Jackson Mahomes’ attorney asks judge to seal several documents in sexual battery case

An attorney representing Jackson Mahomes in a sexual battery case filed a motion Tuesday requesting the Johhnson County Court allow his client to file documents under seal, according to court documents.

Brandan Davies, a lawyer with Roth Davies LLC, filed the motion on behalf of Mahomes, a TikTok and Instagram influencer charged with three felony counts of aggravated battery and a misdemeanor count of battery.

The motion specifically asks the judge to allow the attorney to file a motion and affidavit under seal on behalf of the defendant.

In February, Mahomes allegedly pushed a 19-year-old waiter and forcibly kissed the 40-year-old owner of Aspens Restaurant and Lounge at 6996 W. 151st St. in Overland Park.

In early March, Aspen Vaughn, the restaurant’s owner, and the waiter both told The Star about their encounters with Mahomes. Vaughn provided surveillance video to The Star and police that allegedly shows Mahomes grabbing her by the throat and kissing her.

According to the waiter, who asked not to be named, Mahomes came to the restaurant that night and went to the basement office with about five friends.

The waiter told police he went to the office to retrieve his water bottle, when Mahomes allegedly pushed his chest and told him not to enter, according to a redacted copy of the affidavit. After telling Mahomes he worked at the restaurant and needed to go to the office, the waiter said Mahomes allegedly shoved him again and told him to get out.

One witness in the office allegedly told police that Mahomes extended his arm toward the waiter, but she couldn’t remember if he touched him. Another allegedly told police no physical contact was made, according to the affidavit.

Mahomes later tried to apologize and allegedly told the waiter that he shouldn’t need to be asked twice to leave a room and that if Mahomes is in a room in the restaurant, it should be considered off limits, according to the affidavit.

During the investigation, the owner told police the restaurant has had problems with Mahomes before and had to kick him out.

She said that Mahomes told her he needed to speak to her in the office and closed the door once she was inside. Mahomes allegedly grabbed her throat, forced her head back and kissed her, putting his tongue in her mouth, according to the affidavit. Mahomes allegedly forcibly kissed the owner two more times without consent and told her not to tell anyone.

The owner told two nearby servers about the incident and showed them fresh signs of injury on her neck, according to the affidavit.

At one point, Mahomes allegedly returned to the office and told the owner “what he could do for her business,” but he and his friends were told to leave. Mahomes was allegedly angry, but eventually left the restaurant.

Davies did not immediately respond to a request for comment.
