Fredericksburg Restaurant Inspections: Facility Closed

FREDERICKSBURG, VA — During recent restaurant inspections by the Rappahannock Area Health District uncovered violations at more than a dozen locations around Fredericksburg and Stafford. The inspections were conducted between Dec. 8 and Dec. 14.

As coronavirus restrictions continue to fluctuate around the state, health inspectors are returning to conduct restaurant inspections in person. However, some visits, such as those for training purposes, can be conducted virtually.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

Here are the most recent violations as listed by the Rappahannock Area Health Department:

  • Subway (Inside Walmart), 10001 Southpoint Parkway Fredericksburg, VA 22407

    • Date inspected: Dec. 10

    • Total violations: 16

      • Observed 1.5 foot candles of light inside the walk in freezer and 2.6 foot candles of light inside the walk in cooler.

      • Observed the following in need of cleaning: Food in the floor drain under the 3 compartment sink, interior of ceiling light covers, and the wall behind the 3 compartment sink.

      • Observed the following in poor repair: Burned out ceiling lights, Ceiling tile not secured to the frame above the microwave oven, and damaged wall near the mop sink

      • Observed hose connected to the water line, used to prepare juices and teas at the beverage station, without backflow prevention. A flow valve was observed connected but absence of adequate backflow prevention. Provided backflow prevention handout. The person in charge reported it would be removed.

      • Observed accumulation of debris on the following nonfood contact surfaces: Base of the bread rack in the front of the house, rack and interior door of the Turbochef oven, shelf under the sandwich prep which holds utensils, Keurig coffee machine and iced tea brewer, container used to hold various utensils on the clean equipment shelving, and cabinet under the soda fountain in the lobby, appears they may have been a drip. The container used to hold utensils were removed to the 3 vat sink to clean and sanitize the contents.

      • Observed tubing and associated equipment used to prepare juices at the beverage station are not protected from contamination including contamination which may occur from customers. The tube and hook, which the water flows from to mix with the juice concentrate, is being stored on the side of the juice machine and is not protected from contamination. Discussed removing the equipment for storage in a clean and dry location after cleaning and sanitizing when not in use. The juice machines are being prepared (filled) in the dining room.

      • Observed two packages of pre-cooked meatballs sitting in the sanitizer basin of the 3 compartment sink at 48 degrees F. The person in charge reported they were pulled from the walk in cooler at 9:30 am., temperature was taken at 10:00 a.m. with the intent to portion them. The meatballs were relocated to the walk in cooler to cool to 41 degrees F or less by 12:30 p.m.

      • Observed pre-cooked meatballs in the hot holding well at 82 degrees F. The person in charge reported they were reheated in the microwave oven and placed in the unit at 8:30 a.m., temperature was taken at 10:08 a.m. The meatballs were removed to the microwave oven to reheat to 165 degrees F or higher by 10:30 a.m. Observed the meatballs reheated to 176, 189 degrees F by 10:21 a.m. Strongly encouraged documenting reheating temperatures.

      • Observed three silicone containers which are used to reheat meat, two black silicone mats used in contact with bread and a pair of plastic tongs on the open shelving which were observed soiled. The food contact equipment was removed to the three compartment sink for cleaning.

      • Through discussion with the person in charge, the soda machine nozzles are removed for cleaning and sanitizing once a week. Instructed the person in charge to remove the nozzles for cleaning at least once every 24 hours. The person in charge agreed to comply.

      • Absence of hand drying provision at the warewashing handsink. The person in charge placed disposable paper towels in the paper towel dispenser during the inspection.

      • Observed a container in the front handwashing sink. The container was removed to the 3 vat sink during the inspection.

      • Absence of handsoap at the warewashing handsink. During the inspection the person in charge replaced the handsoap dispenser.

      • Observed a food employee lather their hands under running water at the front handwashing sink. Hands were not effectively washed due to handsoap being flushed down the drain. Instructed the food employee on correct handwashing procedures and the employee rewashed their hands.

      • Observed a food employee handle their belt with their bare hands without washing their hands prior to handling food contact equipment. Instructed the food employee to wash their hands and discussed handwashing when there is a change in task.

      • The person in charge could not provide an employee health policy to verify training of food employees, however, he could communicate symptoms and illnesses requiring reporting. Provided sample employee health policy during the inspection

      • Observed food debris in the front handwashing sink. Discussed with the person in charge proper usage of handwshing sink. Person in charge removed the food debris.

      • Observed a container of raw shrimp and shell eggs stored above RTE foods in the walk in cooler. During the inspection the person in charge rearranged items to avoid cross contamination.

      • Observed the following:1. The interior surface of the ice machine was observed soiled 2. The can opener was observed with debris and grime. Can opener was relocated to the 3 compartment sink for washing and sanitizing.

      • Observed a heavy presense of fruit flies, in particular around the soda machine, utility closets and back prep kitchen area. Person in charge stated pest control comes to the treat the facility every 2 weeks.

      • Observed the handle of the ice scoop making direct contact with the ice at the kitchen soda machine.

      • The interior surfaces of all reach in coolers and interior of the upright freezer were observed in need of cleaning.

      • Observed an accumulation of water at the entrance of the kitchen and near dish washing area.

      • Observed a missing ceiling tile above the dish machine.

      • Observed floors underneath equipment and floors of the back prep kitchen area are in need of cleaning.

      • Observed the following employees belongings on a food prep table: 2 bottles of multi-vitamins, phone and phone charger, deodarant, coat, and face masks. During the inspection the person in charge relocated the employees belongings.

  • Thai House, 26 Doc Stone Road Stafford, VA 22556


    • Date inspected: Dec. 10

    • Total violations: 15

      • Observed food contact surfaces of two mixers in the back of the house soiled. The person in charge reported they were not being used. The equipment was removed to the dishwasher area for cleaning.

      • The food establishment does not have a system to date mark TCS ready to eat foods held longer than 24 hours in the food establishment. Observed five containers of various curry sauces prepared on 12/8/21 and three containers of cooked chicken and sweet potatoes prepared on 12/9/21 which were not dated with the date of preparation or discard. A food employee placed date labels on the containers during the inspection.

      • The exterior door which is located in the kitchen is not self-closing or tight sealing. This may allow the entry of insects or rodents.

      • Observed boxed and canned food stored on the floor by the shelving unit by the ice machine. The packaged food was relocated to the shelving unit.

      • Observed food employees preparing food without proper hair restraints.

      • Observed ladles stored in room temperature water at the rice warmer. The person in charge reported the ladles have been in the containers since 11:00 a.m. and were relocated to the dishwasher area for cleaning. Discussed storing ladles in a clean and dry container and removing the equipment at least once every four hours.

      • Observed boxes of single use disposable beverage containers stored on the floor by the ice machine.

      • Observed the hand washing sink by the prep area and in the ladies restroom are not sealed to the adjacent wall.

      • Observed three heads of broccoli and three cucumbers with their peel on, stored in a white plastic shopping bag. A food employee removed the food from the shopping bag during the inspection.

      • The person in charge could not provide an irreversible registering temperature indicator to monitor sanitization of equipment in the hot temperature dishwasher.

      • Observed Accumulations of debris were noted on the following nonfood contact surfaces: Interior, including gaskets, of reach in refrigeration units. sides of flattop grill, fryer cabinets.

      • Observed the hand washing sinks in the back of the house and the three compartment sink caulk to be soiled.

      • Observed the following in need of repair: Several ceiling tiles throughout the facility need to be re-adjusted, and a hole in the wall near the exterior door.

      • Observed living quarters in the left side dining room area. The facility has made gains to remove the bulk of the furniture and other unnecessary items, however, some furniture remains to be removed. The person in charge reported he is working on getting the remainder of the furniture removed. There is no evidence of sleeping quarters or persons living in the facility.

      • Observed the walk-in-cooler, walk-in-freezer, floors, ceiling, and walls in need of cleaning throughout the facility.

  • Bob Evans Restaurants #537, 10011 Southpoint Parkway Fredericksburg, VA 22407


    • Date inspected: Dec. 10

    • Total violations: 9

      • Observed employee's cups stored on the cooks line near food. The person in charge discarded the cups.

      • Observed the dish washer handling both clean and dirty equipment without washing his hands in between.

      • Both hand sinks on the cook's line are being used as dump sinks.

      • Observed fries, potatoes, fish that were not covered

      • Observed that the mixer parts and slicer require cleaning.

      • Observed that the microwaves require cleaning.

      • Observed mac & cheese at 44'F, omelette mix at 60'F, and shell eggs at 60'F cold holding at improper temperatures.

      • Observed that the inside of the reach in refrigeration units require cleaning.

      • Observed that the floors, walls, and ceiling is in need of detailed cleaning to include the air vent covers.

  • Costco Wholesale, 3102 Plank Rd Fredericksburg, VA 22407

      • Observed a stirring spoon in a glass of water next to the beverage dispenser. During inspection, the PIC relocated the the spoon and glass to the 3 compartment sink for washing and sanitizing.

      • The cabinets along the pretzel prep counter and beverage dispenser are in need of repair.

      • The employee restroom door is not self-closing.

      • The floor and wall in the back kitchen were observed soiled.

  • Chipotle Mexican Grill #2396, 1601 Jefferson Davis Hwy Fredericksburg, VA 22401

      • Observed a 2 foot mound of tortilla chips piled against the wall between the prep sink and fryer. During the inspection, a food employee discarded the tortilla chips touching the wall.

      • Observed 3 soiled metal containers containing spatulas and metal spoons on the prep counter. During inspection, the PIC relocated the containers and utensils to the dishwasher for washing and sanitizing.

      • Observed several metal food containers on the drying rack that were stacked while wet after cleaning and sanitizing.

      • Observed several lights out over the warewashing area and in front of the walk in cooler.

  • Ledo Pizza & Pasta, 9849 Jefferson Davis Highway Fredericksburg, VA 22407

    • Total violations: 1

      • Observed the following TCS cold holding at improper temperatures in the pizza prep cooler: In house prepared garlic butter (43 degrees F) and basil leaves (45 degrees F). The person in charge reported the TCS foods were held overnight in the pizza prep cooler and voluntarily discarded for safety. The person in charge contacted a technician during the inspection and will hold small amounts of TCS foods on ice in bus tubs in the unit until a technician evaluates the cold holding capacity of the unit. The top of the pizza prep cooler appears to cold hold TCS foods below 41 degrees F.

    • Date inspected: Dec. 13

    • Total violations: 4

      • Observed many small, flying insects swarming around the drain pipe of the front hand sink and the men's restroom door.

      • The handwashing facility located in trhe back room is blocked, preventing access by employees for easy handwashing. Observed construction materials, cases of water and christmas decorations blocking the sink. A path to the sink was made during inspection.

      • The handwashing station behind the serving counter is being used to clean equipment and utensils. Observed employee cleaning out a milk pitcher during inspection. Instructed employee to use hand sink only for washing hands.

      • This food establishment does not have an employee, with management and supervisory responsibility, that is a Certified Food Protection Manager.

  • Applebee’s Neighborhood Grill & Bar, 2851 Plank Road Fredericksburg, VA 22401


    • Date inspected: Dec. 13

    • Total violations: 10

      • Observed a food employee change tasks and proceeded to engage in food preparation without first washing their hands and donning gloves. Employee was asked to wash their hands.

      • The following were observed soiled to the sight and touch: one knife, one pan, meat slicer, and several containers. Items were moved to be washed, rinsed, and sanitized.

      • Observed two containers of pre portioned riblets cold holding at improper temperature ((44'F-50'F) in the cold holding drawer under the grill. The person in charge (PIC) discarded the items.

      • Observed two racks of silverware, a whisk, and two long drink stirrers stored with the lip-contact surfaces facing up. The person in charge moved the items to be washed, rinsed, and sanitized.

      • The following were observed in need of repair: 1) water collecting on the bottom shelf of the reach in cooling unit in the bar. 2) the walk in freezer was observed with a large accumulation of ice on the floor, around the door, and on the ceiling that may prevent necessary maintenance and easy cleaning.

      • The following nonfood contact surfaces were noted with an accumulation of grime and debris. 1) the interior and exterior of all reach in coolers and freezers, 2) the shelving units, 3) range burners, 4) the exterior of the blender, 5) the exterior of the dishmachine, 6) the fryer cabinets.

      • Observed the following in need of repair: 1) sealant between the coving and the wall at the 3-compartment sink area has become eroded, 2) several ceiling tiles throughout the facility need to be re-adjusted, 3) broken and missing floor tiles throughout the facility, 4) the floor tiles need to re-grouted throughout the facility. 5) broken light shield cover in the kitchen and in the dry storage area.

      • The following areas were noted in need of cleaning throughout the facility: ceiling vents, ceiling, light shields, walls, and floor, including the walk-in-cooler and freezer.

      • Observed the hood system and filters soiled with grime and debris.

      • Observed the following employees' personal belongings stored next to food and equipment. 1) two jackets stored over equipment in the dry storage area, 2) a jacket stored near single service articles in the servers area in the front of the house,, 3) a cell phone in the kitchen near equipment. The PIC relocated the items.

  • Super Value Inn, 5321 Jefferson Davis Highway Fredericksburg, VA 22408

      • Consumer self-dispensing bulk food bin containing dry cereal is not properly labeled.

      • The facility does not have a person or trained staff that is knowledgeable in food safety, cleaning of food contact surfaces, monitoring cooking and cooling temperatures of TCS foods.

      • The facility does not have a person with a valid Certified Food Protection Manager.

      • Per discussion with the person in charge the blender and steaming wand of the espresso machine are not getting cleaned at the frequency recommended of every 4 hours.

      • The following were observed: 1.The interior surfaces of the microwave were soiled. 2. The interior surfaces of the ice machine were extremely soiled with mold-like growth and staining.

      • The following TCS foods were observed cold holding at improper temperatures due to a faulty cooling units:1 container of soy milk (50 degrees F), 1 container of oat milk (50 degrees F), 1 container of almond milk (50 degrees F), 1 gallon of lactaid milk (50 degrees F), 1 container of egg nog (50 degrees F), 2 containers of veggie pasta soup (49 degrees F). Per discussion with the person in charge milks had been left in unit overnight, and were discarded for safety.

      • Two cooling units are not cold holding at the adequate temperature. The under counter milk fridge (50 degrees F), and the pastry/sandwich display unit (49 degrees F). Person in charge will not store TCS foods in units until they get fixed.

      • The person in charge could not provide a small thin probe thermometer.

      • Observed the following single service use articles were stored on the floor. 1 box of foam cups, 2 boxes of clear cups, 1 box of lids, 1 box of to go containers.

      • The following non-food contact surfaces were observed in need of cleaning: 1. Inside the cooling/freezer units. 2. Vent inside the kitchen milk cooler. 3. Top surface of the oven. 4. Up splash of the coffee brewers.

      • Observed the following: 1.Two ceiling panels missing in the back office/coffee roasting room. 2. Caulking at the 3 compartment sink needs redoing.

      • Observed the floors underneath and between equipment are in need of cleaning.

  • Subway/Auntie Anne’s Pretzel (Inside Wal-Mart), 11 Village Parkway Fredericksburg, VA 22406

      • Observed three bins of various condiments/ingredients which were not labeled to identify the contents.

      • Accumulation of debris was noted on the following non-food contact surfaces: 1- Base of the pretzel oven, 2- top of the ice well unit , 3- shelving in the Auntie Anne's side of the facility and 4- base of the Turbo Chef.

      • The PIC could not provide an employee health policy for the food employees. EHS provided a sample copy of the employee health policy. The PIC had the food employee sign the policy.

      • Observed food employee scrub hands under running water. Food employee rewashed hands using proper handwashing procedure before returning to work.

      • Observed several lights out throughout the back of the kitchen.

      • The floors throughout the establishment were observed soiled.

  • Majestic Restaurant Bar & Grill, 3987 Jefferson Davis Highway Stafford, VA 22554


    • Date inspected: Dec. 13

    • Total violations: 25

      • Observed the following in poor repair: Missing ceiling tile above the ice machine, damage wall by the meat slicer, numerous blown out ceiling lights, seal toilets to the floor, ceiling tiles not secured to the frame in the toilet rooms, and the floor at the bar area is lifting up, observed accumulation of water on the floor.

      • Observed the ceiling tiles in the male and female toilet rooms are absorbent and not easily cleanable.

      • Observed two mops with the mop head sitting inside the bottom of a bucket.

      • Observed the floors, wall and caulking at the warewashing area, ceiling vents and mop sink in need of cleaning.

      • Observed dumpster stored on grass/gravel.

      • Observed accumulation of debris on the following nonfood contact equipment: Cutting board on prep cooler (not used in contact with food), shelf under char broiler, shelf next to range, interior doors of the convection oven, equipment used to store cleaned utensils at the cook line. Discussed removing utensils for cleaning.

      • The person in charge could not provide a Quaternary Ammonium (QT-10) test kit to monitor concentration of Quaternary Ammonum sanitizing solutions.

      • Observed basket of forks at the host station and three stacks of plates with the food contact surface facing upward on the beverage preparation table. The top plate for each stack was inverted to prevent contamination.

      • Observed boxes of wine and two pickle buckets stored on the floor in the walk in cooler.

      • Observed numerous working containers of salt and various sauces at the beverage station and three bulk containers which were not labeled to identify the contents.

      • Observed four reduced oxygen packages (ROP) of raw diced prime rib in the walk in cooler, which the facility has conducted ROP in house which were not labeled to identify the date and time of packaging and the identification of the product. Discussed ROP requirements in absence of a HACCP plan and the person in charge voluntarily discarded for safety.

      • Observed sternos stored on open shelving over cleaned and santized food contact equipment.

      • The menu does include the reminder to indicate which foods on the menu may be cooked to order upon a customer's request and the brunch menu does not include a consumer advisory (disclosure and reminder) for eggs and steak which may be cooked to order.

      • Observed the following in house prepared food more than 24 hours in advance without date marking: Opened container of hot dogs in the 3 door reach in cooler #1, marinara sauce, garlic in oil, pasta in the walk in cooler and single use containers of portioned in house prepared blue cheese dressing in the 2 door reach in cooler. The person in charge reported TCS foods were prepared 12/12-12/13/2021 and placed a date label on the products. Discussed date marking and provided handout.

      • Observed the following TCS foods cold holding at improper temperatures: 3 door reach in cooler #1- Raw squid (45 degrees F), corned beef sandwiches (44 degrees F); shredded cheddar cheese (44 degrees F) cold holding on a pan of ice in a cold holding well. The person in charge reported the raw squid was held overnight in the cooler and voluntarily discarded. The corned beef sandwiches and shredded cheese were pulled from the walk in cooler at 10:30 a.m. and were relocated back to the walk in cooler to cool. TCS foods, holding at 41 degrees F or less, were relocated to the walk in cooler out of an abundance of caution until cold holding capacity is evaluated by a technician. Discussed holding TCS on ice up to the highest level of food stored in the container and discussed holding less product on ice.

      • Observed au jus gravy prepared at 10:30 a.m. holding at 90 degrees F in the hot holding well. The TCS food was inadequately reheated prior to hot holding. Temperature was taken at 11:00 a.m. The person in charge removed the gravy to the range for reheating to 65 degrees F or higher by 12:30 p.m. Observed gravy reheated to 184 degrees F by 11:30 a.m.

      • Observed the in-use Steramine Quaternary Ammonium sanitizing solution at the bar three compartment sink at 100 ppm and 99 degrees F. Worked with food staff to increase the concentration to 200 ppm and 93 degrees F (solution was tested at 74 degrees F).

      • Observed uncovered pizza in the walk in freezer and multiple containers of produce uncovered in the walk in cooler. The person in charge placed a cover over the pizza in the walk in freezer.

      • The person in charge could not provide parasite documentation for fish which may be cooked to order. Instructed the person in charge to obtain parasite destruction documentation from the fish supplier.

      • Observed open package of hot dogs, stored in the 3 door reach in cooler #2, which had a slimy white coating on the surface. The person in charge voluntarily discarded the product for safety.

      • The only handsink in the kitchen was not supplied with handsoap. The person in charge placed handsoap at the sink. instructed food employees to wash their hands.

      • Observed absence of hand drying provision at the bar handsink. The person in charge provided disposable paper towels at the sink during the inspection.

      • Observed hot water does not flow at the bar handsink. Contact plumber to restore hot water.

      • Observed a food employee handle raw salmon wearing single use disposable gloves, remove gloves and begin to handle food contact equipment. Instructed the food employee to wash their hands.

      • Observed a food employee dry their hands, after handwashing, with a dry cloth. Informed the person in charge employees shall dry their hands after handwashing with a disposble paper towel.

  • Cheddar's Scratch Kitchen, 3722 Plank Road Fredericksburg, VA 22407


    • Date inspected: Dec. 14

    • Total violations: 19

      • Observed two food employees wash their hands for less than 10 seconds. Observation was discussed with the person in charge. Ensure that food employees use the proper procedure when they clean their hands and exposed portions of their arms.

      • Observed an employee handle soiled dishes then handled clean dishes without washing their hands. Employee was asked to wash their hands.

      • Observed 2 containers of coleslaw and one container of salsa that were placed uncovered under soiled trays. The PIC removed the trays and covered the foods.

      • Observed a food employee touch soiled utensils and fryer baskets, then touched cut lettuce with the same gloves. The observation was discussed with the employee. Gloves were discarded and hands were washed.

      • The sanitizer basin in the 3-compartment sink in the bar area where equipment and utensils are being sanitized tested (0 ppm) The PIC added the proper amount of sanitizer.

      • Observed several equipment, utensils, dishes, and containers that were soiled to the sight and touch. Items were removed to the three compartment sink to be washed, rinsed, and sanitized.

      • Observed a container of raw chicken breast cold holding at improper temperature (47-50'F) in the frying station. The chicken was stored above the fill line for less than two hours. The person in charge placed the chicken in the walk-in-cooler.

      • Observed flies in the facility.

      • Observed food employees wearing wrist jewelry.

      • Per discussion with the person in charge, servers prepare salads without proper hair restraints.

      • Observed in-use ice cream scoop stored in standing water at a temperature of 66'F. The scoop was re-located to the dishroom to be washed, rinsed, and sanitized.

      • Observed several food containers stacked while wet on the shelving units throughout the facility. Discussed requirements with the person in charge.

      • The handwashing sink by the dishmachine is not sealed to the wall.

      • Observed the following: 1) the three compartment sink spout is missing, 2) the walk in freezer was observed with a large accumulation of ice on the floor and the fans that may prevent necessary maintenance and easy cleaning.

      • The person in charge could not provide a working irreversible registering temperature indicator to monitor sanitization of equipment in the hot temperature dishwasher.

      • The following nonfood contact surfaces were noted with an accumulation of grime and debris: 1) the interior of the reach in freezer, 2) the exterior of the chips unit holder, 3) fryer cabinets, 4) the exterior and the top of the dishwasher, 5) the hood system, 6) the oven, 7) the fan on the conveyor oven.

      • Observed the following areas in need of cleaning: 1) the ceiling over the frying station, 2) the floor in the bar area, 3) the wall near the mop sink, 4) ceiling tiles and vents.

      • The wall covering in the mop sink area is not smooth and easily cleanable. The walls are visibly soiled.

      • Observed several openened and unprotected bags of dried foods and spices stored on a dry food shelf. EHS discussed with the person in charge and the bags were sealed or rewrapped to protect from cross contamination.

      • Observed four pans of food stored in the walk in freezer uncovered and one pan of chicken in the walk n cooler uncovered. During the inspection the person in charge covered the pans of food.

      • The following were observed soiled: theinterior surfaces of the ice machine, microwave and blade of can opener.

      • The following TCS foods were observed cold holding at improper temperatures due to a cooling unit not working properly: barbecue chicken 46 degrees F, fried cauliflower 44 degrees F, 7 hard boiled eggs 46 degrees F, yogurt 48 degrees F, quart of heavy cream 73 degrees F, unsalted butter 80 degrees F. During the inspection the person in charge discarded the foods for safety.

      • Facility is making in house made yogurt without the approval from the health department or meeting variance requirements. In discussion with the person in charge yogurt will be taken home by employees and not be used/made in the facility any longer.

      • Observed a prep cooling unit at 50 degrees F. During the inspection the person in charge adjusted the temperature, before inspection was over EHS rechecked the unit temperature at 40 degrees F.

      • Observed two food employees working without hair restraints.

      • Observed numerous containers of sour cream, yogurt, spice containers being washed and reused to hold foods.

      • Observed several cutting boards heavily stained and heavily scored.

      • Ther person in charge was unable to provide verification of employee training in regards to Employee Health. A sample Employee Health form was left with the person in charge.

      • Observed sliced provolone chese, deli sliced turkey and ham in the prep unit with what appeared to be mold on them. Items wwere voluntairly discarded during inspection.

      • Observed 2 pair of tongs and a serving spoon in the clean utensil container on the clean pot rack that were soiled. Items were placed in the 3 compartment sink to be cleaned.

      • The deep fryer baskets and theinterior of the microwave oven were observed heavily soiled.

      • The following foods were observed cold holding at improper temperatures in the prep unit: tuna salad (48'F), coleslaw (47'F), sliced american cheese (55'F), provolone cheese (55'F) and chicken salad (48'F). The items have been in the unit overnight abnd werre voluntarily discarded by the person in charge.

      • The commercially processed ready-to-eat (RTE) sliced ham and sliced turkey in the prep unit was held for more than 7 days after the package was opened. The turkey should have been discarded on 12-9-2021, and the ham on 12-4-2021. Both items were voluntarily discarded during inspection.

      • Observed fish thawing in standing water in the 3 compartment sink. Proper thawing methods were discussed with the person in charge.

      • Harborage conditions exist. Observed two large buckets of used fryer oil stored under the 3 compartment sink.

      • Observed a case of biscuits and 2 cases of chicken stored on the floor of the walk in freezer. Items were placed on shelf during inspection.

      • The following non-food contact surfaces were observed soiled: 1-the shelving throughout the kitchen and in the walk in freezer, 2-the clean utensi storage containers, 3-the outer surfaces og the reach in cooler, 4-the small fan on the floor, 5-the outer surfaces of the deep fryers, 6-the deep fryer exhaust vents, 7-the caulking aling the 3 compartment sink and the men's restroom sink (mold). IN GENERAL ALL EQUIPMENT SURFACES IN THE KITCHEN ARE IN NEED OF A DEEP CLEANING.

    • Note: This was a pre-opening inspection. The following are items that needed to be completed before a final inspection, according to the health department.

      • Provide Certified Food Protection Manager certificate for Person In Charge (manager)

      • Submit an updated Application for Food Establishment Permit.

      • The Certificate of Occupancy is required prior to issuance of the health permit.

      • An indirect connection (air break) is needed on the drain line to the food prep sink. This was noted on the plan review approval letter dated July 2, 2021.

      • Seal opening/gap between the walk in cooler and walk in freezer with a smooth, non-absorbent and easily cleanable material.

      • The outdoor grease waste container is located on a grassy surface. Relocate to the dumpster pad or provide a separate concrete or asphalt pad for the container.

      • Ensure all vinyl cove base molding at the floor/wall juncture is properly sealed to the wall. Observed cove base molding below the electrical panels that is separating from the wall.

      • Seal all floor/wall junctures in the cooking area (around and below wok station). The stainless steel wall paneling was installed without any cove base molding or trim to seal floor/wall junctures.

      • Ensure that the cook’s prep refrigerator is turned on and capable of holding foods at 41°F and below. The right door does not seal tightly. Repair door for a tight seal.

      • Ensure the steam table is turned on and capable of hot holding foods at 135°F and above.

      • Remove all shipping plastic from equipment.

      • Provide 2 missing knobs for flat top grill.

      • Shelving is needed for the storage of canned goods and other dry food products.

      • Provide paper towel dispensers and paper towels at the 2 kitchen hand sinks and each rest-room hand sink.

      • Provide covered trash cans in the rest-rooms.

      • Provide toilet paper in the rest-rooms.

      • The front outer doors are not tightly sealed to prevent pest entry. There is a large gap between the middle of the doors and gaps at the bottom of the doors. Seal gaps.

      • Provide a thin diameter probe food thermometer for measuring temperatures of thin foods.

      • Provide sanitizer (food grade bleach) and a CM240 chlorine sanitizer test kit.

      • Provide dish washing detergent.

      • Observed the following: 1. The blade of the mounted can opener was soiled with encrusted food debris. During the inspection the can opener was moved to the dish washing area. 2. The interior surfaces of the ice machine was heavily soiled with mold-like and pink staining.

      • Observed a pan of mac and cheese stored in the walk in cooler of the basement at a temperature of 44-45 degrees F. In discussion with the person in charge mac and cheese had been made on 12/6 and cooling temperatures were not monitored before storing in the walk in cooler. During the inspection the person in charge discarded the pan of mac and cheese for safety.

      • Observed a heavy presense of crawling insects around the dish machine washing area.

      • Observed 2 limes, a container of heavy cream/half and half, and an empty plastic container being stored directly on the ice of the soda machine (soda machine is not currently being used).

      • Observed a heavy biuld up of ice in a reach in freezer of the kitchen.

      • Observed the caulking of the dishmachine area is missing and needs replacing.

      • Observed the upsplash of the coffee brewer was heavily soiled with debris.

      • Observed the following: 1. An accumulation of water on the floor near the walk in cooler. In discussion with the person in charge it is condensation from the walk in cooler and is currently being repaired. 2. A bucket collecting water behind soda machine.

      • Observed floors underneath equipment especially under the fryers are in need of cleaning.

      • Ceiling tiles of the men, womens and unisex bathoom are porous and not a smooth and easily cleanable surface.

      • Observed the following were observed in need of repair: Floors of walk in cooler are severly damaged, wall tiles by kitchen handsink and behind dish washing machine are damaged/cracked, numerous floor tiles throughout the facility are cracked/chipped, holes in ceiling tiles of the main floor bathrooms, floor tiles and loose hand rail leading to the basement are cracked/chipped.

      • Observed an employees coat and handbag was stored next to cooking equipment.

      • The person in charge failed to communicate food safety risks to prevent transmission of foodborne illnesses. Absence of active managerial control and numerous risk factor violations were observed during the inspection including: Cold holding, reheating and cooling violations, The person in charge could not communicate cooking temperatures for beef, reheating for hot holding time and temperature requirements for reheating of TCS foods cooled in the food establishment, improper cleaning and sanitizing of food contact equipment, and the lack of knowledge of correct Chlorine sanitization concentration. Food safety education was provided during the inspection.

      • The food establishment does not have a certified food protection manager, the owner's current certification expired November 2021.

      • The person in charge could not provided an employee health policy to verify food employees have been trained but food employees were knowledgeable of health reporting requirements. Provided sample employee health policy in Spanish.

      • Observed the following handwashing violations: Observed a food employee set up Chlorine sanitizer wiping cloth bucket with their bare hands and then proceed to handle a blender which had food in it without washing their hands. Instructed food employee to wash their hands.

      • Observed a food employee handle a sandwich with their bare hands which was prepared for a customer's order. The person in charge voluntarily discarded for safety.

      • Observed uncovered food on the back prep table upon arrival, which food employees were not using or prepping, to conduct the inspection and numerous uncovered food containers in 2 door upright coolers. The uncovered food containers on the prep table were voluntarily discarded due to presence of live crawling insects on the prep table.

      • Observed two containers of shell eggs and package of raw chicken stored on shelf in the 2 door upright cooler #2 over produce. Worked with the food employees to relocate the raw animal foods to prevent contamination.

      • Observed interior surfaces of the microwave oven soiled.

      • Observed a food employee take a stainless steel container, which was not removed from cleaned equipment shelving, and rinse the container prior to drying with a single use disposable paper towel. The intent was to use it for food service. The food container was not adequately cleaned. Instructed the person in charge to remove the container to the 3 compartment sink for adequate cleaning and sanitizing.

      • Observed the following food contact equipment soiled: Tortilla press soiled on open shelving, soiled cutting board at the prep sink and two soiled knives at the magnetic knife rack. The soiled knives were removed to the 3 compartment sink for cleaning.

      • The beef cooked for a taco (126 degrees F) was not cooked to a sufficient temperature and time to eliminate pathogenic bacteria. The person in charge voluntarily discarded the entire taco. Discussed correct cooking temperatures for beef.

      • Observed refried beans in the hot holding well at 126 degrees F. The person in charge reported the beans were placed in the unit at approximately 11:20 a.m., temperatures were taken at 11:50 a.m. The refried beans were inadequately reheated for hot holding and were placed on the range to reheat to 165 degrees F by 12:20 p.m. Observed beans reheated to 182 degrees F by 11:30 a.m. Discussed time and temperature requirements for reheating of in house cooled TCS foods during the inspection.

      • Observed container of rice (44, 43 degrees F) in the 2 door upright cooler #1, container of rice (45 degrees F) in the 2 door upright cooler #2 and large container of cole slaw (44 degrees F) in the 2 door upright cooler #1 improperly cooled. Observed TCS foods stored in deep and covered plastic containers in the refrigeration units. The person in charge reported the TCS foods have been in the unit overnight and temperatures were not taken to monitor the cooling process. The person in charge voluntarily discarded the food for safety..

      • Observed the following TCS foods cold holding at the improper temperatures: Raw beef (49, 45 degrees) in the 2 door upright cooler #2, cut lettuce (60 degrees F) and cut tomato (52 degrees F) stored in a take out container on the prep table. The person in charge reported the raw beef has been in the unit overnight and was thawed under hot water the evening prior which may be a contributing factor. The person in charge could not communicate how long the cut lettuce and tomato have been out of refrigeration. The person in charge voluntarily discarded the TCS foods.

      • The food establishment does not have a system to date mark TCS ready-to-eat foods held longer than 24 hours in the food establishment. During the inspection a food employee date marked TCS foods found in refrigeration units with the date of preparation.

      • Observed an employee's container of Tylenol stored on a shelf with cleaned equipment. The medication was removed to prevent contamination.

      • Observed chemical spray bottle under the 3 compartment sink which was not labeled to identify the contents. A food employee placed a floor cleaner label on the bottle to identify the contents.

      • Improper cooling methods observed to cool cole slaw from ambient ingredients and multi-stage cooling of cooked rice. The facility does not have a food thermometer to monitor internal temperatures of TCS foods and are cooling and storing TCS foods in deep and covered plastic containers. The person in charge reported cooling is being done in pans with ice, however, the containers being used are greater than 2 inches.

      • The person in charge could not provide a thin-probed food thermometer to monitor internal temperatures of thin massed foods.

      • Observed containers of spices on open shelving and large container of cassava flour which were not labeled to identify the contents.

      • Observed significant presence of live and dead crawling insects (roaches) in the food establishment. Observed 3 live crawling insects on the back prep table and crawling inside a container of rice, observed dead and live insects trapped between the 3 compartment (damaged) wall and a large sheet of plexiglass secured on top of the wall at the 3 compartment sink, also observed dead insects inside the service sink. The person in charge voluntarily closed the food establishment to address the significant pest issue. Instructed the person in charge to contact pest control to conduct an inspection and treatment and clean and sanitize all food contact equipment and utensils. Observed harboraging conditions in the food establishment including food in floor drains, accumulation of debris behind the cook line, damaged wall at the 3 compartment sink which appears to be an attractant for pest activity.

      • Observed linen in contact with warm tortillas stored in a cooler. The tortilla were removed from the linen during the inspection,

      • Observed three crawling insects (roaches) crawling inside a container of rice on the back prep table. Four uncovered containers of food were observed on the prep table and were voluntarily discarded for safety due to the presence of crawling insects on the prep surfaces.

      • Observed employee coats hanging over shelving unit used to store cleaned equipment. Discussed storage of employee's articles.

      • Observed plastic food storage containers stacked while wet after chemical sanitizing on open shelving by the upright coolers.

      • Observed food being stored in direct contact with plastic shopping bags. The food was removed to prevent contamination. Discontinue storage of food in direct contact with plastic shopping bags which are not food grade or safe.

      • Observed the following equipment in poor repair: Cracked plastic storage containers, ice build up inside freezers, hand held collander is bent, and base of 1 door upright freezer is cracked.

      • Accumulation of debris observed on the following nonfood contact surfaces: Base of oven, shelf under the flattop grill, container used to store various utensils on open shelving, exterior surfaces of bulk container used to store cassava flour, magnetic knife holder, exterior surfaces of the food processor.

      • Observed the following in poor repair: Damaged wall at the 3 vat sink (large sections of the wall are chipped away), holes in ceiling tiles above the ice machine and hot water heater, ceiling lights out in the toilet rooms, ceiling tiles in female toilet room not secured to the frame, scratches in ceiling tiles in the kitchen. The facility has attached a large sheet of Plexiglas to on top of the damaged wall, the wall is in need of significant repair.

      • Observed the coving tile is untreated wood and is not smooth or easily cleanable. Seal or paint wood to create a smooth and easily cleanable surface.

However, not all the restaurants that the health department visited had violations. Here are a list of locations that were visited, but had no violations. Some were visited as part of pre-opening inspections, while others received routine or follow-up visits.
