Indy man charged in crash that killed Muncie resident
INDIANAPOLIS — An Indianapolis man faces three felony charges stemming from a June crash that killed a Muncie resident.
Joseph Evan Dely, 31, was pronounced dead at the scene of the June 17 collision, along the southbound lanes of Interstate 465 near Interstate 74, on the southeast side of Indianapolis.
Indiana State Police said Dely was driving a Jeep southbound on the interstate when his vehicle was struck in the left rear by a Chevrolet Malibu driven by Teriyon Carter of Indianapolis.
That impact caused the Jeep to "spin off the roadway and overturn several times," according to an ISP release.
Carter, now 23, was charged last week in Marion Superior Court 29 with reckless homicide, causing death when driving while intoxicated and causing death when driving with a controlled substance in system.
According to a probable cause affidavit, Carter told state police he had GPS activated on his cellphone, which he dropped while driving. The rear-end collision took place after he reached down to retrieve the phone, the report said.

Investigators said Carter's car was traveling about 89 miles per hour when he struck Dely's vehicle, which had an estimated speed of 61 mph.
Police found marijuana in Carter's vehicle, and blood tests also indicated he had ingested marijuana, the affidavit said.
Christine Dely-Stinson, Evan Dely's mother, said at the time he was killed, her son was on his way to Indianapolis International Airport, planning to join a family member on a camping trip in Colorado.
Dely-Stinson called her son a "good man whose life was cut short by a selfish person who had no consideration for life when he chose to drive high."
Reckless homicide is a Level 5 felony carrying a maximum six-year prison term. The other two charges filed against Carter are Level 4 felonies with maximum 12-year sentences.
