Elizabeth Holmes files motion to stay out of prison during appeal process

Theranos founder Elizabeth Holmes is petitioning to stay out of prison as she appeals her 11-year prison sentence while her former partner Sunny Balwani faces his sentencing on Wednesday.

- Convicted Theranos founder Elizabeth Holmes is appealing her case, and she's asking to stay out of prison in the meantime. Holmes' lawyers are filing court documents on Monday detailing her request. Now her lawyers say, one, she is not a flight risk or a danger to public safety. Two, they say that the appeal is not meant to delay Holmes going to prison. And three, they write that Holmes appeal-- Holmes' appeal will present critical questions, including whether the judge may have made mistakes before, during, or after the trial. And now Holmes was sentenced in November to more than 11 years in prison after being convicted for defrauding investors in her company. Meanwhile, the sentencing for Holmes' former business partner and Theranos executive, Sunny Balwani, will happen tomorrow. Balwani was convicted in July on counts of fraud and conspiracy.
