Judge: Man accused of sexually assaulting minor violated probation, will return to jail

Mar. 20—LEWISBURG — A Mifflinburg man sentenced in December to four years of probation for indecent assault of a child must now serve jail time for violating the terms of his probation.

Following a revocation hearing on Wednesday, Union-Snyder County President Judge Lori Hackenberg resentenced Timothy A. Troxell, 45, to one to two years in a state correctional institution. Troxell allegedly entered Mifflinburg Area School District property, which violated a term of his probation precluding him from being in a place where children gather.

Hackenberg in December sentenced Troxell to four years of probation and 100 hours of community service, and he must pay restitution to the victim's mother in the amount of $1,570 and register for life as a tier 3 Megan's Law offender.

Troxell, accused of molesting and raping a child over a five-year period, pleaded no contest in January 2023 to two misdemeanor counts of indecent assault. In pleading no contest, Troxell did not admit guilt but acknowledged there was enough evidence against him that a jury might find him guilty.

As part of his probation conditions, Hackenberg in December ordered that Troxell must not have any contact with the victim. He cannot comment about the case on social media or any public forums. He must not have any activities close to where children gather, including parks, schools and playgrounds.

The charges were brought against Troxell in 2021. Troxell allegedly committed sexual crimes against the child at three residences in Mifflinburg along with the Best Western Inn in King of Prussia, according to arrest papers. The alleged crimes occurred between Nov. 16, 2015, and Nov. 15, 2020, including an overnight trip to King of Prussia in August 2020.

When the child was 13, she accused Troxell of sexual assault and rape, saying the incidents dated to when she was 10 years old. She described the incidents in detail and said the assaults went from occurring several times monthly to nearly daily as she grew older, according to court documents.

Troxell was originally facing two sets of criminal accusations, totaling 19 felony counts and three misdemeanors. On the first case, he was charged with two counts of rape of a child, four counts of involuntary deviate sexual intercourse, two counts of aggravated indecent assault, six counts of indecent assault, all of which are felonies, along with two misdemeanor counts of indecent assault. On the second case he was charged with statutory sexual assault, involuntary deviate sexual intercourse, aggravated assault, all felony charges, and a misdemeanor charge of indecent assault.

The remaining charges were dismissed as part of the sentencing order.
