Couple says love life suffered after wife slipped on ham. They’re suing Eataly market

A New Hampshire woman spotted the free samples at a popular Italian restaurant and market in Boston.

As she walked through the isles of Eataly toward the samples, she slipped on prosciutto and broke her ankle, according to a new lawsuit.

Alice Cohen and her husband, Ronald Cohen, are suing Eataly Boston for negligence and “loss of consortium,” according to the Aug. 11 filing in Suffolk County Superior Court.

The lawsuit states that Eataly “had a duty to ensure that the surfaces of the floors were free from unnecessary dangers.” They failed to do so when Alice slipped and fell on the Italian ham, the lawsuit states.

The New Hampshire couple says damages exceed $50,000, with the exact amount to be determined if the case heads to a Massachusetts court.

The lawsuit says Alice Cohen “sustained bodily injuries, a loss of enjoyment of life, pain and suffering and incurred necessary medical expenses for medical care and attention” when she fell in October 2022.

Ronald Cohen, the co-plaintiff, cites Eataly for causing his wife’s injury that put a strain on their marriage.

The lawsuit says that he has “suffered from the loss of consortium of his wife, Alice Cohen,” as a result of her broken ankle.

Loss of consortium refers to a loss of “benefits that a familial or intimate relationship offers,” according to Forbes. This most commonly refers to sex, affection and emotional support.

Eataly is an Italian marketplace chain with restaurants and shops. McClatchy News could not immediately reach the company for comment.
