Judge allows Sig Sauer case to continue

Jun. 29—CONCORD — A federal judge has rejected efforts by New Hampshire gunmaker SIG Sauer to break up a lawsuit filed by 20 people who say they were injured when the company's P320 handgun misfired.

U.S. District Court Judge Joseph Laplante said he would not transfer the cases to the 13 different states where the plaintiffs reside, given the early stages of the lawsuit.

But the judge dropped claims that SIG Sauer's P320 advertisements and marketing materials violated the New Hampshire Consumer Protection Act.

Laplante ordered that he has ruled in previous cases that a violation of the New Hampshire law can only occur when a person receives a misrepresentation within the borders of the state. The company still faces claims of negligence and product liability.

The company has faced complaints across the country about the handgun and unprompted firings.

SIG Sauer faces a similar lawsuit, filed this year in New Hampshire, that can now proceed.
