District attorney asks court to seal motion that cites Madison Brooks’ sexual history

BATON ROUGE, La. (BRPROUD) — An attorney for a man accused of raping Madison Brooks has filed a motion claiming that someone else caused the injuries prosecutors are citing in the case. District Attorney Hillar Moore, however, wants the document sealed.

Casen Carver was indicted on first and third-degree rape charges in May 2023, according to court documents.

In a recent filing, Carver’s lawyer argues that a different LSU student, who isn’t named, gave Brooks injuries consistent with sexual assault before the night of her death. The filing says witnesses have reported testimonies that could “gut the State’s theory of the case.”

Moore motioned to have Carver’s motion sealed, arguing it violates Louisiana state law, specifically because it references the victim of a sexual crime’s past actions. He references a state statute that requires a written motion with written evidence and a hearing to determine if the reported evidence is admissible before it is made public.

Moore said the defense cannot “claim ignorance of the law.”
