Defendant granted diversion in theft case

Oct. 26—A 31-year old area woman accused of stealing furniture and household items from a rental property Tuesday was been given the opportunity to have the charge removed from her record if all terms and conditions of judicial diversion are met.

Kayleen Danielle Luna, Old Lantana Rd., pleaded guilty to a reduced charge of theft of property of up to $1,000 and received an 11-month and 29-day suspended sentence. That plea was set aside for the probationary period.

If Luna successfully completes requirements of diversion — including payment of $1,865 restitution and court costs — she will be eligible to petition the court to have the charge removed from her permanent record.

Another condition of the agreement is that she remain on supervised probation for whatever time in excess of the year sentence that it takes to pay restitution.

The charge stems from incidents on Oct. 17 and 29, 2021, during which items were taken from a rental house without permission.
