC Demolition historically has had an excellent safety record. They have fully cooperated with OSHA's investigation and are carefully reviewing the citations, and will contest them as appropriate," JDC spokesperson Lizzy Guyton said in a statement to WCVB.

The projects general contractor, John Moriarty and Associates Inc., was also cited by OSHA and faces $58,000 in proposed penalties.

Both employers have 15 days to comply, request an informal conference with OSHA’s area director, or contest the findings to the Occupational Safety and Health Review Commission.
