Hungary Loses Latest EU Court Fight Over its Asylum Policies
(Bloomberg) -- Hungary lost the latest skirmish with the European Union’s executive over its “unlawful” asylum policies, after the EU’s top court said the government hindered access to those seeking refuge.

The Hungarian law “deprives third-country nationals or stateless people” of their right to seek asylum from Hungary, the EU Court of Justice said in a binding decision on Thursday.
EU judges said the law constitutes “a manifestly disproportionate interference” with the right of people seeking international protection.
The ruling, which can’t be appealed, is part of a series of judgments by the bloc’s top tribunal chastising Hungary over its harsh anti-immigration policies. The government faces potential fines in another case from the commission requesting the court punishes Hungary for failing to comply with a 2020 ruling that hit at the heart of Prime Minister Viktor Orban’s anti-immigration policy.
The latest case concerns a 2021 commission suit arguing Hungary unlawfully restricted access to the asylum procedure by forcing those seeking international protection in the country to first file a petition at a Hungarian embassy outside the EU.
