Driver in fatal SLO County crash charged with murder, GoFundMe launched for victim

A man suspected of driving under the influence when he crashed his vehicle on Highway 101 in Atascadero, killing his passenger, was charged with murder Wednesday, court records show.

The San Luis Obispo County District Attorney’s Office charged Oscar De La Mora Marin, 37, of Reedley, with murder, gross negligent manslaughter, DUI causing injury and DUI above an .08 blood alcohol level causing injury. There were also two sentencing enhancements for inflicting great bodily injury.

According to a California Highway Patrol news release, De La Mora Marin was speeding between 90 and 100 mph southbound in a Subaru Impreza south of the Del Rio Road overpass around 10:42 p.m. on Sunday, when his “level of intoxication” led him to swerve into the center divider.

When he tried to return his vehicle to the roadway, he over-corrected and spun clockwise across both southbound lanes, according to the release. The vehicle then left the freeway and rolled over on the nearby frontage road, Ramona Road.

Edna Marquez Galindo, 32, of Fresno was in the passenger seat during the crash.

She was ejected from the vehicle and suffered major injuries, according to CHP. She was transported to Sierra Vista Regional Medical Center in San Luis Obispo, where she succumbed to her injuries, CHP said.

De La Mora Marin received minor injuries in the crash.

Alcohol was suspected to be a factor, the CHP said, and De La Mora Marin was arrested Sunday evening.

As of Thursday morning, De La Mora Marin was still being held without bail in San Luis Obispo County Jail, according to the San Luis Obispo County Sheriff’s Office’s Who’s in Custody site. His next court date is Feb. 5.

GoFundMe raises money for Fresno woman killed in crash

Meanwhile, friends of the passenger killed have launched a GoFundMe account to raise money for funeral expenses.

“It is with a heavy heart, today we are asking for help to lay our beloved friend to rest,” the post reads. “Edna Marquez was a daughter, a friend and most importantly a mother to her beautiful daughter and son.”

The post continued: “We are asking for help so that her family is able to put her to rest without having to worry about the financial burden and are able to grieve as this was so sudden. We truly appreciate any and all help.”

As of Thursday morning, the fund had raised $2,306 of a $45,000 goal.
