Delphi murder suspect Richard Allen documents unsealed and posted online

DELPHI, Ind. — Hundreds of pages of sealed filings in Delphi murder suspect Richard Allen's case were published online Wednesday.

The filings from both the state and defense attorneys were sealed to "comply with the Court Order dated December 2, 2022, which prohibits public comment, commonly referred to as the 'Gag Order.'" Special Judge Frances Gull wrote in her Wednesday order.

The filings can be found at allensuperiorcourt.us/Delphi.

Gull signed an order Wednesday indicating she consulted with the attorneys for the case.

"Counsel agree with the Court that the public interest is best served by transparency, but that certain pleadings should remain sealed," Gull wrote in her Wednesday order.

The unedited version of the probable cause affidavit, for example, remains sealed, as does the list of witnesses that contain the names of juveniles. Defense ex parte motions remain sealed.

To ease the burden to the Carroll County clerk's staff, the Allen County officials were used to upload the documents to the internet.

In a June 13 filing, Carroll County Prosecutor Nicholas McLeland requested the court to prohibit the public access to the court records.

"Access or dissemination of the Court Record will create a significant risk of substantial harm to the requestor, other persons, or the general public," McLeland wrote in his motion.

Gull's order on Wednesday amounts to a ruling against McLeland's motion.

In an April 20 motion requesting the public be prohibited from inspecting the records, McLeland wrote, "The public interest will be substantially served by prohibiting access for the reason that the release of the information might damage an ongoing murder investigation; or ... (a)ccess or dissemination of the Court Record will create a significant risk of substantial harm to the requestor, other persons, or the general public."
