Judge to attorney: 'I haven't decided' on jail time

Dec. 15—CATLETTSBURG — Attorney Michael Curtis asked that his client be released from his ankle monitor in Boyd County Circuit Court on Thursday in front of Judge John Vincent.

"Why?" Vincent asked.

"Because there won't be jail time," Curtis responded, referring to Mark E. Hicks, 63, who was indicted last month on charges of second-degree disorderly conduct, second-degree fleeing on foot, resisting arrest, third-degree assault on an officer and first-degree strangulation.

"Well, I haven't decided there wouldn't be any jail time," Vincent said.

Hicks and his brother, Mitchell, were indicted on identical charges. The 48-year-old Mitchell is in Boyd County Detention Center. Mark Hicks remains out but on the ankle monitor.

According to prior reports, the Hicks brothers struggled with deputies when police responded to an Ironville residence on a domestic dispute call in July.

It was reported that they fought with deputies, with Mark Hicks placing one of the officers in a headlock, according to police records.

Vincent and Curtis agreed that Jan. 18 will still be the date to review Hicks's case and the entry of a potential plea.

David Mussetter, who was occupied with a federal trial in Covington recently, was in court on Thursday morning but was still catching up with everything.

Mitchell Hicks is still scheduled for a jury trial in January. A pre-trial is set for Jan. 11.
