Judge denies Danny Masterson bail, citing flight risk, lack of ‘wife to go home to’

“That ’70s Show” actor Danny Masterson was denied bail while appealing his rape convictions because he poses a flight risk, a judge ruled Wednesday.

“In light of the fact that defendant has no wife to go home to, defendant now has every incentive to flee and little reason to return to state prison to serve out the remainder of his lengthy sentence should his appeal be unsuccessful,” said Los Angeles Superior Court Judge Charlaine Olmedo.

Masterson’s wife Bijou Phillips filed for divorce in September after the disgraced actor was sentenced to at least 30 years in prison on a pair of forced rapes that occurred in 2001 and 2003. Phillips supported Masterson, 47, during his May trial, but cited “irreconcilable differences” after his lengthy prison term was handed down.

Olmedo said that because the former star could “remain in custody for decades and perhaps the rest of his life,” he has an incentive to flee if turned loose from North Kern State Prison in Delano, Calif.

Masterson’s defense team reportedly petitioned the court to release their client so he could “be an at-home parent and financial provider for his family” while awaiting appeal. Phillips and Masterson have a daughter who was 9 years old when he was convicted.

Masterson’s attorneys are hoping to overturn his convictions with “extensive exculpatory evidence” that wasn’t presented to a jury, according to Deadline.
