Concord man receives life sentence for 2019 homicide

(KRON)– David Kyle Lubkin, 30, of Concord, has been convicted of first-degree murder, and after more than three years of investigation, has been sentenced to 50 years to life for the 2019 murder of 19-year-old Ezequiel Garcia.

The murder occurred in September 2019, when Garcia met with Lubkin for the purchase of a gold necklace originally listed on Craigslist, said Assistant District Attorney Brian Staebell in a press release on Wednesday.

Upon meeting at the Petaluma Outlets, Lubkin recognized Garcia from a previous deal, and confronted the 19-year-old with a privately made firearm. Garcia tried to drive away, but Lubkin fatally shot him, Staebell said.

Police were able to arrest Lubkin with the help of two cooperative eye witnesses, and several weeks of investigation before arresting Lobkin, Petaluma Police said.

Judge Passaglia imposed the maximum punishment allowable by law, finding “no reason to limit the punishment given the absence of any remorse shown by the defendant,” Passaglia said. He also called it “a callous shooting to death of an unarmed man fleeing […] Because it insulted your ego.”

During the sentencing hearing, Judge Laura Passaglia, a commissioner for the Sonoma County Superior Court in California, described the shooting as the “ultimate act of violence,” and, “as senseless a murder as they come.”

Lubkin had the opportunity to make a statement expressing remorse or explaining his actions during Wednesday’s court hearing, but he said nothing, Staebell said in Wednesday’s press release.

Sonoma County district attorney Carla Rodriguez stated, “Mr. Lubkin’s well-planned murder has caused immeasurable harm to Mr. Garcia’s family. I hope that this entirely appropriate sentence helps them in some small way to move forward in their lives.”
