Family of Deer Creek teen is suing homeowners over drowning death
The family of a Deer Creek High School graduate who drowned at a pool party is suing the homeowners.
Emergency responders pronounced Oluwatoyin “Toyin” Amuda dead at about 3:11 a.m. June 16, 2021, in the 21600 block of Villagio Drive in an unincorporated area west of Edmond.
Oklahoma County Sheriff’s Office investigators previously said Amuda may have accidentally fallen in the water or entered on his own after consuming alcohol and marijuana.
“His outer clothes were found nearby and they were not wet,” a sheriff’s investigator wrote in an affidavit. “A toxicology screening is being performed by the Medical Examiner’s Office. It was noted by EMSA there was a strong smell of alcohol about Toyin’s person. Being that Toyin did not know how to swim, it is probable in an intoxicated state he decided to enter the swimming pool or fell into the swimming pool.”
Investigators spoke with the homeowner, who said he was in bed when his daughter came in and told him a boy was in the pool. When the homeowner went outside, Amuda had already been pulled from the pool and laid on the deck, the homeowner told investigators.
The homeowner said he administered CPR until emergency responders arrived.
The sheriff’s office said a daughter in the home got permission from her parents to host a birthday party for a friend. Three adults over the age of 21 were present, authorities said.
Investigators discovered two plastic garbage containers in the driveway, filled with empty beer cans and assorted liquor bottles, according to the report. They also found two empty beer cans near a hot tub, an empty bottle of vodka and empty Jell-O packages.
Now, in Oklahoma County District Court, the family of Amuda is suing the homeowners.
Citing wrongful death and negligence, Amuda’s family accuses the homeowners of permitting “unsupervised drinking by underaged persons at a birthday party in and around the swimming pool” of their home.
They also accuse the homeowners of failing to supervise or control the birthday party around the pool.
The family seeks in excess of $10,000.
