Lexington restaurant inspections: Rodents, raw sewage & 9 closures (one place twice)

The Lexington-Fayette County Health Department has released an updated list of about 160 restaurants and businesses that are under enhanced regulatory enforcement for food service.

And at least eight local establishments were closed by the health department since June, with one business closed twice.

The health department’s enhanced enforcement list, formerly known as probation, has been growing: There were only 150 establishments on the list in June, up from 114 establishments in November 2022.

Between June 6 and Oct. 11 of this year, at least 36 food service establishments were added to the health department’s list for heightened scrutiny designed to protect the dining public from food-borne illness.

The Fayette County Health Department does not flag on inspection scores which restaurants are on the watch list or post full restaurant inspection reports on its website. The Herald-Leader obtained the detailed list and individual reports through open records requests, but the health department limited the number of reports due to staffing constraints.

What restaurants came off the watch list

Restaurants come off the list once they have twice passed inspections with no significant issues.

At least 30 establishments came off the list since June after successful passing repeated inspections.

Establishments that came off the watch list since June include Allen’s Foodmart, Arby’s on South Broadway, Blessing From God daycare, Bourbon n’ Toulouse on South Broadway, Creaux, Domino’s on Towne Center Drive, El Malecon Restaurant, El Rancho Tapatio, El Sabor de Mexico Restaurant & Tayuena, Hardee’s on West New Circle, Hooter’s, Horsepark BP, Idle Hour Country Club, KS Bar and Grill, McDonald’s on Leestown Road, Parlor Doughnuts, Pho Saigon, Pro Shakes Nutrition, Rally’s on Richmond Road, Rolling Oven on South Limestone, Senor Chimi, Shaking Seafood & Wings, Shell Food Mart on Polo Club, Sir Pizza Commissary, Speedway on Leestown Road, Sultan, Super Mercado Aguascalientes on Woodhill Drive, Wild Eggs on Palomar Center Drive, Wing Zone on Eureka Springs Drive and Yu Yu Asian Market.

At least one restaurant — Sultan — came off the list because it closed. Another, Rally’s on Richmond Road, closed after a fire.

All of Lexington’s nearly 1,500 food service establishments, from daycares to hospitals to grocery stores to restaurants, are inspected at least twice a year and most pass without significant problems. Hundreds score a perfect 100, many more than once.

Restaurants and food service establishments are required to post their most recent scores at the front door; scores in green boxes indicate passage and scores in red indicate failure. Those that score below 60 are closed until issues are remedied. Inspection scores are available online at the Lexington health department’s web site.

How Lexington restaurants are inspected by the Health Department

After a pause at the beginning of the COVID pandemic, the Lexington-Fayette County Health Department in 2021 resumed the key public health measure.

Restaurant inspectors place restaurants that fail on critical points on a watch list. The “enhanced regulatory enforcement” comes with a stepped-up inspection schedule designed to catch potential problems earlier.

The measure, previously known as the probation list, restarted in August 2020. The Board of Health voted in September 2021 to update food service regulations to formally include the program.

Restaurants are placed on the list when they score below 85, fail a significant inspection point or if they are required to be closed due to imminent health hazard such as raw sewage, evidence of rodent or insect infestations or a lack of electricity.

Problems that constitute a failure are those deemed by the Food & Drug Administration to have the highest potential to affect the public health adversely, such as a improper food handling, lack of hand-washing or improper dish sanitizing.

Luke Mathis, environmental health team leader, said in 2022 that the intent of enhanced regulatory enforcement is “identifying establishments that are struggling with food safety compliance and providing additional monitoring.”

The hope, he said, is that the more inspectors are there, the quicker they will spot things that need to be changed “and through education help them get into compliance.”

“The overall goal of the program is to improve public safety, sanitary and hygiene practices within these establishments, so the public will feel safe eating out,” said Skip Castleman, Environmental Health and Emergency Preparedness Coordinator. “All of our placards are still posted at these establishments, so they have a means of looking to see if a restaurant has passed or failed. With a green placard, they’ve passed; with a red placard, they’ve failed. And they can also look on our website too, before they go out to eat.”

Typically, food service establishments are inspected every six months. With enhanced enforcement, inspectors usually come every four months, Mathis said. Restaurants come off the enhanced enforcement when they pass regular inspections without significant issues twice in a row.

Generally, restaurants that are in the enhanced enforcement program are safe to eat at or the health department would have closed them down.

Lexington restaurants shut down, closed by the health department

In the last four months, food service was halted at least six times at local restaurants by the inspectors for serious issues.

Panda Cuisine, 2358 Nicholasville Rd. #115, was ordered closed on Aug. 2 due to evidence of rodents in the kitchen area and an inspection score of 69. After the owner submitted an application for reinstatement and after re-inspection, Panda Cuisine reopened Aug. 7.

Waffle House, 1912 Plaudit Place, was ordered closed on Aug. 8, 2023, after live roaches were found, as well as dead roaches in food.

Indi’s Fast Food Restaurant, 670 N. Broadway, was ordered closed on Aug. 9 due to multiple employee-related violations observed during a 30-day follow-up inspection. A conference with Indi’s management had been conducted in June due to repeated inspection failures, according to the health department. One of the conditions agreed upon was that the establishment would be randomly re-inspected within the next couple of months and that any priority items previously cited in June would result in the establishment’s closure. Indi’s was reopened on Aug. 10, 2023, with an inspection score of 94.

Papi’s Palomar, 3901 Harrodsburg Rd Suite 180, was ordered closed on Aug. 22 due to the presence of insects, among other violations. It has since reopened.

La Michoacana De Lexington, 1801 Alexandria Dr., was ordered closed on Aug. 30 for presence of insects. It has since reopened.

Zaxby’s, 1772 Sharkey Way, was closed on Aug. 31 due to having no sanitizer in the establishment. It has since reopened.

El Rey De Mariscos, 1485-1 Alexandria Dr., was ordered closed on Sept. 27 due to presence of insects, among other violations. The restaurant scored 67, the lowest score during this reporting period.

One other inspected business was shut down twice during the time frame:

Walgreen’s, 101 E. Reynolds Rd., was closed on June 8 and on Aug. 8 due to operating with raw sewage present in the basement after the health department received complaints about sewage smell in the store, according to the health department. In both instances, the sewage issue was remediated and the store re-opened the following day.

The health department also can order food items to be placed under quarantine or voluntarily destroyed; since June at least 27 restaurants destroyed hundreds of pounds of food.

Names in bold are new additions to the list. Inspection scores listed are the latest available on the health department’s database, which was last updated Oct. 11, 2023.

33 Staves, 4174 Rowan in the Origin Lexington hotel at the Summit at Fritz Farm, was placed on the list on May 17, 2023, after scoring 80. Inspection score on Oct. 2, 2023, was 91.

Ali Baba, 412 Southland Dr., was place on the list July 26, 2023, with a score of 83; inspectors ordered the quarantine/voluntary destruction of 10 pounds of pork and some milk. Inspection score on Aug. 16 2023, was 99.

AP Suggins, 345 Romany Rd., was placed on the list on April 21, 2023. Inspection score on Aug. 23, 2023, was 92.

Applebee’s Neighborhood Grill & Bar, 1761 Sharkey Way, was placed on the list July 13, 2023, with a score of 84; inspection on July 27, 2023, was 95.

Asian Bistro, 4224 Saron Dr., was place on the list Aug. 9, 2023, after scoring 82. The inspector noted the hand washing sink was blocked by a prep table and trash can with no hand cleaner or disposable towels, food stored improperly, improper sanitizing, food not clearly date marked for discard, among other issues. Inspection on Aug. 23, 2023, scored 95.

Asian Wind Restaurant, 3735 Palomar Center Dr. Suite 40, was placed on the list on Jan. 21, 2022. Inspection on Jan. 17, 2023, scored 94. Inspection on Sept. 29, 2023, scored 94; restaurant was warned on Sept. 13 for not having inspection placard posted (next violation of this type will result in automatic closure.)

Athens Food Mart, 5522 Athens-Boonesboro Rd., was placed on the list Aug. 28, 2023, with a score of 81. Inspection on Sept. 11, 2023, scored 99.

Azur, 3070 Lakecrest Circle, Suite 550, was placed on the list on June 13, 2022. Inspection on March 21, 2023, scored 94. Inspection on Aug. 7, 2023, scored 95.

Bangkok House, 275 Avenue of Champions basement, was placed on the list on Aug. 1, 2023, after scoring 82. Inspector noted a repeat violation of the food prep tabled completely blocking the only hand washing station in the kitchen, improper sanitizing, food not maintained at proper temperatures, food not properly date marked for discard, unclean surfaces and more. Inspection on Aug. 16, 2023, scored 97.

BD’s Mongolian Grill, 2309 Sir Barton Way, was placed on the list on Sept. 28, 2023, after scoring 80. Inspector noted employee personal items improperly stored including beverages on the dish machine and by food prep areas, hands not washed, hand sinks by grill area unclean and not supplied with soap and paper towels, improper dish sanitizing, pork products on the buffet line not maintained at proper temperature, employees with expired food handler cards, equipment not maintained in good repair, unclean non-food surfaces, leaking sink, standing water throughout the establishment and more.

Blaze Pizza, 4049 Finn Way #110, was placed on the list July 31, 2023, after scoring 81. Inspection on Aug. 14, 2023, scored 97.

Bluefire Bar & Grill, 401 W. High St., was placed on the list on March 29, 2022. Inspection on Aug. 30, 2023, scored 95, after an Aug. 16, 2023, inspection resulted in order of quarantine/voluntary destruction of 4 pounds of butter and 6 pounds of cottage cheese.

The inspector noted chemical spray bottles not labeled, food improperly stored, lack of required hair/beard restraints, improper sanitizing, unclean surfaces, toilet facility unclean, presence of flying insects and more. Inspection noted dead roaches in sliced onion and by sliced tomato and in ice/water below food product (food items were discarded), food not properly stored, food not kept at proper temperature, presence of live roaches in traps and flying insects in the front kitchen and back kitchen, and a live roach by the hand sink and paper towels. Restaurant has reopened.
