Judge grants motion to suppress interrogation in Robert Baron murder trial

OLD FORGE, LACKAWANNA COUNTY (WBRE/WYOU) — A Lackawanna County judge has granted a motion to suppress evidence against Justin Schuback in the alleged 2017 murder of Robert Baron.

On Thursday, January 25, Lackawanna County Judge Joseph Nealon granted the motion to exclude or suppress statements made by Schuback and said his right to counsel and his right against self-incrimination were violated.

During his interrogation with Pennsylvania State Trooper Greg Allen and Lackawanna County Detective Sheryl Turner, Schuback denied any involvement in the murder and was informed of his right to remain silent and his right to have an attorney present.

According to the court filing, Schuback stated twice during the interrogation that he needed a lawyer, and because the interrogation did not immediately end, Judge Nealon granted the motion.

According to the Judge’s order (seen above), the other motions filed by Shuback’s lawyers, which were a motion to suppress “Cell Site Location/Range-to-Tower Evidence” and the motion to change venue, were denied. So, police will still be able to use the cell site location but, anything stated in the interrogation will now be inadmissible at the trial.

Lackawanna County District Attorney Mark Powell said in a statement, “We are looking forward to proceed to trial which is set for May 6, 2024. Since the case is pending I am unable to comment further.”

Schuback has pleaded not guilty to the charges against him and a new trial date has now been set for Monday, May 6.
