WASHINGTON – Former Vice President Joe Biden said if he's president, he wouldn't interfere with the Justice Department if it pursued criminal charges against President Donald Trump after he left office.
"I will not interfere with the Justice Department's judgment of whether or not they think they should pursue a prosecution of anyone that they think has violated the law, but I think it depends on what happens," Biden said.
However, he added it's "not very... good for democracy to be talking about prosecuting former presidents."
Biden's comments were made during a virtual interview with members from the National Association of Black Journalists and National Association of Hispanic Journalists that was conducted Tuesday and published in full on Thursday.
Earlier this week, the New York Times reported that Manhattan's district attorney's office suggested in a new federal court filing that they are investigating Trump and his company for possible bank and insurance fraud.
During the interview, Biden conceded that he doesn't know many details on the New York cases but that if a future Attorney General believes charges should be pursued against Trump, then he will not stand in the way.
"If they proved to be a criminal offense, then in fact that would be up to the Attorney General to decide whether he or she wanted to proceed with it, I'm not gonna make that individual judgment," Biden said.
Trump in 2016 made headlines during a presidential debate with Democratic presidential nominee Hillary Clinton after he said he would appoint a special prosecutor to investigate Clinton and her private email server. However, several days after he was elected, Trump walked back that statement, saying that he hadn't decided officially if he would.
Biden noted that he himself will not ask his Justice Department to pursue any charges.
"In terms of saying, 'I think the President violated the law. I think the President did this. Therefore go and prosecute,' I will not do that," Biden said.
