The trial in Johnny Depp’s defamation lawsuit against Amber Heard continued on Wednesday in Fairfax, Virginia, with testimony from their former agent Christian Carino.
Heard is being sued by Depp for $50m (£38.2m) for implying he abused her in a 2018 Washington Post op-ed. Although she did not name him, he claims her allegations made it difficult for him to land movie roles.
Mr Marino testified that he felt Heard’s allegations had caused Depp to lose work but did not tie this directly to the op-ed.
He explained his friendship with the couple and said he set up a meeting between the pair two months after Heard filed a restraining order against Depp.
Mr Carino also said Heard was dating Elon Musk during the time she was attempting to reconcile with her ex and he had advised her dating famous men meant things would be public.
Further testimony was given by two police officers who responded to a domestic violence call at the couple’s penthouse in May 2016. They said they found no evidence of a crime, Heard was “uncooperative”, and did not want to file a report.
Heard is yet to testify and provide her own account of the relationship.

A video that shows Dakota Johnson noticing Johnny Depp’s injured finger has resurfaced in the wake of the actor’s legal battle with Amber Heard.
Depp has claimed in his testimony that ex-wife Heard severed his finger with a vodka bottle during an argument, a few months after their wedding in February 2015.
A TikTok user’s video, taken that year, shows the Pirates of the Caribbean actor and Johnson at a press conference, promoting their film Black Mass at the 72nd Venice Film Festival at the time.
The short resurfaced clip shows the Fifty Shades of Grey star looking down at Depp’s finger before making a comment to him about it. In response, he seemingly gives an explanation about the injury, at which point Johnson laughs and sits back in her chair.

Johnny Depp concluded his lengthy testimony by responding to a recording in which ex-wife Amber Heard could be heard pushing him to “tell the world” that he’s a victim of domestic violence.”
In a recording played in court, Heard told Depp, “tell the world, Johnny. Tell them ‘I, Johnny Depp, a man, is (sic) a victim of domestic violence’”.
One of Depp’s lawyers asked him what he said in response when he was asked if he was a victim of domestic abuse.
“I said, ‘Yes, I am,’” Depp responded.

According to further texts Heard appears to have been trying to reconcile with Depp as late as 2018 when she texted Depp that she missed him and told Mr Carino “God, I miss him.”

Mr Carino testifies he never saw Depp abuse Heard. He also testifies neither Depp nor Heard discussed abuse allegations with him. He says he never saw injuries on Heard.
He testifies that he set up the 2016 meeting between Depp and Heard at her request, two months after the restraining order was filed against Depp.
One stipulation was that she would never accuse him of violating the restraining order if he came to the meeting.
Mr Carino borrowed a friend’s house and he flew with Heard to San Francisco and drove to the house, where Depp met them.
Heard and Depp met outside inches apart for several hours.
The owner of the house notified Mr Carino that he was returning and the couple went to a hotel room in the city to continue to talk. They travelled separately to the hotel.
At the hotel, the couple argued in a hotel room.

Mr Carino is asked to read the op-ed by Heard that was published on 18 December 2018. He does so, identifies Heard as the author, and says he does not recall reading it when it was first published.
An email exchange is shown to him dated 20 December 2018 referring to an article saying that Depp will not return to the Pirates franchise. The email was sent to him by Depp’s publicist.
In the email, he asks whether this was the official word from Disney and is told no.

Mr Carino introduced Depp and Heard to Laurel Anderson, who testified earlier in the trial, when they needed help in their relationship.
Dr Anderson is a clinical psychologist who testified that the couple engaged in “mutual abuse”.
Mr Carino testifies he spoke with both Depp and Heard about the state of their relationship and each confided in him.

Court resumes after the afternoon recess and the jury is now being shown the second part of Mr Carino’s testimony.
He explains that he met Heard prior to meeting Depp, by some years. He took on her representation from a commercial perspective, identifying brands to work with and other such opportunities.
They also became friends.
When he met Depp, he began to spend time with the couple and eventually with Depp alone. He grew to consider Depp as much a friend as Heard.
Mr Carino says he is no longer friends with either of them and stopped regularly seeing Depp after he stopped being represented by CAA.
He stopped being friends with Heard “when the legal disputes started”, though he is not sure which one but says it was one between Depp and Amber — not their divorce — he remained friends with them through that period.
He says he has no animosity toward either of them.

Asked about Depp’s behaviour on the set of Pirates 5 and whether it included alcohol and drug use and tardiness, Mr Carino says he was aware of the tardiness because Depp has been tardy his whole career.
He said people were used to it and it did not cause a problem for anyone because people were used to it.
Mr Carino says there was a difference in opinion on how the movie was edited, but he does not recall the details.
He says Pirates 5 was not the most successful movie in the franchise.
Mr Carino is asked if he or anyone at CAA have made efforts with Disney to find roles for Depp since he did Pirates 5. He says he worked on the possibility of a Houdini movie, but others did.

Mr Carino testifies that Depp’s reputation regarding his professional capabilities has not changed between October 2016 and the present (the interview was recorded on 19 January 2021). He says he is still considered one of the finest actors of his generation.
He says offscreen Depp was previously known for having an air of mystery around him as to who he was because he was not visible to the public.
Asked if that changed over time, Mr Carino says it did, and that it changed with the exposure that came with the lawsuits that he was embroiled in over the years since 2016.
He says that the most significant piece of litigation against him was that Heard’s accusations would have had the most dramatic impact on his offscreen reputation. He says he is not talking about one specific accusation, but rather the things she has accused him of doing that were made public.

Mr Romero says he was not looking, but he believes marks or bruises on Heard would have been noticeable, though he has no idea if she was wearing make-up to cover anything up.
He adds that if she was covering anything up she would not be able to hide swelling.
As the questioning continues, Mr Romero is not shy about hiding his frustration with the situation and again reiterates that he just wants it all to be over.
His remarks amuse Depp and draw some laughter from the court.

Mr Drew said this was still related to the previous call and showed them the business card left by the initial two officers.
He said they were adamant that the husband (Depp) was no longer there and Officer Gatlin said it seemed they were not keen for them to enter the apartment.
Gatlin says he was aware of the call being handled earlier, but that does not mean it is treated as if it were not new.

Officer Gatlin and his partner were greeted at the apartment door by a male (Josh Drew) and they ascertained he was not the perpetrator or victim.
He was aware that officers had answered an earlier call and they had to ascertain if it was the same incident they were responding to and not a new incident.
Officer Gatlin says that just because a victim is uncooperative does not mean that they will just leave as they might see injuries or a third party might be cooperative and provide information on the incident.

Hadden reiterates that she was unresponsive and crying, but did not observe her being fearful.
It is once again said that Heard did not want to file a report. He says he does not know the reason why.

Officer Hadden says he was never close enough to Heard to examine her face, but also said her face was red and it appeared that she had been crying and he did not see the red marks as consistent with anything other than that.
Shown a picture of Heard, he said he would not have reported the incident as an injury because: “I do not see an injury.”
He adds that he saw no damage to the property or any visible injuries to her.
Officer Hadden says that the pink on her face is consistent with crying, adding: “Just because I see an individual with pink cheeks and pink eyes, doesn’t mean anything happened. They could be sad because their dog died.”
He explains that he and Officer Saenz did a protective sweep of the location where Heard was, walking through the general housing area to make sure no one else was there and to make sure no one was hurt.

Officer Hadden says he did not make a report at the time, “because the victim didn’t request a report.”
He says he did not personally discuss with Heard at the time that it was “only a verbal dispute”.
Hadden said there were other circumstances that were within this investigation as well that indicated that it was just a verbal dispute.
He discussed the investigation with Officer Saenz at the scene. Miss Heard refused any medical treatment and had no visible injuries.
Both Heard and other witnesses were uncooperative.
No photos, recordings, or notes were taken at the scene.

The jury is in and the first witness of the day by pre-recorded deposition is Tyler Hadden, a police officer with the Los Angeles Police Department.
He responded to the call made from the Depp’s Eastern Columbia Building penthouse on 21 May 2016 alongside Officer Melissa Saenz, whose testimony was heard yesterday.
In questioning by Heard’s lawyers, he reveals he was not issued a body camera until the summer of 2016 — after the reported incident at the penthouse.
As a probationary officer, he would defer to Officer Saenz who was his training officer.

Judge Penney Azcarate is at the bench and is dealing with preliminary matters before bringing in the jury.
We are expected to hear more prerecorded depositions today, including from other officers who responded to the call made from Depp’s LA penthouse.
Law & Crime reports that there may be body camera footage shown to the court.
It is also reported that their former agent may also testify. He set up the meeting between the two in the summer of 2016 after the restraining order was issued. Audio of that meeting heard earlier by the court had Depp asking Heard to cut him with a knife.

Heard’s lawyer asks why the card was left if there was no sign of a disturbance or injury.
The officer responds that she leaves the card as a courtesy to the complainant.

Dr Curry described Heard’s demeanour as polite and cooperative during her two days of evaluation.
There was one incident mentioned in her deposition at which she says Heard furrowed her brow about a question regarding high school friendships.

Asked about the “assaulting cabinets” video filmed by Heard, she says she saw the video. Asked if Depp has a personality disorder, Dr Curry said it wasn’t her task to determine that.

Asked about a meeting at Johnny Depp’s house, Dr Curry says she was interviewed by Depp’s legal team at his house ahead of legal proceedings, that he was present, and dinner and drinks were served.
Cross-examination focuses on a pleading filed ahead of the court case and how it makes statements called opinions before Dr Curry wrote her report and gave testimony.
When questioned she says that she has not testified before with respect to intimate partner violence.

Psychologist Dr Shannon Curry took the stand on Tuesday saying that she met with Ms Heard on “two separate dates” as she conducted her evaluation – 10 and 17 December 2021. She said they spent 12 hours together and that “the result of Ms Heard’s evaluation supported two diagnoses – borderline personality disorder and histrionic personality disorder”.
